tion this year. Many thanks to everyone for their work on this

important process. Next year, with the introduction of an

online tool called ePerformance, the performance evaluation

process should be faster and easier. You will be hearing more

about ePerformance in the weeks and months to come.

ePerformance is the name of the University-wide on-line per-

formance management tool that we will use for performance

Spotlight on the Petrie-Flom Center

The Petrie-Flom Center for Health Law Policy, Biotechnolo-

gy, and Bioethics has a number of interesting research initia-

tives taking place. Lauren Reed and Paige Pascarelli asked

the Center about some of these interesting projects. Enjoy!

The Football Players Health Study at Harvard University,

Law and Ethics Initiative

The Players Health Study is a transformative research initiative

launched in February 2014 through an agreement between the

National Football League Players Association and Harvard

Medical School. The Players Health Study aims to improve

the integrated health and wellbeing of professional football

players, without focusing solely on any one disease or condi-

tion. It is comprised of (1) a major clinical research initiative

seeking to define the incidence and severity of medical condi-

tions that impact the quality and length of life of professional

football players, (2) several innovation grants to fund cutting

edge studies with a high likelihood of impacting the health of

football players, and (3) a law and ethics component, led by the

Petrie-Flom Center for Health Law Policy, Biotechnology, and

Bioethics at Harvard Law School.

Over the initial years of the project, the Law and Ethics pro-

gram will undertake a variety of distinct initiatives with the

primary goal of understanding the legal and ethical issues that

may promote or impede player health and wellbeing, and de-

veloping appropriate responsive recommendations. Planned

projects include:

A qualitative research study (“listening tour”) with players

and their families intended to catalogue legal and ethical

concerns related to health and wellbeing, and to identify

additional stakeholder priorities, questions, and hypotheses

for future work.

A comparative legal and organizational policy analysis of

various professional sports leagues to identify best practic-

es in protecting player health and wellbeing, ranging from

contract structure to relationships between teams and med-

ical staff to insurance systems and other topics.

Development of an ethical framework and accountability

structure for player health and wellbeing, including recom-

mendations regarding the responsibilities of key actors and

guidance on the baseline legal and ethical protections that

should be afforded to all players.

Public conferences, events, and publications to facilitate

discussion of law and ethics issues, and to solicit feedback

from players and other stakeholders.

Additional projects will be identified in collaboration with rel-

evant parties, with advice and guidance from a Law and Ethics

Advisory Panel (LEAP), comprised of leading bioethicists and

lawyers, players, and family members.

The Law and Ethics team also actively participates in provid-

ing real-time consultation and advice to ensure that the clinical

projects within the Players Health Study are conducted in ac-

cordance with the highest legal and ethical standards.

The Project on Law and Applied Neuroscience

Petrie-Flom will begin a new collaboration with the MGH

Center for Law, Brain, and Behavior - the Project on Law and

Applied Neuroscience - in Fall 2014. The collaboration will

include a Senior Fellow in residence, public symposia, and an

HLS Law and Neuroscience Seminar.

Amanda Pustilnik, JD, currently a Professor at the University

of Maryland School of Law, will be the first resident Senior

Fellow in Law and Neuroscience in 2014-2015. Professor

Pustilnik will pursue original research, mentoring, and public

engagement related to issues of pain and the law.

The Project will also include expert symposia and public events to promote focused discussion on ques-

tions at the intersection of pain, addictions, and the law. Finally, the Hon. Nancy Gertner, who is an HLS

Professor of Practice as well as a CLBB faculty member and Petrie-Flom affiliated faculty, will teach a

Law and Neuroscience Seminar to introduce students to this complex and growing translational field.

The course will draw on HLS and CLBB’s interdisciplinary legal and scientific faculty. Said Gertner, “I

am delighted to be part of this venture which brings together the extraordinary resources of MGH's Cen-

ter for Law, Brain and Behavior and Harvard Law School's Petrie-Flom Center. The subject – the inter-

section of law and neuroscience – deserves no less.”

Petrie-Flom’s Collaboration with Harvard Catalyst

The Petrie-Flom Center has recently joined the Regulatory Foundations, Ethics, and Law Program of

Harvard Catalyst | The Harvard Clinical and Translational Science Center at Harvard Medical School.

The Center will focus on two priority areas: 1) participant recruitment to (and retention in) research

studies, and 2) clinical data sharing for research purposes.

The Center's work will aim to develop practical solutions to key barriers to clinical trial recruitment,

focusing on such issues as the use of financial incentives, demographic targeting, diversity, engagement

with vulnerable populations, and the use of social media. Through exploration of international and com-

parative dimensions, engagement with critical stakeholders, and benchmarking current practices and

concerns, this project will produce educational modules and guidance documents for IRBs, investiga-

tors, and recruitment managers, model policies and other toolkits, consensus statements, and the like.

Petrie-Flom will also examine the current landscape and challenges of sharing clinical data with quali-

fied researchers. The project is designed to identify potential gaps in oversight, assess compliance de-

mands, and craft recommendations about current and projected needs for the sharing of clinical data.

Considering clinical data sharing in both its international and comparative context, this project will com-

bine factual inquiry with legal and ethical analysis to identify and evaluate key uses, adaptations, and

challenges.

Tireless Green Team members; Carrie Ayers, Anna Ben-

nett, Carla Gannon, Julie Kron, Angela Limoncelli and

Karen Thomas led the efforts to separate by hand the waste generated from

the Commencement luncheon into trash, recycling and compost, resulting

in a phenomenal 90% of waste being diverted from the landfill. Here are

the numbers:

Total Percentage of Waste Composted or Recycled: 90%

Since 2006, we here at the law school have reduced green-

house gas emissions by 24% (and accomplished that de-

spite over 25% growth in campus size during this same

period).

Let’s continue our exceptional progress towards the Uni-

versity’s goal of reducing greenhouse gas emissions 30%

by 2016 by taking two simple steps in our work spaces:

1. Adjust your temperature setting to the summer

cooling set point of 74°F

2. Allow for a brief lag in cooling your office space

when you enter it after a break
