Standing Straw Sale – Special Conditions of Sale 1. The highest bidder will be the Purchaser and no bidding can be retracted after the hammer
has fallen. The Auctioneers reserve the right to refuse any bidding and in the event of any
dispute the Lot may be put up again at the Auctioneer’s discretion. Lots are for sale, subject
to any reserve price imposed by the Vendor. 2. Each lot will be sold on a “price per acre” basis. There is no buyers premium. 3. The Auctioneers intend to sell in the order lotted and described in the catalogue but reserve the
right to make any alteration if so requested by a Vendor.
4. The acreages are believed to be correct however are not guaranteed and so Purchasers are
encouraged to inspect prior the auction.
5. The Purchaser of each lot shall give their full name, address and telephone number to the
Auctioneers clerk and the Vendors will notify each Purchaser one day before harvesting
commences.
6. The Vendor will take every care to cut the straw as close as is normal and practically possible.
7. The Auctioneers will not be responsible for any Lots damaged by fire, accident or otherwise
and all Lots are the Purchasers responsibility from the fall of the hammer.
8. The Purchaser of each lot must bale and remove straw WITHIN 14 days after the completion
of combining. If the Purchaser fails to remove within 14 days, the vendors reserve the right to
dispose of the straw without refunding all or any part of the purchase price.
9. In the case of adverse weather conditions, the Vendors reserve the right to refuse admission
to any Purchasers where they deem ground conditions to be unsuitable for entry, subject to
fair reimbursement. In this event the 14 day renewal limit will be extended accordingly.
10. The terms of sale are cheque, debit card or BACS and must be paid in full at the close of the
sale. Purchasers unknown to the Auctioneers are requested to register prior to the sale and
provide the following ID to verify you and thus allow you to bid. If pay by BACS, please send

11. Money Laundering: If you have not already provided us with the relevant documentation,
please bring the following information/items to the sale (or email before):
For Sole Traders: One of either: ● a valid passport ● a valid photo card driving licence (full or provisional) ● a firearms certificate
For Businesses:
Headed notepaper showing:
• The full name of the company
• Company or other registration number
• VAT registration number (if applicable)
• Registered address and principal place of business
• Names of the board of directors or equivalent body
• Names of the senior person responsible for its operations
• For partnerships- all the partners with greater than 25% share are required
12. Upon failure of complying with the above conditions, money deposited in payment will be
forfeited and the Lots which may remain uncleared after the time aforesaid will be sold by public
or private sale without notice to the former Purchaser and the deficiency (if any) by such a
second sale, together with all charges attending the same, shall be made good by the defaulter
at this sale.
13. In the event of a Lot not selling at the sale any further negotiations are to be conducted through
the Auctioneers, as agents to the Vendor, and these conditions will apply for private sale also.
14. All twine, netting and broken bales must be removed by the Purchasers from every field.
15. The Vendor will insure the crops whilst standing, and should a fire occur prior to combining will
refund in full. The Vendor will not be liable in any way after harvesting the straw, it becomes
the Purchasers risk and responsibility.
16. Purchasers must keep to the access provided it is suitable for entry. In the case where there
are no direct tracks or roads to lots, the necessary rights of way are reserved over the adjoining
lots to facilitate the removal.
17. The Purchasers responsibility is to safely remove the straw and to use reasonable endeavours
not to cause damage to the vendors land or any adjacent hedges, fences or ditches.
18. If there are any Overhead Power Lines across the land it is then the purchasers responsibility
to inspect the land from where the straw is to be removed and carry out any assessments
needed prior the straw being cut and removed.
19. The Purchaser agrees to indemnify the Vendor in relation to any claim that may be brought
against the Vendor which relates to the cutting and removal of the straw from the Vendors land
and any damage to any property or injury arising there from. For avoidance of doubt it is agreed
that this indemnify includes any damage caused by the Purchaser, his contractors or
employees to the overhead power lines and associated infrastructure, together with any
financial penalties and charges that may be incurred by the Vendor as a result of any such
damage.
20. In the case of any dispute between Vendor and Purchaser the Auctioneers decision to be final
and binding.
Viewing
At any reasonable hour when in possession of sale catalogue and showing courtesy to the Landowner and please take care to avoid unnecessary damage to growing crops.
