  • Letter to the Buzz WHOA, WHOA, WHOA ....hold up a minute!

    Real Life Wisdom

NVCCA- North Valley County Condominium Association- Good Intentions, or Tom Foolery and Rascality? Well it appears to be a blend or mulligan stew of many claims and activities coming out of many points of view. But are they LEGAL? There are many misrenagulations causing discomfort for many....head aches, belly aching, and a serious pain in the gluteus maximus to mention a few. WELL INTENTIONED? Yes, a small group of small property owners wishing to clear up the whole mess and title problems. BUT the large NVCCA property owners are engaged in 11 open lawsuits clouding the property titles! In addition theres mention of possible criminal activity involving NVCCA properties. LEGAL POWER- Does the so called current board have legal power to do anything? Apparently NOT according to Judge John Petersons Memorandum of Decision on case No. 05-62166-7 Butte Federal Court back in 2005. Were all NVCCA owners notified of meetings and activity, voting? ....admittedly NO. Are all NVCCA properties bills paid? NO. Pat Kelly and Nick Chiechi voiced this in the very first NVCCA gathering and it was reiterated by Mike Mitchell of NSM (New St Marie LLC) in his meeting with SMCA (St. Marie Condo Assoc) last week. FINANCIALLY POSSIBLE? - Does NVCCA have the capacity (money) to purchase insurance and hire an attorney? Since the majority vote holder owners and ram-rodders (behind the scenes) dont pay their past due taxes or association bills, these necessities are in serious doubt! ETHICALTARIANISTICAL? - Are ALL NVCCA players ethical? By not paying their taxes and bills for services and wanting to gain control and lead NVCCA, ethics are indeed in question. QUESTION- Is all the current NVCCA activity for

the good of ALL association owners, or only for the self gain of a few? CONCLUSION- Its the same old story....follow the money or lack of and look at the condition of the buildings of various owners. MEETINGS- Last week I attended a SMCA meeting with Mike Mitchell of NSM (Missoula) in attendance. Different facts, points of view, and goals were discussed....as well as some Legal Points. Questions and answers were exchanged. The following night I attended the NVCCA gathering down at the Townhall headed up by Mary Jonas and Terry-Lee. NVCCA framework and concerns were discussed. They may be well intentioned but lack the funds for insurance and a much needed attorney. Myself, Marv Bethea and one other NVCCA unit owner attended, the rest of the many participants were SMCA unit owners. As the previous nights meeting with SMCA and Mitchell, many issues were discussed in a Q and A fashion. I posed the question: What legal authority gave who to do what? According to Judge Peterson: An incorporated or unincorporated Association must be represented by an Attorney. All properties bills must be paid before Association recognition. FOLLOW UP- As a follow up, I met with Mary and husband Bill and presented them with documents, contracts, and other Court findings in an effort to expose and educate and bring them up to speed. I asked that they share that information with Dan Dale and Terry-Lee. I wish no legal harm to befall them. (no insurance) FINAL OPINION- NVCCA is not deemed legal by a Federal Judge. Maybe it be best to back up and start over ethically and legally before going any further. Thats what I wanted to do before a large unit owner stated that he didnt want me on the board. After seeing and hearing what was in the works I withdrew my offer to serve on the NVCCA board. ~ Nick Chiechi Due Diligence - The Truth Always Prevails*comments, corrections, opinions, additional facts welcomed*
