NEVADA COUNTY SHERIFF’S OFFICE KEITH ROYAL SHERIFF/CORONER CCW PERMIT APPLICATION PROCEDURE POLICY The Sheriff ofNevada County may issue a permit to carry a concealed weapon pursuant to Penal Code Section 12050(a)(1). The Sheriff is not required to issue a concealed weapons permit nor does the applicant have a constitutional right to such a permit. Existing California laws establish criteria to be examined prior to the Sheriff issuing a concealed weapons permit. PROCEDURE Eligible citizens shall complete the standard application for concealed weapons permits to the Office of Sheriff. Applicants shall fill out completely the California Department of Justice application form. Any resident of Nevada County will be issued the appropriate application form and instructions upon request. This citizen shall be at least 21 years of age at the time of application. Proof of residency may be required. Proof of residency shall include a driver’s license or voter registration, and/or utility bills showing the actual place of residency. Post office boxes will not be sufficient to determine residency within Nevada County. It is the responsibility of the applicant to accurately complete all components of the application form. Incomplete applications shall be returned to the applicant without action. Submission of the completed applications shall be submitted to the Nevada County Sheriffs Office, CCW Unit, 950 Maidu Avenue, Nevada City, California 95959. Written notification will be given to the applicant indicating that the permit must be approved or denied within ninety (90) days of receiving the application, or within thirty (30) days after the sheriffs office receives the applicant’s criminal background check from the Department of Justice (whichever is later). GOOD CAUSE Applicants must elaborate as to their reasons for the issuance of a CCW Permit. California Penal Code Section 12050 states in part that good cause must exist for issuance of the permit.The establishment of a reasonable cause for granting of the CCW Permit is the most difficult aspect of the permit process because it is subjective. Every applicant believes that he or she always has good cause for the permit. CCW PERMIT APPLICATION PROCEDURE

POLICY

The SheriffofNevadaCountymayissueapermit to carrya concealedweaponpursuanttoPenalCodeSection12050(a)(1). basedon balancingthe individual perceptionagainstan overall considerationof publicgoodand safety.

TheNevadaCounty SheriffsOffice generallyconsiders issuing CCW Permits for abusinessor professional reason. A majority of the businessor professionalneedmustbe performed here in NevadaCounty. In making a determinationasto the reasonablecause,theSheriffwill considerall availableinformation;andwherethereexistsasufficientnexusbetweenthe approvalof the CCW and the avoidanceof Victimization, he/shewillmake that decision most beneficial to the public good and safety. The mere fear ofvictimization or desire to carry a firearm shall not be wholly insufficient; however, thesheriff in making a determinationshall rely first on objectivestandards,personalhistory,training, and a professionalevaluationof the applicant, and secondarilyon subjectivefactors.

BACKGROUND INVESTIGATION

Upon submission,theapplicationwill be reviewedfor completenessandgivento aNevadaCounty Sheriffs Office staff memberfor an interview and analysis of suitability forissuance. The purposeof the backgroundinterview is to determinethe applicant’sneedand establishsomereasonableexpectationof suitability for theCCW Permit. Informationdevelopedduringa CCWbackgroundinvestigationshallbedeemedconfidential in nature.Applicantswill be requiredto grant the sheriffs office a certification and releaseofinformation. Such information accessmay include,but is not limited to, employment,medicalandjudicial. Thefailure to providearequiredwaivershallconstitutean automaticvoluntary withdrawal of the application. Specific considerationof the applicant’sbackgroundshall addressminimally criminal, civil, and socialhistory, physicalability tohandlea firearm,andemotionalstabilityto controla firearm.

Upon review by the Sheriff or his designee,the applicantwill be notified in writingwhetheror not his CCW Permit was approvedor denied in accordancewith the timerestrictionsmentionedabove.

PERMIT RESPONSIBILITIES& RESTRICTIONS

New Permits:

Prior to the issuanceof a CCW, the applicantmust attendand successifillycompleteanapprovedgun safetycourse. This courseshallbe a minimumofeight (8) hoursin duration.Thepermitteeshallshowfamiliarizationwith eachweaponlisted on theCCWPermit.

Time Limits:

Thepermitteeis responsiblefor compliancewith any regulationor conditionsimposedbythe Sheriff. All permits havea standardconditionof “no alcohol useor illegal druguse.”The applicantwill also be held to theconditions enumeratedin “Attachments1-3” of theCalifornia Departmentof Justicestandardizedapplication. In addition, the permitteeis

responsiblefor the exerciseof good judgment and sounddecision-makingin the care,transport,holstering,discussion,display,and/oruseof a permittedweapon. Permitteesareadmonishedthat theweaponis usedfor the absolutelast line of defensewhereinall otheralternativesshortof lethal forcehavebeenexhausted.

In the eventa permitteeis detainedor arrestedby a law enforcementagency,or he/sheisasked to presentthe permit to any peaceofficer, the permittee shall comply with thedemandsofthepeaceofficermakingsucha demand.

An applicantneitherearnsnorholds anypropertyright to apermit and/orits renewal. Allpermitsaresubjectto inspectionupondemandby theSheriffor anypeaceofficer.

The Sheriff may revoke, amend,or impose any specific restrictions on the permit asdeemedreasonableandappropriateby him/her. Theserestrictionsneednot be specificallycited in the regulations,but maybe assignedeachpermit asneededor warrantedfor thepublic good.

Renewal: -

Generally,CCW licensesarevalid not to exceedtwo (2) yearsfrom the dateoflicensewiththe exceptionof ReserveDeputy licenseswhich arevalid not to exceedfour (4) years,orjudicial licenseswhich arenot to exceedthree (3) years.Applicantsare responsibleforrenewingtheir permituponexpirationwithout prior notification from the SheriffsOffice.However, theSheriffhasdeterminedthat thereshall be anannualupdateof the CCW filefor eachapplicant. The generaltwo-yearCCW will havethis annualupdatein ordertomeetthe Sheriffsrequirements.The annualupdateshall include, butnot be limited to, anupdatedphoto if therewere significant changesin appearance,a local and staterecordscheck. The fee involved for this annualupdatewill only includethe nominal countyfeecurrently in effect at the time of the update. The firearmscoursewill only be requiredeverytwo (2) years—noton the annualupdate. Thepermitteeshallshow familiarizationwith eachweaponlisted on theCCWPermit.

Weapons:

CCW Permitspursuantto this policy haveto be concealableweaponsasdescribedby theCalifomia Penal Code. Weapons approved shall be the product of a recognizedmanufacturer,free from mechanicaland other flawswithin tolerancesdeterminedby themanufacturer’sspecificationsand in good working order. Weaponsmust also appearonthe“Not UnsafeGun” list producedby the CaliforniaDepartmentof Justiceasa resultoftheSafeGun Act of 2001.

Revocationor SeizureofPermit:

The Sheriff reservesthe right to revoke,seize,amend,or not renewany CCW Permit atany time. When a CCW Permit is revoked, seized,amended,or not renewed, the

Undersheriffmay, but is not obligatedto hearmattersof mitigation as presentedby theapplicant. The Sheriff is the final authority in all contestedpermitsor restrictions. Aspreviouslystated,permitsshall be surrenderedto apeaceofficer upondemand.Failuretodo so shallconstitutegroundsfor immediaterevocationofthepermit by the Sheriff

NumberofWeaponsAllowed PerPermit:

Permits shall normally be limited to not more than three (3) weapons. All weaponsauthorizedby the permit must be registeredto the applicantprior to the permit beingissued.

ChangeofAddressor Weapons:

Eachpermitteeshallprovide the sheriffsoffice within ten (10) daysa changeofphysicaladdress.This shall be donein personat the sheriffsoffice, so a newpermit canbe issuedreflectingthechangeof address.

Any changein weaponsshall also be completedwithin ten (10) daysaswell. Weaponryinformationshall include, but not be limited to, typeof weapon(eitherpistol orrevolver),manufactureroftheweapon,make,modelandserialnumber,barrellength,and color.

Sheriff’s Office Employees:

Not all departmentemployeesby merevirtue of their employmentpossessreasonablecauseforpossessionofa CCW Permit. This determinationshallbemadeon an individualbasis. Departmentemployeesshall be subjectto the samefees as citizens would be.Departmentemployeesalreadysubjectedto the law enforcementbackgroundinvestigation,psychologicalexamination,or relatedphysical,emotional,or characterexaminationsneednot repeatthoseunlessthereis specific causedeterminedby the Sheriff ThegrantingofaCCW Permit to amemberofthe departmentshallbe specificallynotedandpostedin thatemployee’sofficial personnelfile locatedin SheriffsAdministration.

All departmentemployeesapplyingfor a CCW Permit mustmeetthe following minimumqualifications. Theymusthavecompletedtheir initial probation,not be the subjectof aninternalinvestigationnorundergoinga disciplinaryaction,havea currentevaluationreportthat is ratedat least “satisfactory” or higher, have completeda courseof instructionapproved by the Sheriff, or approval by a departmentrangemasterof satisfactorycompletionof a departmentalsponsoredrangeprogramthat theemployeewould normallybe requiredto attend.

Pursuantto U.S. GovernmentCode - Title 49, Chapter26, Section 1472 (1) andFederalAviationRegulation121.583, alicenseto carry a concealedweapondoesnot authorizea personto carry afirearm, tear gas,or any dangerousweaponaboardcommercialairlines. Further,a personmustdeclarethathe/sheis carryingsuchfirearm,teargas,ordangerousweaponBEFOREenteringtheboardingareaof an air terminalwherethe securitychecksaremade. Such violation canresultinarrestby law enforcement.

secure.(3) Thefirearm is carriedon thepersonorwithin sucha closeproximity theretosothat the individualcan

readily retrieveandusethe firearm asif carriedon the person.(4) The firearmis lockedwith a locking devicethathasrenderedthefirearm inoperable.(5) The personis a peaceofficer ora memberofthearmedforcesornationalguardand thechild obtains

the firearm during, orincidentalto, theperformanceof theperson’sduties.(6) The child obtains,orobtainsanddischarges,the firearm in a lawful actof self-defenseordefenseof

(c) A pistol,revolver,orotherfirearmcapableofbeingconcealeduponthepersonthat a childgainsaccesstoand carriesoff-premisesin violation of this Sectionshall be deemed“used in the commissionof anymisdemeanorasprovidedin this codeoranyfelony” for thepurposeofsubdivision(b)of Section12028regardingtheauthorityto confiscatefireannsandotherdeadlyweaponsasa nuisance.

(d) This Sectionshall notapplyif anyoneofthefollowing circumstancesexists:(1) Thechild obtainsthepistol,revolver,orotherfirearmcapableofbeingconcealeduponthepersonas

aresultofan illegal entryinto anypremisesby any person.(2) Thepistol, revolver,orotherfirearm capableofbeingconcealeduponthepersonis keptin a locked

containeror in a locationthat a reasonablepersonwould believeto be secure. -

(3) The pistol, revolver,orother firearm capableof beingconcealedupon thepersonis lockedwith alocking devicethathasrenderedthe firearm inoperable.

(4) The pistol, revolver,or otherfirearm capableof being concealedupon thepersonis carriedon thepersonwithinsucha closerangethattheindividualcanreadilyretrieveandusethefirearmasif carriedon theperson.

(5) Thepersonis apeaceofficerora memberofthearmedforcesornationalguardandthechild obtainsthepistol,revolver,orotherflrearmncapableofbeingconcealedupon thepersonduring,or incidentalto, the performanceoftheperson’sduties.

(6) The child obtains,or obtainsanddischarges,thepistol, revolver,orotherfirearmcapableofbeingconcealeduponthepersonin alawful actofself-defenseordefenseofanotherpersonorpersons.

(7) Thepersonwho keepsapistol,revolver,orotherfirearmcapableofbeingconcealedupon the personhasno reasonableexpectation,basedon objectivefactsandcircumstances,that achild is likely to bepresenton thepremises.
