The interested Service providers are requested to submit the tender documents in the prescribed form duly signed and stamped, in a sealed cover addressed to the Commissioner of Customs, Custom House, Willingdon Island, Cochin -682009. The format of the “Technical Bid” are enclosed as Annexure I & II to the Terms and condition/ Invitation for bids. The tenders received unsigned/incomplete and/or filed after the due date shall be summarily rejected.

Rental/Agency/Firms for hiring of the 01 vehicles along with Drivers for the Office of the Commissioner of Customs, Custom House, Willingdon Island, Cochin -682 009. The bidders should follow the instructions and conditions given below while submitting the tenders.

बोिी िृाने िािों के किए अनुदेश

INSTRUCTIONS TO BIDDERS

1. सेिा प्रदाता अन् ु सभी अपेति जक्षत दथ तािेों ों के साि सिंिग् न प्रारूपति के अनसुार सिािा सिंपति रणा अपति नी बोकिुािं प्रथ ततु/िमा कर सकते ैं। अिृ-अिृ मु रबिंद तकनीकर और वित् तीु बोकिुों के सिंबिंकधत किफाफों पति र ‘’ कनीकी‍बोयी’’ ुा ‘’वित्‍ ीु‍बोयी’’ किखा िाना िाक ए और इनको एक मु रबिंद किफाफे में रखा िाना िाक ए तिा इसके ऊपति र ‘’गाड़ी‍डकराए‍पर‍येने‍हे ‍ुचनविदा‍2015-16’’ किख कर कदनािंक 15 िरन, 2015 को 13.30 बिे तक प्रथ ततु करना िाक ए।

The Service Providers may submit/ deposit their bids, complete in all respects as per Proforma annexed, along with other required documents. Separate sealed Technical and Financial bids should be clearly marked “ Technical Bid” or “Financial Bid” on the respective envelopes and should be kept in a single sealed envelope and super-scribed with “Tender for Hiring of Vehicles 2015-16” latest by 15th June 2015 by 13.30hrs.

2. तकनीकर बोिी में ककतनी ृाकडुों के माकिक ैं (यरसी बकु कर प्रकत के रूपति में दथ तािेों ी सबरत प्रथ ततु ककुा िाना िाक ए), उनका मेक, मॉडि और पति िंिीकरण सिंख् ु ा, ककसी कें द्र सरकार/राज् ु सरकार/कें द्रीु ुा राज् ु पति ीएसुर/प्रकतवित कनिी किं पति नी/एमएनसी यकद को सफितापति रिाक सेिा प्रदान करने सिंबिंधी अनुभि का प्रमाणपति ि यकद वििरण, सेिाकर पति िंिीकरण एििं पति नै काडा कर प्रकतुािं शाकमि ोनी िाक ए।

प्रथ ताि के प्रत् ु ेक पति हष्‍ट पति र प्रथ ताि पति र थ ताक्षर करने िािे ‍ ु वयुों के थ ताक्षर, नाम और पति द एिेंसी कर रबड कर मु र एििं तारीख के साि किखा ोना िाक ए। प्रारूपति अनबुंध-। में कदुा ृुा ै।

The Technical bid should contain details such as number of vehicles owned (documentary evidence in the form of copy of RC book should be submitted), their make, model and Registration nos., experience certificate for successfully executing service for any Central Govt. Office/State Govt./Central or State PSU/reputed Pvt. Company/MNC. Copies of Service Tax Registration, PAN card. Each page of the offer should bear the signature, name and title of the persons signing the offer with rubber stamp of the agency and date. The proforma is given in Annexure – I.

3. वित् तीु बोिी में प्रत् ु ेक श्रणेी के अिंतृात िृाई िाने िािी बोिी के किए अिृ-अिृ रूपति से प्रकत ृाडी कर प्रकत मा प्रभातरत राकश शाकमि ोनी िाक ए। प्रारूपति अनबुंध-।। में कदुा ृुा ै।

The Financial Bid should contain amount charged per month per vehicle, each shown separately, for bid under each Category. The proforma is given in Annexure – II

4. केिि तकनीकर बोकिुों में पति ाि ोने िािे सेिाप्रदाता िं कर वित् तीु बोकिुािं ी खोिी िाएिंृी।

Financial bid of only those service providers would be opened who have qualified in respect of the Technical bids.

5. कोट कर ृई दरों में सेिाकर का घटक शाकमि न ीिं ोना िाक ए।

The rates quoted should be exclusive of the service tax component.

6. बोिीकताा को, कनविदा िं को खोिने के किए ृक त सकमकत द्वारा इनको खोिते समु उपति जथित र ने का अकधकार ै। तकनीकर रूपति से पति ाि ोने िािे बोिीकताा िं कर वित् तीु बोकिुािं ी खोिी िाएिंृी।

The bidder has the right to be present at the time of opening of the tender by a Committee constituted for the purpose. The financial bids of only those bidders who technically qualify will be opened.

बोिी िृाने िािों के किए सामान् ु कनुम एििं शतें

GENERAL TERMS AND CONTITIONS FOR THE BIDDER

1. सिंिग् न अनबुिंध-।। में कोट कर ृई दर ककसी िाजणजज्ुक प्रुोिन के किए पति िंिीकह त ृाडी के किए ै िो नई ो ुा अकधकतम एक िषा पति ुरानी ो, सफेद रिंृ कर ो तो बे तर ै और जिसकर कोई दघुाटना न ुई ो, बे तरीन रकनिंृ किं डीशन में ो और सीट ए्‍ थ टीतरुर/इिंटीतरुर ो, और जिसका ककराए पति र िेने कर अिकध के दौरान उनके द्वारा अनुरक्षण ककुा िाना िाक ए। सीटें साफ सफेद रिंृ के टािि से ढ़कर ोनी िाक ए और इन् ें र फ्ते बदिना िाक ए। नई ृाकडुों को िरीुता दी िाएृी।

Rate quoted in Annexure - II attached is for a commercially registered vehicle that is new or maximum one year old, preferably of White Colour and without any accident history, in excellent running condition with seat exteriors/interiors, which they shall also maintain during the period of hire. The seats shall be covered with Clean White Towels and the same shall be replaced every week. Preference would be given to new vehicles.

2. अृर ककराए पति र िेने िािे विभाृ को यिश् ुकता पति डती ै, तो शकनिार, रवििार और छुट्टी के कदनों सक त ककसी भी कदन ृाडी उपति िब् ध करिानी िाक ए।

The vehicle shall be provided on any day including Saturday, Sunday and Holidays, if required by the hiring Department.

3. ककिोमीटर कर ृणना करने के किए शरन् ु यधातरत माइिेि अिाात ््ुरटी ुा ड्रोपति िोकेशन से/तक शुरू ोने िािा ुा खत् म ोने िािा माइिेि अपति नाुा िाएृा।

Zero based mileage i.e mileage starting and ending at/from duty or drop off location shall be adopted for the purpose of calculating the kilometers.

4. ृाडी रोों 06.00 बिे तरपति ोटा ोनी िाक ए और 21.00 बिे तक काुाािु के कनुिंिणाधीन र ेृी। तिावपति , ब ुत ों रूरी मामिों में इस सिंबिंध में ककसी अकततर्‍ त िाृत के वबना अकधक समु तक ृाडी कर यिश् ुकता पति ड सकती ै।

The vehicle would be required to report at 06.00 hrs every day and will remain at the disposal of this office until 21.00 hrs. Nevertheless, in case of any exigent

circumstances, the vehicles would be required for longer period at no extra cost on this account.

5. उनके पति ास सिंपति का करने एििं कदन-रात सेिा प्रदान करने कर ‍ ु िथ िा ोनी िाक ए।

They should have arrangements for establishing contact and round the clock service.

6. कोट कर ृई दरों में सेिा कर शाकमि न ीिं ोना िाक ए और सेिा कर के किए पति ाि सेिा प्रदाता िं को सेिा कर कर प्रकतपति रकता कर दी िाएृी। सेिा प्रदाता को सेिा कर के भुृतान का प्रमाण भी प्रथ तुत करना िाक ए।

The rates shall be quoted exclusive of Service Tax and Service Tax will be reimbursed for service providers who are liable to Service Tax. The Service provider shall also produce proof of payment of Service Tax.

7. माकसक यधार वबिंकििंृ कर िाएृी और अृिे म ीने कर 5 तारीख तक वबि प्रथ ततु करने ोंृे।

The billing will be done on monthly basis and bills are to be submitted by the 5th of the succeeding month.

8. ेकेदार द्वारा 30 कदनों के नोकटस पति र ेके को समाप् त ककुा िा सकता ै।

The contract can be terminated by the contractor giving 30 days notice.

9. ेके कर अिकध के दौरान ककसी भी कारणिश थ िीकह त दरों में िहवक के अनुरोध पति र वििार न ीिं ककुा िाएृा।

During the period of contract, no request shall be entertained for any hike in the agreed rates due to any reason.

10. उपति िब् ध कराई ृई ृाडी भारत में िा रृ कनुमों के अनसुार ोनी िाक ए।

The vehicle provided should comply with the laws in force in India.

11. ड्राइिरों के पति ास िा रृ कनुमों के अनुसार िैध ड्राइवििंृ िाइसेंस ोना िाक ए और िे पति ुााप् त अनुभिी ों, और कशष्‍ट टता, सभ् ु ता, अच् छी यदतें बरतें तिा अच् छे सफेद कपति डों में र ें।

The drivers should have valid driving license complying with the laws in force and they should be adequately experienced, and maintain decency, politeness good habits and should be in good white attire.

12. ड्रािरों के पति ास सिंपति का करने के किए काम करने िािा मोबाइन फोन ोना िाक ए इसका खिाा िे थ िुिं उ ाएिंृे। ड्राइिरों को कोकिन युु्‍ तािु के के्षिाकधकार के अधीन यने िािे सभी राथ तों एििं थ िानों का अच् छी तर पति ता ोना िाक ए। ड्राइिर/सेिाप्रदाता को रोों ाना कर माइिेि दिा करने के किए अपति ने पति ास एक करपति शीट रखनी िाक ए।

The drivers should be equipped with functional mobile phone at their cost, for contact purposes. The drivers should be well versed with the routes and locations falling under the jurisdiction of Cochin Commissionerate. The driver/service provider shall maintain a trip sheet of each vehicle indicating the day to day running mileage.

13. ककराए पति र किए िाने के बाद ृाडी का प्रुोृ ककसी अन् ु काम के किए न ीिं ककुा िाना िाक ए, और ृाज डुािं तिा ड्राइिर विभाृ के पति रणा पति ुािेक्षण में काम करेंृे जिसके किए िे िो भी काुा यिश् ु क समझा िाए ि करेंृे।

Once hired, the vehicle will not be put to use for other purposes, and the vehicles and drivers will work under the overall supervision of the department for which they will do all as is necessary.

14. ककराए पति र किए िाने के बाद ककराए पति र िेने िािे कर काुाात् मकता सुकनजश् ित करने के किए सेिा प्रदाता को ृाज डुों एििं ड्राइिरों में फेर-बदि न ीिं करना िाक ए, ऐसे अिसरों को छोड कर िब ककराए पति र िेने िािा ककसी सिंभा‍ ु ता ुा अनौकित् ु ता के मामिों में ऐसा करने का सिंकेत दें।

In order to ensure day to day functionality of hirer, once hired, service provider shall not keep changing or rotating vehicles and drivers, except if the hirer so indicates in the case of eventuality or unsuitability.

15. कोई भी ‍ ु वय िो सरकारी सेिक ुा विभाृ का कमािारी ो, सेिा प्रदाता के रूपति में कोट करने का पति ाि न ीिं ै।

Any person who is in government service or an employee of the department is not eligible to quote as Service Provider.

16. सेिा प्रदाता िा रृ श्रम कनुमों और इस सिंबिंध में सेिा प्रदाता कर सभी देुता िं का पति ािन करेृा।

The Service provider will comply with the labour laws in force and all liabilities in this connection be with of the Service provider.

17. अृर ेका कदुा िाता ै, तो सेिा प्रदाता द्वारा ृाडी का पति ररा वििरण, यरसी बुक कर प्रामाजणत प्रकत, पति ररी बीमा पति ॉकिकसुािं और इसके साि-साि तैनात ड्राइिरों, उनके पति ते, उनके ड्राइवििंृ िाइसेंसों कर प्रकतुों यकद का वििरण विभाृ को कदुा िाना अपेति जक्षत ै।

If the contract is awarded, the service provider is required to provide the department the complete details of the vehicle, certified copy of the RC book, comprehensive insurance policies as well as full details of deployed drivers, their addresses, copies of their driving licences.

18. ककराए पति र िेने कर अिकध के दौरान ुा इसके बाद सेिा प्रदाता के ककसी भी कमी को नौकरी प्रदान करने का विभाृ का कोई भी दाकुत् ि, कानरनी ुा अन् ु , न ीिं ोृा। विभाृ, अपति ने और सेिा प्रदाता द्वारा तनैात ककमाु ों के बीि कनुो्‍ ता-कमािारी के सिंबिंध को मान् ु ता न ीिं देता ै। ककराए पति र रखे िाने कर अिकध के दौरान सेिा प्रदाता द्वारा तैनात ड्राइिर ुा ‍ ु वय को िृने िािी ककसी भी िोट ुा ृाडी को पति ुिंिने िािी क्षकत के मामिे में यकिाक रूपति से ुा अन् ु ककसी प्रकार से विभाृ कर कोई जिम् मेदारी न ीिं ोृी।

The department will not be under any obligation, legal or otherwise, to provide employment to any of the personnel of the service provider during or after the expiry of the hire period. The department recognizes no employer-employee relationship between the department and the personnel deployed by the service provider. The department shall not be responsible financially or otherwise for any injury to the driver or person deployed by the service provider during the course of hire and any damage to the vehicle.

19. ककसी दघुाटना ोने कर जथिकत में, इसके त त ककए िाने िािे दािों और ोने िािी क्षकतुों कर प्रकतपति रकता सेिा प्रदाता द्वारा ी कर िाएृी।

In case of any accident, any and all the claims and damages arising there from shall be met by the service provider.

20. सेिा प्रदाता को इस बात का उत् तरदाकुत् ि िेना ोृा कक ि सेिा प्रदाता ुा उसके थ टाफ ुा उसके कनुिंिणाधीन ककसी ‍ ु वय द्वारा सेिा में, दघुाटना/ककसी ‍ ु वय का घाुि ोना ुा यम िनता ुा ककसी ‍ ु वय कर सिंपति वति को नुकसान पति ुिंिना यकद िैसी िापति रिा ी ुा इससे िडेु कारणों से ुा काुा करते समु अििा अन् ु ककसी प्रकार से ोने िािी क्षकतुों/प्रभारों और तत् सिंबिंधी दािों और मािंृों से सुरजक्षत रखेृा।

The service provider shall undertake to indemnify the department against all damages/charges arising on account of or connected with the negligence of the service provider or his staff or any person under his control whether in respect of accident /injury to the person or damages to the property of any member of the public or any person or in executing the work or otherwise and against all claims and demands thereof.

21. अृर ककराए पति र िी ृई ृाडी में कोई खराबी यती ै, तो सेिा प्रदाता ु सुकनजित करेृा कक उसी प्रकार कर दरसरी ृाडी प्रािकमकता यधार पति र उपति िब् ध कराई िाए और िैकजल्पति क ‍ ु िथ िा करने में असफि ोता ै, तो विभाृ को दरसरी ृाडी ककराए पति र िेने का अकधकार ोृा और इस प्रकार ककसी ृाडी को ककराए पति र िेने के किए ोने िािी िाृत का भुृ तान सेिा प्रदाता को करनी पति डेृी। In the event of the hired vehicle developing snags the service provider will ensure that a replacement of similar vehicle is provided on priority and in case of failure to make alternative arrangement, the Department will be at liberty to hire other vehicle and the cost incurred on account of such hiring shall be at the expense of the service provider.

22. विभाृ को वबना कोई कारण बताए सात कदनों का नोकटस दे कर ेके को समाप् त करने ुा ृाज डुों कर सिंख् ु ा कम करने का अकधकार ोृा।

The department reserves the right to terminate the contract or reduce the number of vehicles without assigning any reason by giving seven days notice.

23. ृाडी पति र कद्वभाषी (क िंदी और अिंगे्रिी) में सामने और पति ीछे कर तरफ ‘’ऑन ्ुरटी’’ ‘’कथ टम् स’’ का साइनबाडा िृा ोना िाक ए।

A signboard bearing “On Duty” “Customs” should be displayed on the vehicle in bi-lingual (Hindi and English) both in the front and rear sides.

24. ेकेदार को 31 कदनों के किए प्रकतमा अकधकतम 2000 कक.मी. तक के किए अपति नी दरें कोट करनी िाक ए।

The contractor should quote his rate for the vehicle used for 31 days up to a maximum of 2000 Kms per month.

25. अकधक ुा कम ककिोमीटर ििने पति र ेके कर समाकि तक अृिे म ीनों में इसका समाुोिन ककुा िाएृा।

Any excess or short run kilometers will be adjusted in the subsequent months until the end of the contract.

26. विभाृ कोई अकग्रम भुृतान न ीिं करेृा और फिं ड कर उपति िब् धता के यधार भुृतान ककुा िाएृा।

Department shall not make any advance payments and the payment will be made as per the availability of funds.

27. सीमाशुल् क युु्‍ त, सीमाशलु् क ृह , विजल्ििंृटन यईिेंट, कोकिन-682009, इस काुाािु में ककराए पति र िी ृई ृाकडुों के प्रुोृ के अनुरूपति अन् ु शतों, िा े थ पति ष्‍ट ट रूपति से उजल्िजखत न ों, को पति ररा करने कर अपेति क्षा रखने और ककसी एक ुा सभी कनविदा को वबना ककसी कारण बताए रद्द करने का अकधकार रखते ैं।

The Commissioner of Customs, Custom House, Willingdon Island, Cochin -682 009 reserves the right to require fulfillment of other conditions, not expressly mentioned, which are consistent with use of vehicles on hire with this office, and to reject any or all tenders without assigning any reason thereof.

28. इस समझौते के त त विकशष्‍ट ट रूपति से शाकमि न ककए ृए ककसी भी मामिे के बारे में सीमाशुल् क युु्‍ त, सीमाशुल् क ृह , विजल्ििंृटन यईिेंट, कोकिन द्वारा कनणाु किुा िाएृा, उनका कनणाु अिंकतम, कनणााु क एििं दोनों पति क्षों के किए बाध् ु ोृा।

Any matter during the period of contract, which has not been specifically covered by this agreement, shall be decided by the Commissioner of Customs, Custom House, Cochin whose decision shall be final, conclusive and also binding on both parties.

In case of any disagreement or dispute arising between the contractor and the Government under or in connection with the terms and conditions, they shall make every effort to resolve amicable by direct informal negotiations, even then, if any disagreement or dispute arising between them shall be settled under the Court of Law having its jurisdiction at Cochin. The resultant contract will be interpreted under Indian Laws
