    The business plan has four main purposes:

    When setting up your business, you needtodecidewhattypeofbusinessitwillbe.Everybusinesshasalegalstatus(thewayitsviewedinlaw)andtherearefourmaintypes,withafifthforthosebusinessesthatare run for social purposes only:

    Sole trader:Thisisabusinessfullyownedbyonepersontheproprietor.Ifyoureasoletradertheliabilitylieswithyou,andyour personal savings and assets could beat risk if your business fails.

    Ontheplusside,itsquickandeasytosetup and you only need to keep minimumrecords. Unless your earnings are high,yourtotaltaxpaymentsmaybelowerthanif you formed a l imited company.

    Partnership: Partnerships,exceptforprofessional partnerships such asaccountants and solicitors, cannotnormally have more than 20 partners. Anyprofitisnormallydividedequallybetweenthepartners.However,aswithsoletraders,partners are regarded as liable and theirassets may be seized to pay off debts.

    The good things about being a partnershipare that you pool your skills and youmay have more initial capital. You mayalso be able to raise money by introducingnewpartners.

    Limited Liability Partnership (LLP):In a Limited Liability Partnership, thepartners are not personally liable for

    the debts of the business and the LLPhasthesameorganisationalflexibilityofapartnership.Thepartnersaretaxedinthesamewayasapartnership,andtaxischargedonalltheprofitswhetherornottheyredistributedtothemembers.

    Limited company:With a limited company,it can be easier to raise large sums ofmoney for the business or to sell part of it.The main advantage of trading asa company is limited liability: the liabilityis limited to the initial cost of the shares.You can keep your personal wageslowtohelpthebusinesscashflowandminimiseincometaxasyougoalongandyoucantake other money you need as dividends orbonuseswhenthebusinesscanaffordit.

    Social enterprises:A social enterprise isabusinesswithprimarilysocialpurposes.Any profits are largely reinvested in thebusiness or in the community, rather thangiventoshareholdersandowners.

    There are many different types of socialenterprises, including community

    development trusts, housing associations,worker-ownedco-operativesandleisure centres and Community InterestCompanies (CICs).

    Choosing a name for your business isacreativeandenjoyableprocess.Itsalsoone that you need to get right. Customerswilloftenformtheirfirstimpressionsfrom your business name and firstimpressions count.

    Rememberthatyourbusinessnamewillbe the cornerstone of your brand. It shouldworkwellandbeclearwhereveryouuseit - on the phone, in your logo, signage,stationary,advertisements,website,uniforms and any other media you plan touse to reach the target market. Remembertocheckwhetherithasalreadybeenregistered as a trade mark. Once you havechosen your business name and checkedthat nobody else is using it, you mightwanttoregisteritandprotectit.

    What I didIwantedbusinesstospreadbyword-of-mouthsoitwasimportantmycompanysnamewasbothcatchyandmemorable.Idecidedithadtobeonlytwosyllablessothatpeoplewouldntforgetit,andphoneticsothattheywouldntmisspellit.Moonpig is fun and cheeky. Most of ourcards are humour based and Moonpigencapsulates that.

    Beforeyoustartup,youwillneedtomake certain practical decisions aboutthe running of your business (youroperations). Once you have made thosedecisions,youshouldwritethemintoyourbusiness plan.

    Staff:Whatstaffwillyouneed,ifany?Will they be full-time, part-time, casual ortemporary?Whatwilltheydo?Howmuchwillyoupaythem?

    Premises: Working from home suits manypeople,butotherswillneedseparatepremises.

    Youmayknowalreadywhereyoullbeworkingfrombut,ifyoudont,drawupalistofwhatyouneedfromyourpremisesto help you decide.

    Afterdrawingupyourlistofrequirements,youmaydecidethatworkingfromhomecouldsuityou.However,thereare

    important legal and practical issues youneed to take into account.

    Suppliers:Yoursupplierswillbecontributors to your success. Almost everybusiness is dependent to a greater orlesser degree on its suppliers. Ideally youshouldlooktocreateastrongwin-winrelationshipwithyourkeysuppliers,inparticularwheretheyalsoshareinyoursuccess. If you sell more, they sell more.

    Youneedtodecidewhotheyllbeandwhatyoushoulddoifsomethinggoeswrong,forexampleiftheydontdeliverontimeor if they should cease trading.

    Equipment/resources:Every businessneeds resources this could be equipmentfor manufacturing your product, ITequipment for running your business orpromotional material such as leaflets.

    Once I had the letter from OFSTED,Iwasabletogeta600grantfromthe council to buy the t hings I neededbecause my postcode comes underwhatisclassedbyGovernmentasadeprivedarea.

    What Id do differentlyIfIcoulddoanythingdifferentlyIwouldhaveperhapsdecidedexactlywhichpartsofmyhomewouldbeusedforthebusinessandwhatIwouldreserveas my personal space. This minimisesthe rooms that have to be inspected by

    OFSTED and also limits the disruptiontoyourlivingarea.

    Aftertheinspection,whichtookaroundtwohours,IwassentaletterstatingwhatchangesIneededtomake.Thesewerethings like installing stair gates, puttinglocks on the bottom cupboards in thekitchen, using plastic covers for electricalsockets and covering the hobs on top ofthe oven. Although it makes perfect sensefor the business, some of the changesarentidealwhenyouwantyourpersonalspacetolookacertainway.

    3.6 Your responsibilities

    Whenyoureabusinessowner,youllhaveanumberofresponsibilitiesthatyoudonthavetoconcernyourselfwithwhenyourean employee. Among other things, you haveto keep accounts, be personally responsibleforpayingyourincometaxandNational

    Insurance Contributions (NIC), take outinsurances,andtakeaccountoflawsandregulations relating to employment, healthand safety and the environment.

    You may also have to apply for planningpermissionif,forexample,youchangehowabuildingisusedand,dependingonwhatyour business is, you may have to apply fora licence.

    Income tax, National Insurance and VATHowyoupaytaxwillbedifferent,dependingonwhetheryoureasoletrader,apartnership, or a limited company.

    VATisataxchargedtocustomersonthesale of goods and services, and you mustregister your business for VAT if its turnoverin any period of up to 12 months is morethan the current registration threshold.

    InsuranceYoumusthaveemployersliabilityinsuranceif you employ staff. Most businesses alsohave public liability insurance and may alsoneed product liability insurance. If you haveavehicleyoullneedmotorinsurance.

    There are also a number of non-compulsoryinsurances, including theft, fire and specialperils, goods in transit and specialistinsurances depending on the nature ofyour business.

    Employmentlawalsocoversavarietyof issues including redundancy, unfairdismissal, discrimination, the minimumwageandnoticeoftermination.

    Health and safetyAllbusinessescomeunderthejurisdictionoftheHealthandSafetyExecutive.Somebusinesseswillneedtoregisterwiththeirlocal authority. Check to see if this appliesto you. If you have five employees or more,youmusthaveawrittenhealthandsafetypolicy. If you have commercial premises,

    youllalsoneedanasbestossurveytocomplywithlegalrequirements.

    The environmentEvery business is legally responsible forthewasteitproducesandyoucouldhaveto pay fines of several thousand pounds ifyours causes any environmental damage.Storeyourwastesafelyandsecurelyinsuitable sacks, containers or skips.
