OFFICE MEMORANDUM

Subject: Payment / Reimbursement of medical expenses to beneficiariesunder CGHS and Central Services (Medical Attendance) Rules,1944 from two sources' - From insurance agencies and from theCGHS or from the Ministry / Department.

The undersigned is directed to invile reference to the Office M£moranda, ofeven number dated the 8th January, 2004, and 27th February, 2004," vide whichbeneficiaries under CGHS and Central Services (Medical Attendance) Rules, 1944 (whohave subscribed to mediclaim policy from an insurance agency) were permitted to claimreimbursement of the medical expenditure from both the sources viz. the insuranceagency and CGHS and Ministries I Departments (as the case may be). This benefitwas subject to the condition that ~he beneficiary will first claim reimbursement from theinsurance agency and then from the CGHS or Ministry I Department concerned. Thereimbursement from the two sources was, however, not to exced the package. ratesprescribed under the CGHS for the particular treatment.

2. This Ministry had received representations from beneficiaries requesting forthe removal of the monetary 'cap' mentioned above. The main argument advanced inthe representation was that this offered the beneficiary no incentive to subscribe to themediclaim policy for reimbursement only upto the package rates as it did not providethem with any additional benefit because they would in any case get the same amountfrom the CGHS without subscribing to mediclaim policy. Chairman Insurance Regulatory& Development Authority (IRDA) also wrote to Secretary (H & FW requestingappropriate revisions in CGHS Rules so that any expenditure incurred by policyholderswhich was inadmissible as per the CGHS rules but admissible mediclaim insurancepolicies could be suitably claimed from the insurer.

3. The above have been carefully considered in this Ministry and it has beendecided I with the approval of the Competent Authority that beneficiaries who havesubscribed to Medical Insurance Policies in addition to availing CGHS facilities I CentralServices (Medical Attendance) Rules, 1944, may be allowed to claim reimbursementfrom both the sources subject to the condition that the reimbursement from suchsources should not exceed the total expenditure incurred by the beneficiary on thetreatment. The beneficiary will make the first claim to the insurance company and thesecond claim to the CGHS or the Ministry I Department concerned. The medical claimagainst the original vouchers I bills would be raised by the beneficiary first on theinsurance company, which would issue a certificate indicating the amount reimbursed tothe Director, CGHS or Head of Department of the Ministry I Department concerned.

Page 58: LOK SABHA SECRETARIAT - 164.100.47.194

2

The insurance company concerned will retain the original vouchers I bills in such cases. The beneficiary would then prefer his I her medical claim alongwith photocopies ofvouchers I bills duly certified. in ink, alongwith stamp of the insurance company on thereverse of the vouchers I bills to the concerned organisation. Reimbursement fromCGHS or other departmental source will be restricted only to the admissible amount asper approved package rates subject to the condition that the total amount reimbursed bythe two organisations does not exceed the total expenditure incurred by the beneficiary.

4. These instructions take effect from the date of issue and past cases are not tobe re-opened. and supercede earlier instructions on the subject (cited above).

4. This issues with the concurrence of IFD. Ministry of Health & Family Welfare, vide their I. D. Note No: 542/AS&FN2009 dated the 4th February. 2009.

Subject: Relaxation of procedures to be followed in considering requestsfor medical reimbursement.

The undersigned is directed to state that under the extant instructions, aCGHS card holder, who wishes to apply for reimbursement of the expenditureincurred by him / her on medical treatment of either self or his / her dependentfamily members, the present reimbursement procedure needed verification of billsand issue of essentiality certificate by the treatinq doctor, and the MedicalSuperintendent of the hospital. The process of verification of bills and issue ofessentiality certificates are time consuming with the doctor at times being busy orbeing away from office for whatever reason. This necessitated repeated visits to thehospital for getting the verification done and essentiality certificate obtained.Instructions were issued vide this Ministry's Office Memorandum of even numberdated the"20th February, 2009, to do away with the procedure for verification of billsand issue of essentiality certificate by the treating doctor, and the MedicalSuperintendent of the hospital. Ministries / authorities concerned may verify andcheck the authenticity of the claims on the basis of the prescription slip and thediagnostic report submitted by the Government servant / pensioner. In the event ofany doubt, the concerned Ministry / Authority can always get verification done fromthe hospital concerned.

2. Powers have been delegated to the Ministries / Departments to consider andapprove requests for reimbursement of medical expenses on post-facto basis.Ministries / Departments do not, however, have powers to grant post-facto approvalin cases where the beneficiary, on the basis of the recommendations of aGovernment specialist goes directly to an empanelled institution without obtainingprior approval from his / her Ministry / Department. The Ministry of Health & FamilyWelfare has received requests for delegating powers to the Ministries / Departmentsconcerned to accord ex-post facto permission in cases where an employee goes toan empanelled institution after due prescription by a Government specialist butwithout obtaining prior permission from his / her Ministry / Department.

3. The matter has been examined in the Ministry of Health & Family Welfareand it has been decided with the approval of the competent authority to delegatepowers to the Heads of Departments of Ministries / Departments to accord post-facto approval/permission in cases where an employee or his dependent familymembers go to an empanelled institution after due prescription by a Governmentspecialist but without obtaining prior permission from his / her Ministry / Department, subject to the Head of Department being satisfied with the genuineness of the
