As you know, we serve as counsel for US Airways, Inc. ("USAirways") in theSeptember 11th Litigation and, in that capacity, wehave been asked to assist in the gathering ofdocuments and information requested by the N ationa l Commission on Terrorist A ttacks U ponthe United States (the"Commission"). US Airways received document request No. 1 on M arch8, 2004 and it received a supplemental request for information, via email, on March 11, 2004 .Responses to both of these requests were forwa rded to you via Federal Express on April 8 , 2004.On April 9, 2004, we received, via facsimile, copies of various photographs of a bag tagthat was on checked baggage belonging to Mohammad Atta. Copies of thesebag tag

photographs were forw arded to US A irways for their review. Based on these bag tags, andpursuant to our telephone conversation yesterday, U S A irway s wants to am end its response torequest no. 2. In addition, you stated that the document produced in response to request no. 1,and identified in our response as US-Kean-000001, was not a copy of the passenger manifest asthe num ber of individuals listed on the document exceeded the capacity of the aircraft. W efollowed up on your inquiry forthwith and have obtained additional documentation.AMENDMENTS TO U.S. AIRW AYS DOCUMENT REQUEST NO. 1

1. The passenger man ifest for Colgan A ir Flight No. 5930 on September 11,2001.A copy of the requested manifest is attached hereto and identified as US-Kean-000021.

US-Kean-000001, which w as previously produced, was a list of the passengers who hadreservations on the Colgan Air Flight No. 5930 rather than the actual manifest.

Based on its recent review of hard copies of the PN R for Mohammad Atta and AbdulAziz al Omari and the photographs of the bag tag that was found on one of Atta's checked bags,US Airwayscan make a determination as to whether these individuals were designated as"selectees." First, on September 11th, CAPPS/APPS scored all PNRs (Passenger NameRecords); however, only customers who were checking baggage would be designatedselectees, based on those scores. A customer with no checked baggage would not be a selectee,regardless of his/her score. The PNR information indicates that Abdul Aziz al Omari did notcheck any bags and, therefore,US Airways can confirm that Mr. Omari would no t havebeen designated a selectee by CAPPS/APPS.I
