“ASK FR. FARNAN”
Q: My father remarried after mom died a woman who was divorced. He says he can’t receive
Holy Communion. Please explain.
My mother and father are divorced. Mom and I go to church every Sunday and mom wants to
get an annulment so she can go to Holy Communion. Dad says if an annulment is granted I
will become an illegitimate child. Is dad correct?
A: There is much confusion concerning the sacrament of marriage. Let me try to make things clear. It would
be impossible to deal with everything in one column so I will have to stretch this out over a few bulletins.
Marriage is both a sacrament and a civil contract. In the United States priests are given the authority to marry
both sacramentally and civilly. Ship boat captains, judges, and Uncle Fred who took a course on line and has
been declared a minister of the church of the wind out of the southwest, are also given the authority to marry
someone civilly. In other countries Catholic ordained deacons, priests or bishops are not given the civil
authority to marry. In Italy, for example, in order to get sacramentally married a couple first has to be civilly
married by a civil authority a few days before their sacramental ceremony.
Only ordained deacons, priests, or bishops are given the authority to witness a sacrament of marriage. And
‘witness’ is important. Because actually although a priest confers the sacrament of Reconciliation on someone,
or the sacrament of Baptism, or a bishop confers the sacrament of Confirmation on someone, the sacrament of
Marriage as we understand it in the Latin Rite church is conferred by those getting married. So, the man
confers the sacrament on the woman, and the woman confers the sacrament on the man.
When someone marries another they exchange vows. These vows are serious. You promise to remain faithful
and to stay married until one of the parties dies. Until death do us part. One of the things that Jesus revealed to
us is that there is not marriage in heaven. As one man once told me…”That’s what makes it heaven!” But there
is definitely marriage on earth, and this covenant comes with responsibilities. If someone should not fulfill
these responsibilities that becomes a grave matter, or a sinful matter.
Someone cannot confer a sacrament if they do not believe in a sacrament or they don’t intend to confer a
sacrament. A teammate on a lacrosse team I played for years ago once told to me prior to getting married to a
Catholic woman, “I told the priest everything he wanted to hear, but I don’t believe any of it.” Could he confer
the sacrament of Marriage? Nope.
Now, the Church always assumes there is a union until proven otherwise. So, even if someone gets married
according to their beliefs, which might be different than a Catholic understanding of marriage, we assume their
marriage is valid.
There are three areas where a marriage ceremony fails to bring about a valid marriage: lack of capacity, lack of
consent, and lack of form.
Lack of capacity deals with whether someone is capable of marriage. There are many reasons someone may
not be capable of marriage. Things like someone is already married, someone who is bound by ordination as a
deacon, priest, or bishop, or those still bound by religious vows of celibacy are also not capable of entering a
valid marriage. Also insufficient age (usually below 16 for a man, 14 for a woman) affects validity. People too
closely related (first cousins, and uncles and nieces, grandfathers and granddaughters) can’t validly marry.
Impotence in one of the parties, lacking a sufficient use of reason, or suffers from a serious psychological
disorder are also things that make one incapable of entering into a valid marriage.
In next week’s column I will deal with lack of consent as grounds for annulment.

The third candle is pink and symbolizes joy. It is called the
“Shepard’s Candle,” and is pink because rose is a liturgical
color for joy. The third Sunday of Advent is Gaudete Sunday
and is meant to remind us of the joy that the world experi-
enced at the birth of Jesus, as well as the joy that the faithful
have reached the midpoint of Advent.
