Mayor Parisi read the following proclamation for Councilwoman Patricia Drimones:

PROCLAMATION

WHEREAS, the Mayor & Council of the Borough of Englewood Cliffs wish to honor outstanding dedication and excellence of service; and

WHEREAS, the Mayor and Council especially wish to honor Patricia Drimones, Councilwoman in the Borough of Englewood Cliffs; and

WHEREAS, Mrs. Drimones’ tireless dedication to all children, parents and senior citizens of Englewood Cliffs knows no bounds; and WHEREAS, her expertise as a Certified Social Worker provided insight and guidance while diligently working on the vast improvements to our summer camp over these last ten years; and

WHEREAS, her dedication to the families of Englewood Cliffs provided the encouragement to institute an extended day summer camp program; and

WHEREAS, not only did Mrs. Drimones serve the Englewood Cliffs Mayor and Council from 1997 through 2008, she also served the Englewood Cliffs Board of Education from 1988 through 1996; and WHEREAS, Mrs. Drimones served both entities with integrity, sincerity and passion in all areas of Englewood Cliffs Government; and WHEREAS, Mrs. Drimones, a lifelong resident of Englewood Cliffs as well as a dedicated public servant, will always be held in the highest esteem and forever present in our hearts. NOW, THEREFORE, BE IT RESOLVED that the Borough of Englewood Cliffs Mayor and Council honors Councilwoman Patricia Drimones and expresses their sincere appreciation for her outstanding dedication to the Borough of Englewood Cliffs and its residents; and BE IT FURTHER RESOLVED that the Englewood Cliffs Mayor and Council wish their friend, Councilwoman Patricia Drimones, and her entire family good health and happiness always.

WHEREAS, not only did Mrs. Norton serve the Englewood Cliffs Mayor and Council from 2002 through 2008, she also served the Englewood Cliffs Board of Education from 1995 through 2002; and WHEREAS, Mrs. Norton served both entities with integrity, sincerity and passion in all areas of Englewood Cliffs Government; and WHEREAS, Mrs. Norton, a lifelong resident of Englewood Cliffs as well as a dedicated public servant, will always be held in the highest esteem and forever present in our hearts.

Mayor Parisi stated to both that a proclamation does not do justice to all the service they have performed. They kept him as Mayor, the Council and all departments on task. They treated the budget and borough as their own and maintained a beautiful town. Love both, they will be missed. Senator Weinberg, Assemblywoman Huttle, and Assemblyman Johnson presented Mrs. Drimones and Mrs. Norton with resolutions passed by the New Jersey Senate and Assembly.

Senator Loretta Weinberg addressed the meeting; she thanked Mrs. Drimones and Mrs. Norton for their dedication of service, she acknowledged that local office, of which she also served, is one of the most difficult of offices to serve. Assemblywoman Valerie Vanieri Huttle also addressed the meeting; she recalled working with Mrs. Drimones and Mrs. Norton, supporting each other and working for the good of the community. They share a special bond as women elected officials. Assemblyman Gordon Johnson addressed the meeting; he noted the difficulty being on the first line of defense of government, dealing with budgets, schools, and the many other issues which arise locally. He thanked and congratulated them for their service. Lynn Norton spoke to all on behalf of herself and Pat Drimones; to friends, family, and all we met along the way, it means so much to have you here. She recognized the contributions of the Senator, Assemblyman, and especially Assemblywoman Valerie Huttle for her involvement in securing the funding for Englewood which was instrumental in getting the school injunction lifted. Thank you to the Council and all others who have done wonderful things for the town and us. Mayor Parisi invited everyone attending the meeting to go to the Bicycle Club for a reception he arranged for Lynn and Patricia. The meeting continued. RESOLUTIONS: On a motion by Councilman Manolio, seconded by Councilman Kasoff, the meeting was opened to public comment on resolutions 2009- 17. RESOLUTION NO 2009-17

WHEREAS, the Planning Board of the Borough of Englewood Cliffs, Bergen County, State of New Jersey, adopted the Housing Element of the Master Plan on January 8, 2009;

WHEREAS, a true copy of the resolution of the Planning Board adopting the Housing Element is attached pursuant to N.J.A.C. 5:96-2.2(a)2; and

WHEREAS, the Planning Board adopted the Fair Share Plan on January 8, 2009; and WHEREAS, a true copy of the resolution of the Planning Board adopting the Fair Share

Plan is attached pursuant to N.J.A.C. 5:96-2.2(a)2.

NOW THEREFORE BE IT RESOLVED that the Governing Body of the Borough of Englewood Cliffs, Bergen County, State of New Jersey, hereby endorses the Housing Element and Fair Share Plan as adopted by the Borough of Englewood Cliffs Planning Board; and

BE IT FURTHER RESOLVED that the Governing Body of Borough of Englewood Cliffs, pursuant to the provisions of N.J.S.A. 52:27D-301 et seq. and N.J.A.C. 5:96-3.2(a), submits this petition for substantive certification of the Housing Element and Fair Share Plan to the Council on Affordable Housing for review and certification; and

BE IT FURTHER RESOLVED that the names and addresses for all owners of sites in the Housing Element and Fair Share Plan has been included with the petition and is as follows: Owner: Borough of Englewood Cliffs, 10 Kahn Terrace, Englewood Cliffs, New Jersey 07632 Site location: Department of Public Works, 342 Hudson Terrace, Englewood Cliffs, New Jersey 07632, ; and

BE IT FURTHER RESOLVED that notice of this petition for substantive certification shall be published in a newspaper of countywide circulation pursuant to N.J.A.C. 5:96-3.5 within seven days of issuance of the notification letter from the Council on Affordable Housing’s Executive Director indicating that the submission is complete and that a copy of this resolution, the adopted Housing Element and Fair Share Plan and all supporting documentation shall be made available for public inspection at the Borough of Englewood Cliffs municipal clerk’s office

RESOLUTION NO. 2009-22 RE: AWARD BID – Elevator Inspections for the Year 2009

WHEREAS, the Borough of Englewood Cliffs has received bids for the furnishing of Elevator Inspections for the year 2009; and

WHEREAS, the bids have been reviewed by the Municipal Attorney; and

WHEREAS, the Mayor and Council are desirous of awarding the contract to the bidder providing the lowest cost to the Borough; and

WHEREAS, EIC Inspection Agency Corp., has provided the lowest total cost in the amount of 65% of the State Fees; and

WHEREAS, it is the recommendation of the Municipal Attorney that the contract be awarded to EIC Inspection Agency Corp.,

NOW, THEREFORE, BE IT RESOLVED, that the Mayor and Council does hereby

award the contract for the Elevator Inspections of Englewood Cliffs for the year 2009 at a cost of 65% of the State Fees, subject to the agreement being executed in accordance with the Bid Specifications, and that the Borough Attorney is hereby authorized to prepare the appropriate Agreement and the Mayor is authorized to sign same.

BE IT FURTHER RESOLVED that all persons who have previously received bid

documents from the Borough be notified of the passage of this Resolution when and if it is passed and the second and third lowest bidders’ papers be retained until such time as the agreement is signed. On a motion by Councilman Plawker, seconded by Councilman Manolio, the meeting was opened to public comment on resolutions 2009-23, 24, 25, 26, 27, and 31. Carried. No comments were made. On a motion by Councilman Manolio, seconded by Councilman Perin, the meeting was closed to public comment. RESOLUTION 09-23

RE: APPOINT VOLUNTEER FIREMAN WHEREAS, the Englewood Cliffs Volunteer Fire Department has recommended the appointment of George J. Sardis as an active member of the Englewood Cliffs Volunteer Fire Department;

NOW, THEREFORE BE IT RESOLVED that the Mayor and Council of the Borough of Englewood Cliffs does hereby approve the membership of George J. Sardis as an active member of the Englewood Cliffs Volunteer Fire Department.

RESOLUTION 09-24 TITLE: ESTIMATE #2 & Final, Improvements to Kahn and Clendenin Place WHEREAS, Boswell McClave Engineering has recommended that Estimate Certificate #2& Final in the amount of $3,382.00 be paid; and

WHEREAS, the amount of the total contract amount was reduced by $8,408.32 due to change order #1. NOW, THEREFORE, BE IT RESOLVED, that the Mayor and Council of the Borough of Englewood Cliffs, does hereby approve the payment of $3,382.00 to English Paving Co., Inc. for work completed to date on the Improvements to Kahn and Clendenin Place project. BE IT FURTHER RESOLVED, that Boswell McClave Engineering has forwarded a two year maintenance bond in the amount of $25,368.98 which is on file in the clerk’s office.

RESOLUTION 09-25

WHEREAS, the Borough of Englewood Cliffs has previously provided by Ordinance No. 2000-08 for contributions to be made pursuant to LOSAP; and

WHEREAS, at the present time these contributions are $1,441.00 per eligible member;

and WHEREAS, the Mayor and Council is desirous of increasing these payments based upon

the increase of the Consumer Price Index for the year 2008, thereafter increasing the payments to $1,481.00, and the payments for the year 2009 shall be based upon any increase in the Consumer Price Index for the year 2009, over the year 2008.

NOW, THEREFORE, BE IT RESOLVED that the payments the municipality shall

make for all eligible members of LOSAP shall be $1,441.00 for the year 2009.

RESOLUTION 2009-26

BE IT RESOLVED, that the Mayor and Council of the Borough of Englewood Cliffs does hereby approve the hire of two interns to perform duties on behalf of the Shade Tree Commission; and

RESOLUTION 09-27 RE: ANNUAL MEETING NOTICE - N.J.S.A. 10:4.8d WHEREAS, the Mayor and Council of the Borough of Englewood Cliffs has established their Caucus and Regular meeting dates for the year 2009. The Regular Meetings will be held on the second Wednesday of each month, unless otherwise indicated by resolution 09-27, at 8:00 PM at the Municipal Building, 10 Kahn Terrace, Englewood Cliffs, New Jersey. Caucus meetings will be held at 6:30 PM. on the same nights as the regular meetings at 482 Hudson Terrace, Englewood Cliffs, New Jersey. Action may be taken at either meeting. RESOLUTION 2009-31 BE IT RESOLVED; that the Englewood Cliffs Mayor & Council authorizes the Police Chief and Deputy Police Chief to negotiate a lease buyout for the 2006 GMC Yukon previously leased to the Borough by Martin Cadillac; and BE IT FURTHER RESOLVED, that the negotiations not exceed $20,900.00 On a motion by Councilman Manolio, seconded by Councilman Plawker, the meeting was opened to public comment on resolutions 2009-28, 29, 30, 32, 33, and 34. RESOLUTION NO. 2009-28

WHEREAS, LINO BOCCHER, Fire Sub-Code Official, has submitted his resignation for the term ending January 31, 2009; and

WHEREAS, in regard to same the Mayor and Council hereby accepts said resignation of

LINO BOCCHER, Fire Sub-Code Official, for the term ending January 31, 2009 NOW, THEREFORE, BE IT RESOLVED, that the Mayor and Council hereby accepts

said resignation of LINO BOCCHER, Fire Sub-Cod official, for the term ending January 31, 2009. RESOLUTION 2009-29

WHEREAS, the Borough of Englewood Cliffs is desirous of appointing a Fire Inspector,

upon the resignation of Lino Boccher effective January 31, 2009,; and

WHEREAS, the Mayor and Council has recommended that Paul Renaud be appointed to

said position at a salary of Five Thousand ($5,000.00) Dollars for the term ending December 31,

2009;

NOW, THEREFORE, BE IT RESOLVED, that the Mayor and Council hereby appoints

Paul Renaud as Fire Inspector of the Borough of Englewood Cliffs for the term ending December

31, 2009.

RESOLUTION 2009-30

WHEREAS, as a result of the resignation of Lino Boccher, Fire Sub-Code Official, effective January 31, 2009, a vacancy shall exist; and

WHEREAS, the Mayor and Council has recommended that William J. McGuire be

appointed to the position of Acting Sub-Code Official at a salary of $909.09 for a term of up to 60 days, effective January 31, 2009.

NOW, THEREFORE, BE IT RESOLVED, that the Mayor and Council hereby appoints

William J. McGuire as Acting Fire Sub-Code Official of the Borough of Englewood Cliffs at a salary of $909.09 for a term of up to 60 days, effective January 31, 2009.

RESOLUTION 2009-32

WHEREAS, the Borough of Englewood Cliffs has received a proposal to furnish the SE Englewood Cliffs Police Department with an update of its PoliSYS to PoliSYS Enterprise

Edition by Enforsys Police Systems, Inc., which shall also include the Englewood Cliffs Fire

Department and Englewood Cliffs EMS; and

WHEREAS, pursuant to said proposal dated November 26, 2008, the total sum

of money to be paid and the terms therewith as set forth on the proposal dated November 26,

2008, is $84,667.86; and

WHEREAS, pursuant to the Local Public Contracts Law 40A:11-2(7) the Borough

Auditor has determined that said purchase pursuant to the aforesaid statute qualifies as

“Extraordinary Unspecifiable Services” which is defined as “services which are specialized and

qualitative in nature requiring expertise, extensive training and proven reputation in the field of

endeavor.”

NOW, THEREFORE, BE IT RESOLVED that the Mayor is hereby authorized to enter

into an agreement with Enforsys, Inc., pursuant to said proposal with the approval of the Borough

Attorney.

RESOLUTION 2009-33

WHEREAS, Florence Modne is the owner of certain property located in the Borough of

Englewood Cliffs, at Block 1006, Lot 15, also known as 42 Johnson Avenue; and

WHEREAS, taxpayer has filed a 2008 real property tax appeal, which matter is presently

pending in the Tax Court of New Jersey; and

WHEREAS, it is the opinion of the Tax Assessor and Tax Counsel that the settlement of

this matter is in the best interests of the Borough of Englewood Cliffs;

NOW, THEREFORE, be it

RESOLVED by the Mayor and Council of the Borough of Englewood Cliffs that the

Borough Tax Appeal Attorney be and he is hereby authorized and directed to execute any and all

documents necessary in order to settle litigation entitled Modne vs. Englewood Cliffs, pending in

the Tax Court of New Jersey under docket number 006009-2008, and be it further

RESOLVED that, for tax year 2008, the total assessment will be reduced from

$1,177,400 to $1,100,000; and be it further

RESOLVED, that the aforesaid settlement is further predicated upon a waiver of any and all pre-judgment interest on any refund due to the taxpayer.

RESOLUTION 2009-34

WHEREAS, Joan Lazell is the owner of certain property located in the Borough of

Englewood Cliffs, at Block 801, Lot 7, also known as 101 Pershing Road; and

WHEREAS, taxpayer has filed a 2008 real property tax appeal, which matter is presently

pending in the Tax Court of New Jersey; and

COMMITTEE REPORTS: COUNCILMAN KASOFF: Legal, Board of Education, No Report COUNCILMAN AGRESTA: Sanitation, Lighting Attended the reorganization meeting of the Board of Health. Will attend a public health one day seminar. COUNCILMAN PERIN: Finance, Recreation, Ambulance Recreation is in full swing; started basketball for first graders through seniors in high school. Adult basketball Tuesday nights. Our indoor travel soccer is the biggest ever five separate teams. Ambulance Corps answered 64 calls, 35 answered by local ambulance 13 mutual aid responses to Englewood. COUNCILMAN PLAWKER: Fire Department, Historical, Economic Development Complimented the Ambulance Corps response rates. Announced his appointment to State Board of Education. And most importantly he stated he was in remission regarding his cancer. COUNCILMAN PETRONE: Beautification, Clean Communities Attended Planning Board reorganization meeting, sworn in with Ron Kilmartin. Spoke with Yvonne Favaro of the Shade Tree Commission, will meet with her this Friday. COUNCILMAN MANOLIO: Police, DPW, Build. & Grounds, Recycling, Bd. Of Adj.

Board of Adjustment reorganization meeting went well, carried a use application and a height and use application. DPW: It is snowing a lot. Streets are good. Police had a drill today. In caucus meeting we spoke about an Emergency Response Team. We will look into it and investigate shared services. Thank you letter to police from a woman in an accident, officers stayed with her and helped until ambulance came and took her to hospital. Chamber of Commerce dedication for the corner is set for May 3rd . REPORT OF DPW SUPERINTENDENT: It is expensive to deal with storms; cost of salt and the storms are falling on Sundays and holidays. Residential parking in the street is a problem when trying to plow. REPORT OF BOROUGH ENGINEER: There is no punch list for Kahn & Clendenin Road Project. Drainage project substantially complete, we a have punch list for landscaping to be done in the spring. Will be meeting regarding basketball court project. We are keeping abreast of the possible funds available for grants and loans that may benefit the borough. REPORT OF POLICE CHIEF: Sgt. Rice completed 22 years of service. Officers Romano, Wicker, and Henkleman have completed nine years, Officers Ford, Waldt, and Drimones have completed two years, and Officer Totten has completed one year. Mayor inquired about the officer overseas. REPORT OF DEPUTY POLICE CHIEF: Bus was driven by 15 year old special education child from Queens to Englewood Cliffs. Councilman Agresta asked what measures were being taken regarding the burglaries. Mayor Parisi suggested that the Councilman may wish to speak to the Police Commissioner. Deputy Chief stated that the Police Department will survey residents’ properties and homes to assist them in crime prevention. REPORT OF BOROUGH ATTORNEY: Cingular antennae case will be heard on Feb 6th Michael Kates trying case. MAYOR PARISI: Congratulations to the new captain of the Ambulance Corps Daniel DiMatteo. He recommended that all the councilmen take the newly elected officials course. There is a land use symposium for the board members. We need to determine a date for the April Mayor & Council meeting. Ilan was contacted by representatives of Englewood Hospital. Mayor asked Mrs. Fehre to contact council members for special meeting to meet with Englewood Hospital representatives and then meet in closed session for police negotiations. PUBLIC PORTION: On a motion by Councilman Manolio, seconded by Councilman Perin, the meeting was opened to the public. Carried. Resident Jerry Misk, 1 Sanford Drive, noted he was robbed two and one half years ago. He would like information. Mayor suggested that he meet with Police Chief and Deputy Chief. Mayor asked for consensus that Ilan draft a letter to residents regarding COAH and the robberies. On a motion by Councilman Manolio, seconded by Councilman Kasoff, Council agreed.

Resident Carrol McMorrow asked about procedures regarding hiring personnel. Mrs. Fehre replied that there was not a procedure that dictates how hires are made. Andrew Nikow, 54 Elm street stated he was walking down Elm Street and noticed a door open on a house. Police responded in minutes and he commends them. On a motion by Councilman Manolio, seconded by Councilman Plawker, the public portion of the meeting was closed. Carried.
