  • NOTE BY THE SECRETARIAT

    Under Article 102 of the Charter of the United Nations every treaty and every international agree-ment entered into by any Member of the United Nations after the coming into force of the Charter shall,as soon as possible, be registered with the Secretariat and published by it. Furthermore, no party to atreaty or international agreement subject to registration which has not been registered may invoke thattreaty or agreement before any organ of the United Nations. The General Assembly, by resolution 97 (1)established regulations to give effect to Article 102 of the Charter (see text of the regulations, vol. 859,p. Viii).

    The terms "treaty" and "international agreement" have not been defined either in the Charter or inthe regulations, and the Secretariat follows the principle that it acts in accordance with the position of theMember State submitting an instrument for registration that so far as that party is concerned the instru-ment is a treaty or an international agreement within the meaning of Article 102.     AGREEMENT' FOR COOPERATION BETWEEN THE GOVERN-MENT OF THE UNITED STATES OF AMERICA AND THEGOVERNMENT OF THE KINGDOM OF THAILAND CON-CERNING CIVIL USES OF ATOMIC ENERGY

    Whereas the Government of the United States of America and the Govern-ment of the Kingdom of Thailand signed an Agreement for cooperation betweenthe Government of the United States of America and the Government of theKingdom of Thailand concerning civil uses of atomic energy on March 13, 1956,2which was amended by the Agreements signed on March 27, 1957, 3 June 11,1960, 4 May 31, 1962,5 and June 8, 1964;6 and

    Whereas the Government of the United States of America and the Govern-ment of the Kingdom of Thailand desire to pursue a research and developmentprogram looking toward the realization of peaceful uses of atomic energy,including the design, construction, and operation of power-producing reactorsand research reactors, and the exchange of information relating to the develop-ment of other peaceful uses of atomic energy; and

    Whereas the Government of the United States of America and the Govern-ment of the Kingdom of Thailand are desirous of entering into this Agreement tocooperate with each other to attain the above objectives; and

    Whereas the Parties desire this Agreement to supersede the Agreement forcooperation between the Government of the United States of America and theGovernment of the Kingdom of Thailand concerning civil uses of atomic energysigned on March 13, 1956, as amended;

    The Parties agree as follows:

    Article I. For the purposes of this Agreement:(1) "Parties" means the Government of the United States of America,

    including the Commission on behalf of the Government of the United States ofAmerica, and the Government of the Kingdom of Thailand. "Party" means oneof the above Parties.

    (2) "Commission" means the United States Atomic Energy Commission.

    (3) "Atomic weapon" means any device utilizing atomic energy, exclusiveof the means for transporting or propelling the device (where such means is aseparable and divisible part of the device), the principal purpose of which is foruse as, or for development of, a weapon, a weapon prototype, or a weapon testdevice.

    Came into force on 27 June 1974, the date on which each Government had received from the other Govern-ment written notification that it had complied with all statutory and constitutional requirements, in accordance witharticle XV.

    (4) "Byproduct material" means any radioactive material (except specialnuclear material) yielded in or made radioactive by exposure to the radiationincident to the process of producing or utilizing special nuclear material.

    (5) "Equipment and devices" and "equipment or devices" mean any in-strument, apparatus, or facility, and include any facility, except an atomic weap-on, capable of making use of or producing special nuclear material, and compo-nent parts thereof.

    (6) "Person" means any individual, corporation, partnership, firm, asso-ciation, trust, estate, public or private institution, group, government agency, orgovernment corporation but does not include the Parties to this Agreement.

    (7) "Reactor" means an apparatus, other than an atomic weapon, in whicha self-supporting fission chain reaction is maintained by utilizing uranium, pluto-nium or thorium, or any combination of uranium, plutonium or thorium.

    (8) "Restricted Data" means all data concerning (a) design, manufacture,or utilization of atomic weapons, (b) the production of special nuclear material,or (c) the use of special nuclear material in the production of energy, but shallnot include data declassified or removed from the category of Restricted Data bythe appropriate authority.

    (9) "Safeguards" means a system of controls designed to assure that anymaterials, equipment and devices committed to the peaceful uses of atomicenergy are not used to further any military purpose.

    (10) "Source material" means (a) uranium, thorium or any other materialwhich is determined by the Commission to be source material, or (b) orescontaining one or more of the foregoing materials, in such concentration as theCommission may determine from time to time.

    (11) "Special nuclear material" means (a) plutonium, uranium enriched inthe isotope 233 or in the isotope 235, and any other material which the Commis-sion determines to be special nuclear material, or (b) any material artificially en-riched by any of the foregoing.

    (12) "Superseded Agreement" means the Agreement for cooperation be-tween the Government of the United States of America and the Government ofthe Kingdom of Thailand concerning civil uses of atomic energy signed by theParties on March 13, 1956, as amended by the Agreements signed on March 27,1957, June 11, 1960, May 31, 1962, and June 8, 1964.

    Article I. A. Subject to the provisions of this Agreement, the availabilityof personnel and material, and the applicable laws, regulations, and license re-quirements in force in their respective countries, the Parties shall cooperate witheach other in the achievement of the uses of atomic energy for peaceful pur-poses.

    B. Restricted Data shall not be communicated under this Agreement, andno materials or equipment and devices shall be transferred, and no services shallbe furnished, under this Agreement, if the transfer of any such materials orequipment and devices or the furnishing of any such services involves thecommunication of Restricted Data.

    C. This Agreement shall not require the exchange of any informationwhich the Parties are not permitted to communicate.

    Article III. Subject to the provisions of article II, the Parties mayexchange unclassified information with respect to the application of atomic energyto peaceful uses and the considerations of health and safety connected therewith.The exchange of information provided for in this article will be accomplishedthrough various means, including reports, conferences, and visits to facilities,and may include information in the following fields:(1) Development, design, construction, operation, and use of research, mate-

    rials testing, experimental, demonstration power, and power reactors, andreactor experiments;

    (2) The use of radioactive isotopes and source material, special nuclear mate-ria1, and byproduct material in physical and biological research, medicine,agriculture, and industry; and

    (3) Health and safety considerations related to the foregoing.

    Article IV. A. Materials of interest in connection with the subjects ofagreed exchange of information, as provided in article III and subject to the pro-visions of article II, including source material, heavy water, byproduct material,other radioisotopes, stable isotopes, and special nuclear material for purposesother than fueling reactors and reactor experiments, may be transferred betweenthe Parties for defined applications as may be agreed when such materials are notcommercially available.

    B. Subject to the provisions of article II and under such terms and condi-tions as may be agreed, specialized research facilities and reactor materials test-ing facilities of the Parties may be made available for mutual use consistent withthe limits of space, facilities, and personnel conveniently available when suchfacilities are not commercially available.

    C. With respect to the subjects of agreed exchange of information asprovided in article III and subject to the provisions of article II, equipment anddevices may be transferred from one Party to the other under such terms andconditions as may be agreed. It is recognized that such transfers will be subjectto limitations which may arise from shortages of supplies or other circumstancesexisting at the time.

    Article V. The application or use of any information (including designdrawings and specifications), and any material, equipment and devices, exchangedor transferred between the Parties under this Agreement or the supersededAgreement shall be the responsibility of the Party receiving it, and the otherParty does not warrant the accuracy or completeness of such information anddoes not warrant the suitability of such information, material, equipment anddevices for any particular use or application.

    Article VI. A. With respect to the application of atomic energy to peace-ful uses, it is understood that arrangements may be made between either Partyor authorized persons under its jurisdiction and authorized persons under thejurisdiction of the other Party for the transfer of equipment and devices andmaterials other than special nuclear material and for the performance of serviceswith respect thereto.

    B. With respect to the application of atomic energy to peaceful uses, it isunderstood that arrangements may be made between either Party or authorized

    persons under its jurisdiction and authorized persons under the jurisdiction ofthe other Party for the transfer of special nuclear material and for the perform-ance of services with respect thereto for the uses specified in articles IV andVII and subject to the relevant provisions of article VIII and to the provisions ofarticle IX.

    C. The Parties agree that the activities referred to in paragraphs A and Bof this article shall be subject to the limitations in article II and to the policies ofthe Parties with regard to transactions involving the authorized persons referredto in paragraphs A and B of this article.

    Article VII. A. Subject to the availability of capacity in Commission fa-cilities for uranium enrichment and within the quantity authorized in article IXfor transfer, service contracts with the Government of the Kingdom of Thailand,or with authorized persons under its jurisdiction, may be entered into by theCommission as herein set forth for the production or enrichment of uraniumenriched in the isotope U-235 for use as fuel in power applications undertakenwithin the Kingdom of Thailand. It is understood by the Parties that, at suchtimes as the Government of the Kingdom of Thailand, or such authorized per-sons, have requirements for such services and are prepared to execute firmcontracts which set forth the agreed delivery schedules and other terms andconditions of supply of such services, the Government of the Kingdom of Thai-land or such authorized persons will have access on an equitable basis with otherpurchasers of such services to uranium enrichment capacity then available inCommission facilities and not already allocated.

    B. Additionally, upon request by the Government of the Kingdom ofThailand or authorized persons under its jurisdiction, the Commission may, at itsoption and under terms and conditions as may be agreed, sell uranium enrichedin the isotope U-235 in such amounts as are within the quantity authorized inarticle IX for transfer for use as fuel in power applications undertaken within theKingdom of Thailand.

    C. Under such terms and conditions as may be agreed, the Commissionmay transfer (including the supply through enrichment services contracts) to theGovernment of the Kingdom of Thailand, or authorized persons under its juris-diction, uranium enriched in the isotope U-235 for use as fuel in reactor experi-ments and reactors other than those covered under paragraphs A and B of thisarticle, including reactors for research, materials testing, experimental, scien-tific, and industrial uses.

    D. Special nuclear material other than uranium enriched in the isotopeU-235 may be transferred to the Government of the Kingdom of Thailand, or toauthorized persons under its jurisdiction, for use as fuel in reactors and reactorexperiments, provided that, if the transfers are made by the Commission, it maytransfer quantities of such material only to the extent that they fall within anauthorized ceiling therefor set forth in article IX and that the terms and con-ditions of each such transfer shall be agreed upon in advance.

    Article VIII. A. The enriched uranium supplied under this Agreementmay contain up to twenty percent (20%) in the isotope U-235. A portion of theuranium enriched in the isotope U-235 so supplied may be made available asmaterial containing more than twenty percent (20%) in the isotope U-235 when

    the Commission finds there is a technical or economic justification for such atransfer.

    B. Subject to the provisions of article IX, the quantity of uranium enrichedin the isotope U-235 transferred under article VI or article VII and under thejurisdiction of the Government of the Kingdom of Thailand for the fueling ofreactors or reactor experiments shall not at any time be in excess of the quantitythereof necessary for the loading of such reactors or reactor experiments, plussuch additional quantity as, in the opinion of the Parties, is necessary for theefficient and continuous operation of such reactors or reactor experiments.

    C. When any special nuclear material received from the United States ofAmerica pursuant to this Agreement or the superseded Agreement requires re-processing, or any irradiated fuel elements containing fuel material received fromthe United States of America pursuant to this Agreement or the supersededAgreement are to be removed from a reactor and are to be altered in form orcontent, such reprocessing or alteration shall be performed in facilities accept-able to both Parties upon a joint determination that the provisions of article XImay be effectively applied.

    D. Special nuclear material produced as a result of irradiation processes inany part of the fuel that may be leased by the Commission under this Agreement,or may have been leased under the superseded Agreement, shall be for theaccount of the lessee and, after reprocessing as provided in paragraph C of thisarticle, title to such produced material shall be in the lessee unless the Commissionand the lessee otherwise agree.

    E. Special nuclear material produced through the use of material trans-ferred to the Government of the Kingdom of Thailand or to authorized personsunder its jurisdiction pursuant to this Agreement or the superseded Agreementmay be transferred to any other nation or group of nations, provided that suchnation or group of nations has an appropriate agreement for cooperation with theGovernment of the United States of America or guarantees the use of specialnuclear material for peaceful purposes under safeguards acceptable to the Parties.

    F. Some atomic energy materials which may be provided in accordancewith this Agreement, or which may have been provided under the supersededAgreement, are harmful to persons and property unless handled and used care-fully. After delivery of such materials, the Government of the Kingdom of Thai-land shall bear all responsibility, insofar as the Government of the United Statesof America is concerned, for the safe handling and use of such materials. Withrespect to any special nuclear material or fuel elements which the Commissionmay, pursuant to this Agreement, lease to the Government of the Kingdom ofThailand or to any person under its jurisdiction, or may have leased pursuant tothe superseded Agreement, the Government of the Kingdom of Thailand shallindemnify and save harmless the Government of the United States of Americaagainst any and all liability (including third party liability) for any cause what-soever arising out of the production or fabrication, the ownership, the lease andthe possession and use of such special nuclear material or fuel elements afterdelivery by the Commission to the Government of the Kingdom of Thailand or toany person under its jurisdiction.

    Article IX. The separative work required to produce the uranium enrichedin the isotope U-235 transferred under this Agreement from the United States ofAmerica to the Kingdom of Thailand for power applications shall not exceed thatnecessary to support the fuel cycles of reactors having a total installed capacityof four thousand (4,000) megawatts (electric).

    Article X. The Government of the Kingdom of Thailand guarantees that:

    (1) Safeguards provided in article XI shall be maintained.

    (2) No material, including equipment and devices, transferred to the Govern-ment of the Kingdom of Thailand or authorized persons under its jurisdic-tion by purchase or otherwise pursuant to this Agreement or the supersededAgreement, and no special nuclear material produced through the use ofsuch material, equipment and devices, will be used for atomic weapons, orfor research on or development of atomic weapons, or for any other mili-tary purpose.

    (3) No material, including equipment and devices, transferred to the Govern-ment of the Kingdom of Thailand or to authorized persons under its juris-diction pursuant to this Agreement or the superseded Agreement will betransferred to unauthorized persons or beyond the jurisdiction of theGovernment of the Kingdom of Thailand except as the Commission mayagree to such a transfer to the jurisdiction of another nation or group ofnations, and then only if, in the opinion of the Commission, the transfer iswithin the scope of an Agreement for Cooperation between the Governmentof the United States of America and the other nation or group of nations.

    Article XI. A. The Government of the United States of America and theGovernment of the Kingdom of Thailand emphasize their common interest inassuring that any material, equipment or devices made available to the Govern-ment of the Kingdom of Thailand or to any person under its jurisdiction pursuantto this Agreement or the superseded Agreement shall be used solely for civilpurposes.

    B. Except to the extent that the safeguards rights provided for in thisAgreement are suspended by virtue of the application of safeguards of theInternational Atomic Energy Agency, as provided in article XII, the Govern-ment of the United States of America, notwithstanding any other provisions ofthis Agreement, shall have the following rights:

    (1) With the objective of assuring design and operation for civil purposes and

    permitting effective application of safeguards, to review the design of any

    (a) reactor, and

    (b) other equipment and devices the design of which the Commission de-termines to be relevant to the effective application of safeguards,

    which are to be made available under this Agreement, or have been madeavailable under the superseded Agreement, to the Government of theKingdom of Thailand or to any person under its jurisdiction by theGovernment of the United States of America or any person under its juris-diction, or which are to use, fabricate, or process any of the following mate-

    rials so made available: source material, special nuclear material, moderatormaterial, or other material designated by the Commission;

    (2) With respect to any source material or special nuclear material made avail-able to the Government of the Kingdom of Thailand or to any person underits jurisdiction under this Agreement or the superseded Agreement by theGovernment of the United States of America or any person under its juris-diction and any source material or special nuclear material utilized in, recov-ered from, or produced as a result of the use of any of the following mate-rials, equipment or devices so made available:

    (a) source material, special nuclear material, moderator material, or othermaterial designated by the Commission,

    (b) reactors, and

    (c) any other equipment or devices designated by the Commission as anitem to be made available on the condition that the provisions of thisparagraph B (2) will apply,(i) to require the maintenance and production of operating records and

    to request and receive reports for the purpose of assisting in ensur-ing accountability for such materials, and

    (ii) to require that any such material in the custody of the Governmentof the Kingdom of Thailand or any person under its jurisdiction besubject to all of the safeguards provided for in this article and theguarantees set forth in article X;

    (3) To require the deposit in storage facilities designated by the Commission ofany of the special nuclear material referred to in paragraph B (2) of thisarticle which is not currently utilized for civil purposes in the Kingdom ofThailand and which is not transferred pursuant to article VIII or otherwisedisposed of pursuant to an arrangement mutually acceptable to the Parties;

    (4) To designate, after consultation with the Government of the Kingdom ofThailand, personnel who, accompanied, if either Party so requests, by per-sonnel designated by the Government of the Kingdom of Thailand, shallhave access in the Kingdom of Thailand to all places and data necessary toaccount for the source material and special nuclear material which are sub-ject to paragraph B (2) of this article to determine whether there iscompliance with this Agreement and to make such independent measure-ments as may be deemed necessary;

    (5) In the event of noncompliance with the provisions of this article or theguarantees set forth in article X and the failure of the Government of theKingdom of Thailand to carry out the provisions of this article within areasonable time, to suspend or terminate this Agreement and to require thereturn of any materials, equipment and devices referred to in para-graph B (2) of this article;

    (6) To consult with the Government of the Kingdom of Thailand in the matterof health and safety.

    C. The Government of the Kingdom of Thailand undertakes to facilitatethe application of safeguards provided for in this article.

    Article XII. A. The Government of the United States of America and theGovernment of the Kingdom of Thailand note that, by an Agreement signed bythem and the International Atomic Energy Agency on September 30, 1964,' theAgency has been applying safeguards to materials, equipment and facilitiestransferred to the jurisdiction of the Government of the Kingdom of Thailandunder the superseded Agreement. The Parties, recognizing the desirability ofcontinuing to make use of the facilities and services of the International AtomicEnergy Agency, agree that Agency safeguards shall continue to apply either asprovided in a trilateral agreement among the Parties and the Agency or asprovided in an Agreement entered into between the International Atomic EnergyAgency and the Government of the Kingdom of Thailand pursuant to article IIIof the Treaty on the Non-Proliferation of Nuclear Weapons. 2 It is understoodthat, without modification of this Agreement, the safeguards rights accorded tothe Government of the United States of America by article XI of this Agreementwill be suspended during the time and to the extent that the Government of theUnited States of America agrees that the need to exercise such rights is satisfiedby a safeguards agreement as contemplated in this paragraph.

    B. In the event the applicable safeguards agreement referred to in para-graph A of this article should be terminated prior to the expiration of thisAgreement and the Parties should fail to agree promptly upon resumption ofAgency safeguards, either Party may, by notification, terminate this Agreement.In the event of such termination by either Party, the Government of theKingdom of Thailand shall, at the request of the Government of the UnitedStates of America, return to the Government of the United States of America allspecial nuclear material received pursuant to this Agreement or the supersededAgreement and still in its possession or in the possession of persons under itsjurisdiction. The Government of the United States of America will compensatethe Government of the Kingdom of Thailand or the authorized persons under itsjurisdiction for their interest in such material so returned at the Commission'sschedule of prices then in effect in the United States of America.

    Article XIII. The rights and obligations of the Parties provided for underthis Agreement shall extend, to the extent applicable, to cooperative activitiesinitiated under the superseded Agreement, including, but not limited to, infor-mation, materials, equipment and devices transferred thereunder.

    Article XIV. The Agreement for cooperation between the Government ofthe United States of America and the Government of the Kingdom of Thailandconcerning civil uses of atomic energy signed on March 13, 1956, as amended, issuperseded by this Agreement on the date this Agreement enters into force.

    Article XV. This Agreement shall enter into force on the date on whicheach Government shall have received from the other Government written notifi-cation that it has complied with all statutory and constitutional requirements forentry into force of such Agreement and shall remain in force for a period of forty(40) years.

    appareil pour essai d'armes, soit pour permettre la mise au point de tels engins;I'appareil utilis6 pour le transport ou la propulsion de l'engin n'est pas comprisdans cette definition s'il peut tre s~par6 ou d~tach6 de I'engin.

    4. Par , il faut entendre toute matire radioactive (hormisles mati~res nucl~aires sp~ciales) obtenue ou rendue radioactive par expositionaux rayonnements dont s'accompagne la production ou l'utilisation de matiresnucl~aires sp~ciales.

    5. Par et , il faut enten-dre tout instrument, dispositif ou installation (y compris tout engin autre qu'unearme atomique) capable d'utiliser ou de produire des mati~res nucl~aires spcia-les, ainsi que leurs 6lments.

    6. Par >, il faut entendre toute personne physique, soci~t6 decapitaux, soci~t6 de personnes, entreprise ou association, toute succession, toutpatrimoine, tout 6tablissement public ou priv6, tout groupe, tout servicegouvernemental ou toute r~gie, autres que les Parties au present Accord.

    7. Par >, il faut entendre tout appareil, autre qu'une arme ato-mique, dans lequel on produit une reaction en chaine nucl~aire auto-entretenueen utilisant de l'uranium, du plutonium ou du thorium, ou toute combinaisond'uranium, de plutonium ou de thorium.

    8. Par ,, il faut entendre tout renseignementconcernant : a) les plans, la fabrication ou l'utilisation d'armes atomiques, b) laproduction de matires nucl6aires sp6ciales, ou c) l'utilisation de mati~res nu-cl6aires sp6ciales pour la production d'6nergie, h l'exception toutefois des ren-seignements que l'autorit6 comp6tente aura d6cid6 de ne plus consid6rer commesecrets ou confidentiels.

    B. Aucun renseignement confidentiel ne sera communiqu6 en applicationdu pr6sent Accord; aucune mati~re, aucun mat6riel et aucun appareil ne seronttransf6r6s et aucun service ne sera fourni en application du pr6sent Accord, si letransfert de ces mati~res, de ce mat6riel ou de ces appareils ou si la fourniture deces services impliquent la communication de renseignements confidentiels.

    C. Le pr6sent Accord n'entrainera pas l'6change de renseignements queles Parties ne sont pas autoris6es h communiquer.

    Article III. Sous r6serve des dispositions de I'article II, les Parties pour-ront se communiquer des renseignements non secrets concernant l'utilisation del'6nergie atomique h des fins pacifiques ainsi que les probl~mes d'hygi~ne et des6curit6 qui s'y rattachent. Cet 6change de renseignements se fera de diversesfagons et notamment au moyen de rapports, de conf6rences, de visites d'instal-lations, et il portera sur les domaines suivants :1. Etude, mise au point, construction, fonctionnement et utilisation des r6ac-

    teurs de recherche, des r6acteurs d'essais de mat6riaux, des r6acteurs exp6-rimentaux, des r6acteurs de puissance de d6monstration, des r6acteurs depuissance ef des r6acteurs prototypes d'essai.

    2. Utilisation des isotopes radioactifs, des mati~res brutes, des mati~res nu-cl6aires sp6ciales et des sous-produits dans les recherches de physique et debiologie, en m6decine, en agriculture et dans l'industrie.

    3. Probl~mes d'hygi~ne et de s6curit6 lis aux domaines susmentionn6s.

    Article IV. A. Dans les domaines au sujet desquels des 6changes de ren-seignements sont pr6vus A l'article III et sous r6serve des dispositions de l'arti-cle II, lorsqu'une Partie ne pourra se procurer commercialement les mati~resdont elle a besoin, notamment les mati~res brutes, l'eau lourde, les sous-produits, les isotopes radioactifs, les isotopes stables, et les mati~res nucl6airessp6ciales, destin6s h des usages autres que l'alimentation des r6acteurs et desr6acteurs prototypes d'essai, ces mati~res pourront tre 6chang6es entre les Par-ties aux fins d'applications d6
