Court Rules Against Anti’s Stay of Bear Season

Trenton, NJ --(Ammoland.com)- The NJ DEP has announced that a

state Appellate Division Court today dismissed a legal challenge to the

Comprehensive Black Bear Management Policy (CBBMP), clearing the

way for a week-long bear hunt that will take place in Northwest New

Jersey starting on Monday.

A two-judge panel rejected a request for an injunction made by the New

Jersey Animal Protection League and the Bear Education and Resource

Group to prevent the State’s first black bear hunt since 2005.

“The facts and science are clear,” said DEP Commissioner

Bob Martin. “There are a growing number of black bears in

New Jersey and a resultant increase in public complaints

about bear and human encounters. This is clearly a public

safety issue that requires responsible action by DEP and the

Fish and Game Council.”

“Hunting is the only proven and most cost-effective method

of wildlife population control, one that is utilized successfully

by other states,” said Commissioner Martin.

“But understand that hunting is just one facet of our

comprehensive black bear policy which also includes many

other important measures designed to deal with the black

bear issue.”

The CBBMP includes a common sense mix of bear management tools,

including public education, research, bear habitat analysis and

protection, non-lethal bear management techniques and enhanced

efforts to keep human food sources, especially household trash, away

from bears to limit bear-human encounters.

The two animal rights organizations sought a court order to stay the bear

hunt. That legal request came a week after Commissioner Martin issued

a letter that also denied their stay request for a hunt that is scheduled for

a seven-county region, including parts of Sussex, Warren, Hunterdon,

Passaic, Morris, Somerset and Bergen counties.

The bear population just in northwestern New Jersey has grown from

500 bears in 1992 to more than 3,400 bears today, and there are an

uncounted number of bears that have now been encountered in all 21

New Jersey counties.

Although bear related complaints vary from year to year due to

environmental factors, serious bear incidents have increased

commensurate with the black bear population, up by 96 percent from

2006 through 2009, according to DEP wildlife officials. There have been

233 serious Category One encounters with aggressive black bears so far

this year, an issue that requires action by the DEP to provide relief to

residents in areas of the state with the densest bear population.

Since the 1980s, New Jersey’s black bear population has been increasing

and expanding southward and eastward from forested areas of

northwestern New Jersey. There have been increased sightings of bears

this year in many suburban towns and urban areas, where black bears

have not been previously been encountered.

The Fish and Game Council in July adopted the CBBMP, which includes

a black bear hunting season, to deal with an overpopulation of bears and

problems they are causing. The Council cited increasing damage to

personal property and threats to public safety as key reasons for its vote.

The black bear hunt is scheduled to run concurrent with the six-day

firearm deer hunting season, December 6-11. It will be held in portions of

a 1,000 square-mile area north of Route 78 and west of Route 287 in

Morris, Sussex, Warren, Passaic, Hunterdon, Bergen and Somerset

counties.

Ohio Restaurant Carry Bill Needs Your Support

Campbell Ohio --(Ammoland.com)- I need your help on Monday,

December 6th — but let me give you a little history on why I need your

help.

Over the past two years Ohioans For Concealed Carry has invested a

substantial amount of blood, sweat, tears and money out of our treasury

to see Restaurant Carry come to life.

We worked with Representatives of the Ohio House to introduce the first

bill to make it lawful to possess a firearm in an Ruby Tuesdays or a Max

& Erma’s so long as you were not consuming alcohol.

Inevitably, Democrats in the Ohio House leadership stopped movement

on Ohio House Bill 203 — and similar legislation was introduced in the

Ohio Senate and passed.

We’ve covered the travels expenses of Ms. Nikki Goeser to come to the

Ohio Legislature twice to testify before both the Ohio House, and the

Ohio Senate when SB239 was introduced. Her testimony was referred to

as “some of the most compelling ever heard” by then-chairwoman Bolon

immediately following hearing her testimony.

Sadly, when the recent November election turned the Ohio House over to

Republican control and when the Governor was not elected politics

seemed to come to a standstill in the Ohio Legislature.

I personally anticipated the Ohio House to hold hearings on SB239 and

SB247 following the election, but it inevitably seemed as if there would

be no further sessions scheduled.

That has changed – the Ohio House has scheduled sessions, but they

HAVE NOT committed to do anything with these two vital bills that we

have invested substantial time and money trying to enact them into law.

As I said earlier in this article I need your help on Monday, December

6th making phone calls, and I need you to forward the link to this artcile

to everyone you know who would consider doing the same.

First: Call every member of the Ohio House Democratic leadership and

urge them to work with Speaker Budish to send these bills to Governor

Strickland.

she told Ms. Goeser that her testimony was some of the most compelling

When you reach their staff: Introduce yourself, tell them you’re a

member and supporer of Ohioans For Concealed Carry, and state that

you understand there is a limited opportunity for remaining sessions and

that you want House Leadership to work with Speaker Budish to pass

both SB239 and SB247.

• SB239 resolves Restaurant Carry and makes changed to

transporting a firearm in a vehicle.

• SB247 is a “rights restoration” bill that provides a means for

restoring an individual right to bear arms.

Once you’ve made these phone calls, you need to call your elected

representative. How do you find them? Go here:

you can enter your zip code in and identify your elected Representative,

who is representing you at least through the end of this calendar year.

Call their office and tell them everything mentioned above — then, tell

them that you want them to join Representative Bubp’s office in the

effort to use a discharge petition to extract these bills from committee

and send them directly to the House Floor, where they must be voted on

by the entire Ohio House.

Finally, call Governor Ted Strickland’s office at (614) 466-3555 – and

advise them that you want Governor Ted Strickland to do everything in

his power to get the Ohio House to send these two bills to his desk.

Grassroots activism like this is what has made concealed carry reform in

Ohio possible during lame duck sessions. We must remain vigilant that

with enough pressure from the electorate these two bills may very well

become law.

even if it is outside your home, scarring your kids.

Mask wearing animal rights activists should think twice before targeting

private residences in the nation’s capital.

Washington D.C. --(Ammoland.com)- Mask wearing animal rights

activists should think twice before targeting private residences in the

nation’s capital. A recently passed law by the D.C. City Council offers new

protections for those on the receiving end of such protests.

On November 23, the Council passed the “Residential Tranquility Act of

2010.” The bill, sponsored by Councilwoman Mary Cheh, was developed

due to constituent complaints involving the group called Defending

Animal Rights Today and Tomorrow or DARTT.

The group organizes protests outside private residences. These often

involve the wearing of masks and shouting slogans, like “you should die”

throughout the night.

According to Councilwoman Cheh, “They scared some people

so much that they feel like prisoners in their own homes.”

The legislation gives police the ability to arrest protesters under a set of

limited conditions.

Those include:

• protesting outside a private residence between 10 p.m. and 7 a.m.;

• Failure to notify the police at least two hours in advance of the

demonstration.

DARTT is a D.C. based branch of a larger organization called Stop

Huntingdon Animal Cruelty. That group was formed in 1996. It focuses

on protesting a European company, Huntingdon Life Sciences, which

provides animals for scientific research.

Anti Conservation Groups Sue to Stop New Jersey Bear Hunt

Columbus, OH --(Ammoland.com)- Earlier this week, the Bear

Education and Resource Group and the Animal Protection League of

New Jersey filed a lawsuit in two New Jersey Superior Courts seeking to

shut down the state’s upcoming bear hunt.

The lawsuit alleges that the state’s bear management plan, which

includes a hunt, was based on flawed science and that the state did not

follow proper technical procedures when adopting the plan.

The lawsuit comes on the heels of the New Jersey Department of

Environmental Protection (DEP) Commissioner Bob Martin denying a

request by the groups to postpone the hunt. The six day hunt is set to

open on Monday, December 6th.

In denying the request, Martin acknowledged that the bear hunt “is an

important and necessary part of the state’s comprehensive approach to

the management of its black bear population.”

“We hope that the court will see this lawsuit for what it really

is…a last ditch anti-hunting effort that undermines the state’s

science based management plan,” said Rob Sexton, USSA vice

president of government affairs.

“The New Jersey state agency has a long history of successful

wildlife management when it is allowed to do its job.”

This summer the DEP approved a bear hunt as part of the state’s overall

bear management plan. The management plan, which includes both the

hunt and non-lethal management tools, is meant to help control the

state’s exploding black bear population.

Bear hunting in New Jersey has been under fire since 2006 when the

former DEP Commissioner Lisa Jackson canceled the state’s bear hunt.

In response, the U.S. Sportsmen’s Alliance Foundation, along with the

Safari Club International and the New Jersey State Federation of

Sportsmen’s Clubs, filed a lawsuit against the state to challenge the

decision to stop the bear hunt.

Despite two lower court rulings compelling the former Commissioner to

proceed with the 2006 hunt, the state’s Supreme Court ultimately ruled

the Commissioner could block the hunt.

Virgina - -(Ammoland.com)- The Obama administration is moving into

high gear in putting gun-control advocates into important government

positions.

The administration’s nominee to head the Bureau of Alcohol, Tobacco,

Firearms and Explosives (BATFE), Andrew Traver, should be of

particular concern.

His attacks on the civilian use of so-called assault weapons raise real

questions about his willingness to distort the truth for political purposes.

The person nominated to be the nation’s top gun cop shouldn’t use

inaccurate descriptions to scare people into supporting gun control.

Mr. Traver is the special agent in charge of the BATFE’s Chicago field

division. Therefore, he knows what was covered by the federal assault-

weapons ban that sunset in 2004.

But in November 2009, NBC interviewed Traver and reported: “Traver

says the power and randomness of the heavy caliber, military-style

weapons make them so dangerous not only to people, but to police.

They’re so powerful, body armor can’t withstand a hit, and they’re so

difficult to control, their bullets often get sprayed beyond the intended

targets, striking innocent victims even when they’re in their own

homes.”

The list of problems with Mr. Traver’s claims is very long. If he really

believes that these weapons fire unacceptably “heavy caliber” bullets, he

is going to have to ban virtually all rifles. Small-game rifles — guns

designed to kill squirrels and rabbits without destroying too much meat

— typically fire .22-caliber bullets, which are only slightly smaller than

the .223-caliber bullets fired by the M16 (used by the U.S. military since

Vietnam) and the newer M4 carbine (used in the Afghanistan and Iraq

wars). Deer-hunting rifles fire rounds that are very similar to those used

by the AK-47.

Speaking of M16s, M4s, and AK-47s, Traver is correct when he states

that the guns covered by the federal assault-weapons ban were “military-

style weapons.” But he fails to note that this really just deals with style —

the cosmetics of the guns, not how they actually operate. The guns

covered by the ban were not the machine guns actually used by the

military, but civilian, semi-automatic versions of those guns. The civilian

version of the AK-47 may look like the guns used by militaries around

the world, but it is different. It fires essentially the same bullets as deer-

hunting rifles at the same rapidity (one bullet per pull of the trigger),

and does the same damage.

On penetrating body armor, Mr. Traver leaves out one important detail:

Rifles in general are often able to penetrate body armor simply because

their bullets travel faster than those fired from handguns. The same can

be said for going through the walls of houses. But if he had said that

deer-hunting rifles can often penetrate walls and lower-level types of

body armor, it is unlikely that his comments would have generated the

same fear.

Unfortunately, Mr. Traver has done more than make clearly inaccurate

claims about so-called “assault weapons.” He has supported banning

.50-caliber rifles, regulations that would force many gun shows to close

down, the Chicago handgun ban, and repealing the Tiahrt Amendment,

which protects sensitive trace data from being misused in frivolous

municipal lawsuits against gun makers. He also worked with the Joyce

Foundation, which has funded gun-ban groups such as the Violence

Policy Center, on the “Gun Violence Reduction Project.”

The fact that Mr. Traver uses the same misleading claims as groups such

as the Brady Campaign shouldn’t make it too surprising that gun-control

groups are applauding his nomination.

Nor is Traver’s nomination very surprising after President Obama

appointed two strong anti-self-defense members to the Supreme Court.

But Mr. Traver’s nomination is quite troubling. Making up claims about

guns to demonize them is beyond what is acceptable for someone who

wants a position in which he will be regulating American gun ownership.
