1.5 IHOP and Shriners Hospitals for Children ProclamationMayor McCourry presented a proclamation to Shriners Hospital of Dallas in recognition of the IHOP National Pancake Day and Shriners Hospitals for Children’s Day on March 7, 2017.

1.6 Recognition of Library volunteers for FY 2015-16 service and presentation of the James W. Althaus Volunteer of the Year Award.Library Director Joan Sveinsson presented annual Library awards to various volunteers recognizing them for their years of service and volunteer hours given to the Library in 2016. Samantha Pines received the James W. Althous Volunteer of the Year Award for 2016.

1.7.1 Presentation from the Parks and Recreation regarding upcoming events and activities.Special Events Coordinator Lindsey Stansell provided upcoming events and activities to Council.

City Manager Troy Powell announced Director of Engineering Gordon Scruggs would be retiring at the end of the month. Mr. Powell thanked him for his years of service and recognized him for the work he has accomplished.

2.0 WORK SESSION2.1 Legislative Update Discussion

Councilmember Boyer provided an update to Council on State Legislative discussions regarding the current Tax Rate, House Bill 1427, and other various legislative items the City may be interested in.

2.2 Discussion of Polling Sites for upcoming LISD May Election.Director of Government Relations Brant Shallenburger briefed Council on a discussion with Dr. Rogers, Superintendent of Lewisville School District regarding permanent polling locations at Griffin and Lakeview Middle Schools for the May and November Elections. Mr. Shallenburger stated Denton County does not have any issues with this request.

Council provided discussion on this item and advised staff to set up a meeting between the City, the School District, and Denton County to discuss Council's concerns for the November Election.

3.0 CITIZEN INPUTThis portion of the meeting is to allow up to five (5) minutes per speaker with a maximum of thirty (30) minutes for items not posted on the current agenda. 4.2 Consider the approval of a resolution authorizing the City Manager to execute the American Cancer Society/Relay for Life request for use of a mobile stage, the Five Star Complex, a fee waiver, and an exception to the City's noise ordinance (Section 6-192.c, Item 2).

5.1 Discuss and consider a resolution approving a Private Transfer Agreement (Grant by Special Warranty Deed) by and between The Colony Local Development Corporation and LMG Ventures, LLC, conveying an approximately 90.147 acre tract of land out of Lot 3, Block A, Grandscape Phase II Addition, an addition within the City of The Colony, Denton County, Texas.City Attorney Jeff Moore advised that the item was discussed earlier in the Local Development Corporation (LDC) meeting that took place prior to the Council meeting. The LDC approved a proposed resolution of a Private Transfer Agreement with LMG Ventures, LLC., conveying an approximate 90.147 acre tract of land in the Grandscape addition.

Motion to approve- Boyer, second by Schrag; motion carried with all ayes.

5.2 Discuss and consider the approval of a resolution authorizing the City Manager to execute and support of House Bill 1427 regarding the utility/zoning issue.Director of Government Relations Brant Shallenburger briefed Council on this item. Mr. Shallenburger stated last week in Austin he met with the Legislative Director of Texas Municipal League regarding the proposed resolution to executethe support of House Bill 1427. A copy of this resolution was presented, reviewed and mailed to the Texas Coalition of Cities for Utilities and Thomas Brocato withLloyd Gosslink Attorneys at Law.

5.3 Discuss and consider the approval of a resolution granting a special exemption from the sound ordinance pursuant to Section 6-192 of the Code of Ordinances by authorizing the use of construction equipment for the FM 423 Widening project for the purpose of a water line tie-in.This item was pulled from the agenda.

5.4 Discuss and consider the approval of a resolution authorizing the City Manager to execute an agreement with Halff Associates, Inc. to provide civil engineering services for the construction of Fire Station #4.Facilities Manager Terry Gilman presented this item to Council.

5.6 Discuss and consider the approval of a resolution authorizing the City Manager to execute a contract with Transend, Inc., D/B/A Spa Skateparks for the design and construction related to the renovation and expansion of The Colony Skatepark located at Kids Colony Park.Park Development Manager Eve Morgan reviewed the proposed resolution to Council. Ms. Morgan presented preliminary drawings for the renovation of The Colony Skatepark located at Kids Colony Park.

Motion to approve- Schrag; second by Wade; motion carried with all ayes.

5.7 Discuss and consider the approval of a resolution authorizing the City Manager to execute an Engineering Services contract with Halff Associates, Inc. to prepare construction plans for the Phase 7 Re-Construction of Residential Streets and Alley.Engineering Director Ron Hartline presented the proposed resolution to Council. Mr. Hartline stated the contract is for the design of Phase 7 Re-construction for residential streets and alleys to include Hackney Lane, Augusta Street, McAfee Drive, Walker Drive, Thompson Drive and Dooley Alley.

5.8 Discuss and consider the approval of a resolution authorizing the City Manager to execute an Engineering Services contract with Alan Plummer Associates, Inc. for Extension of the Austin Ranch Force Main to the Stewart Creek Wastewater Treatment Plant.Engineering Director Ron Hartline presented the proposed resolution to Council. Mr. Hartline stated the contract design is the extension of the Austin Ranch Force Main to the Stewart Creek Wastewater Treatment Plant.

Council provided discussion on this item.

Gordon Scruggs former Engineering Director provided an update explaining the status on this proposed project.

Motion to approve- Wade; second by Schrag; motion carried with all ayes no.

Resolution 2017-019

5.9 Discuss and consider approval of a resolution for an Engineering Services contract with Halff Associates, Inc. to prepare construction plans for stream bank stabilization along Taylor Street.Engineering Director Ron Hartline presented the proposed resolution to Council. Mr. Hartline advised Council of erosion concerns for the stream located near Taylor Street and explained the staff recommended course of action to stabilize the erosion.

Council provided discussion on this item.

Gordon Scruggs former Engineering Director provided an update explaining the status on this proposed project.

Hereinafter referred to as Advertiser hereby contracts with DMNmedia, an assumed name of The Dallas Morning News(hereinafter “DMNmedia”) for consumption of not less than $3,000 of advertising through the use Classified advertising to be published within 12 months. Dallasnews.com expenditures revenues count toward the fulfillment of TDMN dollar volume contracts unless otherwise stipulated.

Such advertising to pertain solely to the business of the Advertiser as now conducted, for which the Advertiser agrees to pay at the office of DMNmedia at Dallas, Texas, in accord with the rates as designated by ratecard and/or Appendix A.

If, for any reason, including suspension of business of Advertiser, less insertions than that contracted for herein is used by Advertiser, and by reason of such fact Advertiser fails to earn rates specified herein, Advertiser agrees that all space used under this contract shall be computed according to the published schedule of rates in effect at date of this contract and hereby agrees to pay Publisher, immediately, whatever amount such computation may show to be due publisher. This agreement applies to any discontinuance of the advertising, whether at the instance of the Advertiser or of the Publisher. Such amount will be due and payable immediately upon receipt of the invoice.

The entire contract is expressed on the face hereof and in the additional Further Conditions & appendices on the back hereof and no verbal agreements, provisions or conditions exist with respect thereto.

APPENDIX B

FURTHER CONDITIONS OF THIS CONTRACT

1. Publisher reserves the right to edit or reject any advertising tendered under this contract.

2. Payment by Advertiser, denominated in U.S. Dollars, must be made in Dallas, Texas, and shall be made not later than the 20th of the month for space billed in the preceding calendar month. Publisher and Advertiser agree that this contract is performable in Dallas County, Texas and shall be governed and construed in accordance with Texas law.

3. Publisher’s rates in this contract are based on an assumed classification for the advertising being placed. If at any time Publisher determines that the advertising being placed does not qualify for the rates set forth, then Publisher shall notify Advertiser that any further inserts run pursuant to this contract shall be run at a revised rate. Advertiser agrees to pay Publisher the revised rate for any insertions run after Advertiser has received notice that the rate has been revised and the amount of the revised rate. If Advertiser chooses not to pay the revised rate, then Advertiser must advise Publisher before any additional insertions are run. If Advertiser gives notice to Publisher that Advertiser will not pay the revised rate, then this contract shall be terminated, and the parties shall have no further liability to each other except for amounts owing for advertising run prior to Publisher's receipt of such notice from Advertiser. Upon contract termination, all advertising will be billed at the appropriate rate card rates.

4. Advertisements are to be inserted in accordance with the Publisher's rules of composition, position, and shape.

5. If Advertiser requests a specific position for the advertisement, then Advertiser agrees to pay the rate for such specific position provided the position is available. Publisher is not required to accommodate a request for a specified position. If a specified position requested by Advertiser is not available, then Publisher may position the copy in any position according to the Publisher's rules of composition, position, and shape, and Advertiser agrees to pay the applicable rate of any copy printed in other than the specified position unless Publisher is notified in writing by Advertiser that the copy is to be printed only in the specified position.,

6. If Advertiser fails to make payment of undisputed sums as agreed, then Publisher and Advertiser agree that Publisher may at any time terminate this contract. Termination of the contract shall in no way affect the obligation of Advertiser to pay undisputed amounts due at the time of termination.

7. In case of omission or error by Publisher in an advertisement, Publisher shall not be liable for damages. Advertiser's sole remedy shall be that Advertiser shall not be liable for the entire cost of the advertisement. Publisher will determine, in its sole discretion, the percentage of effective cost due to error and reduce the entire cost of the advertisement by this percentage amount or offer replacement ad equal to the percentage amount.

8. Advertising running consecutively will be carried until Advertiser notifies Publisher in writing that copy will be changed or the advertisement will be suspended.

9. In the event of a default or other breach of this contract by either party, the prevailing party shall be entitled to recover attorney’s fees and costs.

10. While this contract is in effect, should any conditions arise that affect the cost of newspaper operation, such as imposition by government of a sales tax or increased material or production costs, Publisher reserves the right to increase the advertising rates named on the reverse side of this page or incorporated into this page by reference. In such event, however, Publisher must give Advertiser at least thirty (30) days notice of the increase, and if such increase is not satisfactory to Advertiser, then Advertiser may terminate this contract.

11. Advertiser represents and warrants that the material provided by Advertiser for publication in accordance with this contract is true, accurate, and correct and does not infringe or otherwise violate the copyright, trademark, service mark, or other intellectual property rights, or rights of privacy or publicity, of any third part. To the extent allowed by law, Advertiser agrees to indemnify, defend, and hold harmless Publisher, its parent company and affiliates and each of their directors, officers, agents, and employees from and against all claims, exposure, liability, loss, or damage, including reasonable attorneys’ fees, alleged to be caused by or arising wholly or in part from the publication of Advertiser's material. This indemnification shall not apply to willful misconduct by any employee of Publisher.

12. This contract is made and entered into under Publisher's current published schedule of rates in effect on the date of this contract, and by reference such schedule is expressly made a part of this contract. Advertiser assumes responsibility for being knowledgeable about such current published schedule of rates, and Advertiser shall be deemed to know such current published schedule of rates.

13. Advertiser agrees to submit to Publisher, in writing, all claims of errors in the statement of account submitted by Publisher within thirty (30) days of the billing date. All such claims not submitted within thirty (30) days shall be considered waived.

14. If Publisher's "Application for Credit" form has been completed and submitted by Advertiser in connection with this contract, then Advertiser warrants that the information contained in that application is true, accurate, and correct and agrees that the making of any false statements in that application constitutes a material breach of this contract.

15. Any ″Application for Credit″ form executed by Advertiser is part of this contract and incorporated into this contract fully by reference.

16. Advertiser, and the person, if any, signing on Advertiser's behalf, warrants that he or she has the authority to make and sign this contract.

17. Advertiser agrees to immediately notify Publisher in writing of any change in ownership of Advertiser’s business operation. The Advertiser further agrees to assume liability for and make payment of all advertising published pursuant hereto in the event Advertiser’s business is sold, merged, or otherwise transferred, until such time as a contract is entered into between Publisher and the new owner.

A RESOLUTION OF THE CITY OF THE COLONY, TEXAS, DESIGNATING THE DALLAS MORNING NEWS, AS THE OFFICIAL NEWSPAPER FOR THE CITY; PROVIDING AN EFFECTIVE DATE

WHEREAS, the Texas Local Government Code, Section 52.004, requires the governing body of a municipality to annually designate a public newspaper of the city as the official newspaper for official publications; and

WHEREAS, The Colony City Council finds that the Dallas Morning News is a publication that meets the criteria legally required of an officially designated newspaper as stated by the Texas Government Code Section 2051.044.

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF THE COLONY, TEXAS:

Section 1. That the City Council of the City of The Colony, Texas hereby designates the Dallas Morning News as the official newspaper of the City of The Colony for publication of ordinances, public notices and other matters required by the state law.

Recommendation:The approved budget for this item is $115,000. Originally the Public Works Department intended to purchase anArrow Master Concrete Breaker; however, the high cost of the item and low versatility became evident and a betteralternative was identified. Staff researched the option to purchase a skid-steer with a drop hammer attachment. Thisoption would provide more versatility by allowing the Public Works department to not only utilize the concrete breakeroption with the drop hammer attachment but also use the skid steer for additional needed options thus creating a highervalue to the city at a lower cost.

Staff recommends approval for the purchase of a Caterpillar skid steer with drop hammer attachment in the amount of$59,486.09.

Recommendation:This is a routine bid for hauling and disposal of bio-solids for the wastewater treatment plant. Staff received a bid fromSunbelt Industrial Services, SWS Environmental Services and Trans-Environmental. Sunbelt Industrial Servicessubmitted an incomplete bid therefore was disqualified and Trans-Environmental opted out of the bidding due to acalculation error in the bid submitted. The city and staff has an established satisfactory work history with SWS and isrecommending approval. The proposal and contract submitted has been reviewed by the city attorney and has beendetermined satisfactory.

Staff recommends Council authorize the City Manager to enter into an agreement with SWS Environmental Services foran annual contract in the amount of $305,800 for hauling of bio-solids with options to extend the contract for up to three(3) one-year periods by consent of both parties.

• Work will be performed by properly trained personnel donned in the appropriate level of personnel protective equipment (PPE) under supervision to meet Occupational Safety and Health Administration (OSHA) regulations, and Federal, State and local laws for safety and health.

• All personnel used for the management of any contaminated materials encountered will have received a minimum of 40-hour training in hazardous materials management and is current on all annual 8-hour refresher training in accordance with 29 CFR 1910.120.

• SWSES will stage two (2) – 30 cubic yard roll-off boxes at the Client’s wastewater reclamation facility at 7500 Forrest Land, The Colony, TX for the duration of the contract,with the exception of transportation intervals.

• Prior to mobilization, the Client will be responsible for: Providing at least a 24-hr notice in order to schedule each pickup; Sampling and analysis of any material, if necessary;

Profiling the waste into the SWSES designated landfill; Filling the containers evenly to assure ease of handling and transportation; Performing and ensuring that the material passes the paint filter test; Allowing for unimpeded access to the site and these containers.

• SWSES will transport a minimum of 14 tons but no more than 18 tons on each load. Transportation will be performed on a "drop and swap" basis.

• Demurrage will be charged at a rate of $90.00 per hour, or fraction thereof, if disposal is delayed at the landfill due to radiation issues.

• This contract can be extended for up to three (3) one-year periods by consent of both parties.

Customer acknowledges that invoicing will consist of actual quantities incurred at the provided rates. Any

additional resources required, other than those identified herein, will be invoiced in accordance with SWSES’s

WHEREAS, the City has entered into an agreement with SWS Environmental Services for the transportation and disposal of non-hazardous bio solid waste; and

WHEREAS, the City has determined that it is in the best interest of the City to enter into this agreement which is attached hereto and incorporated herein by reference as Exhibit “A,” under the terms and conditions provided herein; and

WHEREAS, the City of The Colony is agreeing to pay the sum of $305,800.00 for such work.

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF THE COLONY, TEXAS, THAT:

Section 1. The Proposal from SWS Environmental Services is attached hereto and incorporated herein as Exhibit "A", having been reviewed by the City Council of the City of The Colony, Texas, and found to be acceptable and in the best interest of the City and its citizens, be, and the same is hereby, in all things approved.

Section 2. The City Manager is hereby authorized to execute the proposal on behalf of the City of The Colony, Texas.

Section 3. This Resolution shall take effect immediately from and after its adoption and it is so resolved.

Re: Contract Mowing and Landscape Services

Purpose

To consider bid awards for mowing and landscape services to three different companies: SLM Landscaping & Maintenance, Greener Pastures Landscape, and WCD Enterprises, LLC. This is an annually renewing contract with the option for three renewal years after the first year of service as long as the performance of each contractor is sufficiently up to the standard of the City.

Background

Contract mowing and landscaping is a necessary, and continual, service for the City because we currently lack the appropriate resources to maintain all mowing and landscaping services in house. Currently, staff is responsible for maintenance of mowing on the playing surfaces at Five Star and in the greenbelt and rough cut areas within the city. Staff is also responsible for the landscaping on North Colony Boulevard from FM 423 to Paige Rd. In addition, staff also maintains the Shoreline Trail trailhead entry at Stewart Creek Park, and the landscape at the Keith Helms Memorial Sundial.

These contracts would cover the areas we are unable to maintain. These include: athletic practice facilities, parks, municipal facilities, and medians and parkways. Each of these areas has been included in prior mowing and landscape contracts. The term of the mowing contract runs for 36 weeks from March – November. Each location included in the contract will be maintained once each week as long as weather conditions are favorable. The term of the landscape contracts runs through the entirety of the year. Each location included in the contract will be maintained once per week from March – November and once or twice per month (depending on need) from December – February as long as weather conditions are favorable.

Recommendation

Our recommendation is to award these contracts to three separate companies in order to achieve the lowest possible cost to the City. As you will see in the bid tab, the contract was divided into several different location groupings to make these divisions more favorable to both the City and potential contractors.

We recommend that SLM Landscaping & Maintenance be awarded the mowing contract for medians & parkways and parks (2).

We recommend that Greener Pastures Landscape be awarded the mowing contract for parks, municipal grounds, and sports fields.

We have previously worked with both of these contractors and feel confident that they would be able to maintain the desired level of service for each of these locations.

Our recommendation for landscape services is to award the contract to WCD Enterprises, LLC. While we have not previously worked with this company, we have verified through their references that they have a positive reputation for quality work, responsiveness, and outstanding customer service.

The overall cost of these services has increased by 20% since the date of the last bid cycle in March 2014. The current value of these contracts for the remainder of FY 16/17 is $180,000. The remaining funds available from the sources (General Fund, Aquatics Fund, Lake Parks Fund) used to cover these expenditures is approximately $170,000. However, while we do intend to increase our budgetary request for FY 17/18, it is our intent to not request additional funding to cover these contracts at this time. It is possible that we will be able to achieve the cost savings necessary to fund these contracts through missed cycles due to inclement weather, so we will not request a budget amendment unless it is necessary later in the mowing season.

A RESOLUTION OF THE CITY OF THE COLONY, TEXAS, AWARDING A BID FOR THE ANNUAL SEASONAL MOWING SERVICES OF PARKS AND OTHER MUNICIPAL GROUNDS TO SLM LANDSCAPING AND MAINTENANCE AS SPECIFIED IN THE ATTACHED EXHIBIT “A” BID SUMMARY; AND PROVIDING AN EFFECTIVE DATE

WHEREAS, the annual seasonal mowing services for municipal grounds, parks, medians, and rights-of-way is needed throughout the city; and

WHEREAS, bids were received and evaluated with two bidders selected for various projects; and

WHEREAS, the Parks and Recreation Department budget contains funding for maintenance and seasonal mowing services.

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF THE COLONY, TEXAS, THAT:

Section 1. As identified in Exhibit “A” the annual seasonal mowing of the medians and rights of way, Stewarts Creek Park, Bill Allen Memorial Park, Park Loop Trail, Kids Colony and Aquatic Park to be awarded to SLM Landscaping and Maintenance in the amount of $108,036.

Section 2. The City Manager or his designee is authorized to issue appropriate purchase orders(s) in accordance with the bid awarded.

Section 3. This resolution shall take effect immediately from and after its passage.

PASSED AND APPROVED by the City Council of the City of The Colony, Texas, this 7th day of March, 2017.
