Before starting of Meeting, the President raised the following points
1. Pay irregularities about contractual employees engaged by the Board. PCB asked
the details of all contractors. CEO assured him to provide the same.
2. PCB raised the points regarding post of Asstt Teachers in the schools. He was of
the view that the post of the teachers should be upgraded being Cantt Board having High
School and Higher Secondary School also. He has also raised the point related to salary
getting by contractual staff. He advised to write a letter to State Govt. for affiliation to
the Cantt Schools and providing facilities to the students of Cantt Board schools.
3. PCB advised the Board that proper funds be utilized on Health and Education.
After this Ward Member 1 Smt. Kavita Bawaria Pasi raised the point that Cantonment
Board is having 02 JCBs, out of which 01 JCB should be sent in each ward alteast once
in a week for cleanliness. Board has given its consent on this.
Shri Amit Agrawal, Ward Member 8 has raised the point of mobile towers installed at
residential accommodations in cantonment area. Board has decided that notices shall be
sent to the concerned owners for uninstalling the mobile towers. If the concerned owners
failed to comply the orders then the Board is free for initiating action against the
defaulters including putting damage charges as per procedure. CEO assured the Board
that due action shall be taken on it.

Considered, noted and approved except Point No. 2.
Elected Board Members raised the issue of the existing vendors at Road Street
No. 1. They mentioned that those people belong to BPL families and they have
been making their livelihood from this market. Those 15 vendors must be
provided shops and for that Cantt Board must find some way. Therefore it was
resolved to get the legal opinion from CLA and Revenue Section must identify the
deserving beneficiaries. The matter shall be put up in next Board Meeting.

Agenda Point No. 12 – It was resolved that the rates for rain coats (Brand Duck
Back) quoted by M/s Khadi Ashram be read as @Rs. 759.60 each + 5% tax extra.
Agenda Point No. 13 – It was resolved that a proposal shall be sent to competent
authority regarding implementation of benefits to MP Pay Revision of pensioners
who have retired before 01.01.2016.
3. Minutes of Education Committee
To consider/approve minutes of proceedings of Education Committee held on

July 2018.

Considered, noted and approved.
Further it was resolved that two shifts be started in Dr Sarvapalli Radhakrishnan
Cantonment High School, Gora Bazar. Jabalpur, as school is facing problem to run
English medium school and Hindi Medium school simultaneously due to shortage of
rooms and teachers. The timings of first shift shall be from 7.30 to 12.30and for Second
Shift timings shall be 12:3 to 5:30. Timings of high school shall be 1:30 pm.
It was also resolved that the name of Cantt Ridge Bazar Primary School be
changed to “Dr Abdul Kalam Cantt Ridge School”, as the school is applying for
recognition.
4. Empanelment of Integra Legal, a recently established Law Firm for handling
legal work.

To consider the application dtd 06-07-2018 and 25-05-2018 of Shri Anuj
Aggarwal, partner of Integra Legal, Law Firm for empanelment of the firm as Legal
Advisors for handling legal work, including litigation, drafting & vetting legal
documents, and rendering legal advice & opinion on matters of law, on behalf of Jabalpur
Cantonment. The said firm is having two retired Director Generals namely Shri Ravi
Kant Chopra and Shri R.P. Singh as its partner. Firm has also provided Schedule of fees
of their fees.
Board is requested to consider the same . Relevant application is placed on the
table.
Resolution No. 4
Considered in detail. It was resolved that the above mentioned firm be asked for
further reduction in their fees structure, as the fee schedule provided by them is on very
higher side.
5. Town Planning & Development Plans of Cantonment Boards : Development
Plan (5 years) for the period 2017-2022 for Cantonment Board Jabalpur
As per instructions / directions of higher authorities, Cantonment Board Jabalpur has
prepared a 5 years Development Plant consisting of the following works.
1. Developing/Extension of MN hospital building
2. Providing more rooms in school buildings
3. Mastic asphalt at road crossing
4. Development of garden
5. Construction of barat ghar
6.Carpetting of CF roads
7. Renovation / development of CF buildings
8. Construction of shopping complex at Gora Bazar and Mutton Market
9. Installation of Traffic Signals
10. Development of schools
Board is requested to consider and approve the same.

It was further resolved to make development in time bound manner and proposal
be prepared accordingly.

6. Composition/ Sanction of Building plan application u/s 235 read with Sec 248
of the Cantonment Act, 2006 regarding construction of Shopping Complex
in GLR Sy.No.132, B.No.33, Kingsway Ashok Marg, Jabalpur
To consider the composition building plan application u/s 235 read with Proviso of
Sec.248 of Cantonment Act,2006 submitted by Smt. Zia Banu Malak, Shri Saifuddin
Malak, Shri Amte Badar Jeevaji and Smt. Riza Banu [hereinafter referred as
Applicants/HORs] for compounding of Shopping Complex erected in GLR Sy.No.132,
B.No.33 Kingsway, Ashok Marg Jabalpur. It is worth mentioning that the Board was
approved the building plan application of present Applicants/HORs vide CBR No.2 dated
4/3/1989 for same construction which was subsequently cancelled by the Board vide
CBR No.1 dated 28-12-1990 on ground of non depositing complete process fee but till
date of passing this CBR, the applicants had erected maximum construction hence it is
also decided by the Board to issue notice U/s 185(1) of the Cantonment Act 1924 to the
applicants/H.O.Rs. The applicants/HORs were challenged notice U/s 185(1) of the
Cantonment Act 1924 before the Competent Appellate Authority by filing an appeal
which was dismissed by the final order dated 30/04/1992.
Thereafter applicants filed Misc. Petition No. 2440/1992 before Hon’ble High
Court of M. P. challenging CBR. No. 1 dated 28/12/1990 by which the board cancelled
building sanction as well as notice U/s 185(1) of Cantonment Act 1924 issued against the
applicants. It is worth mentioning that one Salim Bhai on behalf of ‘Mehdi Bagh Waqaf
(Trust) Nagpur’ intervene into this petition on ground that Petitioner No. 2 Amiruddin
Malak has lost in civil suit which was filed by intervener Salim Bhai regarding title of
property bearing B. No. 33, Kings Way Sadar, Jabalpur . It is also submitted by the
intervener that the findings of title of Trust over said property has been confirmed by the
Hon’ble High Court of Nagpur in S.A. No 132/1992 and also by the Hon’ble Supreme
Court through dismissing S.L.P. No. 25004/1996 filed against final order of S.A. No.
132/1992.
This Misc Petition No. 2440/1992 has been decided by Hon’ble High Court of
M.P. vide final order dated 18/04/2006 under which it is mentioned that there is serious
cloud over title of suit property between petitioner and Trust (Intervener). Hence
Cantonment Board must notice to the trust before taking decision to dismantle
unauthorized construction raised by the Petitioners. It is also confirmed by the High
Court that Title of Trust was determined upto the Supreme Court of India thus it is for

the petitioner (Applicants/HORs) to seek protection of his possession against the Trust in
proceedings of civil suit filed by him against the Trust which is pending before ADJ,
Nagpur in which trust is party. The order to maintain status quo regarding demolition of
suite property was also passed only for period of six weeks.
The final order dated 18/04/2006 passed in M.P. No 2440/1992 had been
challenged by petitioner Zia Bano Malak and others [Applicant/HORs] through filing
Writ Appeal No.115/2006 which has been decided on 16/07/2007 by which the Hon’ble
Division Bench confirmed the order dated 16/04/2006 with only modification that
structure will not be demolished without following due process of law as contemplated
under Cantonment Act 1924. The division bench also directed appellants (Zia Bano
Malak & others) to approach appropriate legal forum for establishing their title over
property of B. No. 33.
The intervener Salim Bhai has submitted an objection before this Board against
the composition/ sanction of building plan submitted by the applicants/H.O.Rs under
which it is specifically contended that the Maharashtra State Board of Wakf has already
registered the “Mehdi Bag Wakf” under the Wakf Act 1995 by giving registration No.
MSBW/39/2008 and recorded its properties as per deed of 1931 (Exhibit No 249) as
properties of this Wakf. The property of B. No. 33 Sy No. 132 Kingsway Ashok Marg is
duly entered at S. No. 56 in (Exhibit No 249). It is also mentioned by the objector that the
present applicants/ H.O.Rs have already filed an application U/s 6, 7 read with Sec 83(2)
of the Wakfs act 1995 before Wakf Tribunal/ District Judge Nagpur for challenging
registration of property baring B. No. 33 Sy No. 132 as. Mehdi Bag Wakf property on
ground that they are owners of this property. All these four applications bearing Wakf
case No. 6, 7, 8 and 9 of 2009 are pending for final adjudication.
In this factual scenario it is evident before the board that the present applicant /
H.O.Rs submitted the present application for composition/sanction of building plan
without mentioning that title of the property of B. No. 33 Sy. No. 132 is subjudice before
Wakf Tribunal Nagpur which is a very material fact and has been suppressed by the
applicants/H.O.Rs. It is also important to know that the objector has submitted a final
order dated 10/02/1999 passed by Hon’ble Supreme Court of India in Civil Appeal No
1710/95 titled as Salim Bhai Mukhatar Jaffar Bhai Chimthanawala V/s Amriuddin S/o
Hassan Nurani and Others. Under which the Hon’ble Supreme Court has held that it is
not open to the respondent (present applicant/H.O.Rs) to contend that properties
mentioned in Exhibit 249 are not the public trust properties.
The land in question is situated outside the notified Civil area comprising GLR
Sy.No.132, B.No.33 Kingsway Ashok Marg, Jabalpur. As per GLR record enclosed with
application, the property is occupied under leasehold rights as per Schedule VIII of
CLAR 1925 awarded on dated 11-7-1933 for perpetuity on annual lease rent Rs. 129.10

in favour of Mrs Zia Banu Malak(wife), Mr Amiruddin Malak (Son), Mr Saifuddin
Malak (Son), Mrs. Amte Badar Jeevaji and Miss Riza Banu Malak daughter all late of
Shri Hussain Nurani Malak.
The plan was referred to DEO Jabalpur Circle, Jabalpur was referred to DEO
Jabalpur Circle, Jabalpur for vide this office letter No. CBJ/CE/Mutation / 2017/ 611
dated 28-12-2017 for comments from land point of view. The same has been returned by
the DEO / JAB/Sy.No.132/I/76 dated 19-01-2018 with the remark that “Since in the
subject matter the Hon’ble Double Bench of High Court of M.P. Jabalpur passed clear
order, follow up action is to be taken by the Cantonment Board, Jabalpur, if not taken
earlier and action taken along with resolution of Cantonment Board for compounding of
structure duly indicating the composition fee etc may be sent to this office for our further
action.
The Chief Executive Officer is of considered opinion that applicants/HOR’s has
violated terms of the building sanction by not depositing complete sanction fee to this
office as well as suppressed above mentioned material facts regarding order passed by
Hon’ble Supreme Court of India on issue of title of property bearing B. No. 33 Sy.
No.132. The applicants/ HOR’s is also suppressed this material facts that all they have
applied before District Judge Nagpur for deleting the entries of property in question from
register of trust/Waqf properties under which the property in question is recorded as
Mehdi Bagh Waqf Property. Hence it will not be correct to compound the unauthorised
construction erected by applicants/ HOR’s because if the competent court would deny the
title of applicant/HOR’s they may claim compensation for sanctioned construction from
the Board.
Proposed construction admeasure as under:-
As per GLR lease plot area = 1.57 acres (68389 sqft.)
Existing constructed area at G.F. = 1638.82 sqm (17633 sqft)
Proposed compounding area at G.F. = 565.70 sqm (6087 sqft)
The approximate assessed construction cost @ 950/- per sqft. would be Rs 6087x950 =
Rs 57,82,650/-.
Process fee @ 5% of the construction cost is Rs 2,89,133/-
Compounding fee is double the process fee i.e. Rs 5,78,266/-.
Relevant document along with report of Engineering Section are placed on the
table for resolving prayer of composition/ sanction of building plan submitted by the
Applicants/ H.O.Rs.

Considered. After detailed discussion and perusal of entire record it was resolved
that the applicants /HORs malafidely violated terms of original building sanction as well
as did not disclose complete facts of the case in their composition application, hence the
composition / sanction application of HORs be returned with the remarks that they may
file fresh application for composition / sanction, subject to the finalization of Waqf case
no. 6,7,8,9 of the 2009 pending before District and Session Court, NAGPUR
(Maharashtra).
7. “Building Plan for Proposed Construction of Second Floor in Part of Sy. No.
68, House No.111, APR Colony Katanga, Jabalpur Cantonment.”
To consider the building plan and application u/s 235 of Cantonments Act, 2006
submitted by Shri Vijay Kuril S/o Late Shri Sewa Prasad Kuril, of Part of Sy. No. 68,
House No.111, APR Colony Katanga, for the Proposed construction of Second Floor in
the Sy. No. 68(part), House No.111, APR Colony Katanga Jabalpur Cantt.
The land in question is situated outside the notified civil area comprising Part of
Sy. No. 68(part), House No.111, APR Colony Katanga Jabalpur Cantt.
The plan was referred to DEO Jabalpur Circle, Jabalpur for obtaining ‘NOC’ from
land point of view as required u/s 238 (3) of Cantonment Act, 2006, for the proposed
construction. The same has been returned by the DEO to this office vide letter
No.DEO/JBP/Building Plan/Gen/Katanga/Vol-II, dated-05/07/2018, with the remark “as
per GLR of this office the Proposed construction falls on GLR Sy.No.68, Jabalpur Cantt
classified as “B-2” land place under the management of the Local Government Hence,
NOC cannot be given by this office for the proposed construction. Please take further
action at your end.”
Proposed construction admeasures as under:-
Total Plot Area - 1500.00 sqft
Existing construction of Ground Floor - 885.00 sq.ft
Existing construction of First Floor - 830.00 sq.ft
Proposed construction of Second Floor - 830.00 sq.ft
Total Proposed Construction of Second Floor - 830.00 sq.ft.
The approximate assessed construction cost @ Rs-950/- per sq.ft. would be
Rs-7,88,500/-, process fee @ 5% of above amount Rs-39,425/-.
The plan along-with report of Engineering Section are placed on the table.

Resolution No.7
Considered. Resolved that building plan in respect of Shri Vijay Kuril S/o Late
Shri Sewa Prasad Kuril, for the construction in the Part of Sy. No. 68, House No.111,
APR Colony Katanga, be sanctioned u/s 238 of the Cantonments Act, 2006 on payment
of process fee of Rs-39,425/-. The applicant shall inform the CEO in writing the date of
commencement and completion of the building work. The work shall be completed
within one year from the date of commencement. The sanctioned plan must adhere to in
every detail and particulars. Any deviation from the sanctioned plan shall entail action
under sections 239, 244, 247, 248, 249 and 320 of the Cantonments Act, 2006 and other
legal actions as the Board may take, including demolition of unauthorized construction.
8. Contract of Installation and running of Toy Train Children Helicopter Car
and Jumping Bounce etc at Tagopre Garden.
The Cantonment Board Jabalpur first time invited tender from interested persons
for Installing Toy Train, Children Helicopter, Children Car, Jumping Bounce in Tagore
Garden on 04-07-2016 for the period of One year after completion the tendering process
the tender had been approved by the Board vide CBR No. 05 dated 05.-12-2016 in favor
of Shabnam Bano.
The Contractor Successfully run the contract for the One year and also
deposited complete contract amount without any dispute and complications. Thereafter
on expiry of One Year this office again published fresh Tender for further period of One
year but no Bid received in this office. The details of floating tenders is as below:-

Due to continuous non receiving of any bid even after 05th
Call. It is worthless to
float Tender again and again. Therefore this office has to drop work of Installation of
various Toys as mentioned above.

Considered, approved and resolved to drop the proposal.
9. Gitanjali Mini functions Hall Cum Butterfly Food Court – Rate Revision.
To consider and revise the estimated cost of the contract of Gitanjali mini
Function Hall Butterfly food Court. Even after reducing the base price
fromRs.30,00,000/- vide CBR No.46 dated 08-06-17 and from Rs.25,50,000/- to
Rs.23,00,000/- vide Circular Agenda No.1 dated 27-09-17 not even a single tender
is received. After thgis Board vide CBR No. 4 dated 19-01-2018 resolved to
reduce the base price of Gitanjali Mini Function hall cum Butterfly Food Court
from Rs.23,00,000/- to Rs.18,00,000/-. Accordingly online tenders were invited
vide NIT No. 6520/Gitanjali Hall/RS/2018 dated 24-01-2018. No Tenders
received against this call.
After First Call dated 28-02-2018 the second call was published but no
tender is received. After second Call, Third Call was published on dated 26-03-
2018 vide FCR No.9 dated 23-04-2018 but no tender is received, which were open
on 02-05-2018.
It seems that the estimated cost is still higher and needs to be reduced
further to such an extent so that tender may be received.
In the meantime Cantonment Board is giving the hall on rent of Rs.8000/-
per day and rs.2000/- security deposit as approved vide PCB’s sanction dated 24-
04-2017 so that there is no loss of revenue till the finalization of the new tender.

Resolution No. 9
Considered. It was resolved that fresh tender may be floated after fixing base
price of Rs 10,00,000/-. Till the tender process shall be finalized, Board will run the
Gitanjali Mini Function Hall on rent basis.
10. Fixing of Base Price for VET Tender.
CBR No.15 dated 23-04-2018.
Last tender for vehicle entry tax for year 2017-2018 was approved by the Board
vide CBR No.01 dated 25-03-2017 on total tender cost Rs.2 00 11 000/- It is worth

mentioning that due to construction of Bypass Road by MPRDC for connecting Nagpur
Highway (NH-7) to Mandla Highway (NH-12A) condition number 15 has been entered
in the contract agreement under which it is mentioned that any time during running of
contract period, tenderer can cancel whole tender, if found transportation of vehicles is
reduced below then 60% of the total vehicles transportation due to opening of Bypass
road.
The MPRDC vide letter No.3721/DM-JBP/MPRDC/NH-12A (Pacage-1,2
&3)/2017 dated 12-02-2018 intimated to this office that New Bypass road is opened
w.e.f. October2017 for public uses. In view of this intimation it was found needful to fix
Base price for VET Tender for subsequent years therefore the the Board is decided to
calculate total no. transported vehicles from each naka along with recovery of the tax
amount.
In Compliance of CBR under reference, office staff has been deputed in each
Vehicle Entry Naka vide office order No.12 dated 16-05-2018 for preparing record of per
day vehicle transportation in each naka for the period from 18-05-18 to 16-06-2018. The
deputed staff has properly maintained day to day vehicle transportation and make
prescribed entry in record registers along with recovery amount and after expiry of
observation period submitted record register in revenue department. Recovery

As per above mentioned record entries total no. of vehicles transported during
observation period 13,306 Vehicles and total amount recovered during observation
period is 7,08,750/- for a month and approx @ 20% exceed the total baseprice for
one year is Rs.1,02,06,000/-
As per calculations above the total Rs. 1,02,06,000/- Per Annum should be
Base price for One Year tendering process.

Resolution No. 10
Considered. It was resolved that fresh tender be floated after fixing base price of
Rs 1,02,00,000/- for collection of Vehicle Entry Tax.
11. Allotment of Cantonment Gumti at Street No.1 and Pasi Mohalla.
CBR No. 7 (Sr.No. 94) dated 29-09-2016
By resolution under reference the Board approved construction /
Installation of 64 Iron Gumtis at vegetable market , Street No.1 Sadar out of which
42 nos of gumtis has been retained for allotment of vegetables markets vendors
who have been previously allotted open space at vegetable markets and remaining
22 nos of gumtis are marked for fresh allotment by auction process as per 267 of
the Cantonment Act 2006. Like wise Total 09 Nos of Gumtis is also constructed
by the Board at Pasi Mohalla. All 09 Nos of Gumtis are also marked for fresh
allotment by auction process.
The Board has published auction notice on 13-06-2018 in daily newspaper
“Dainik Bhaskar, Patrika, Nai Duniya, Hitwada for allotment of 22 nos of gumtis
at Street No.1 Sadar and 09 nos of gumtis at Pasi mohalla. Total 136 Aplications
(130 Bid Applications for St.No.1 Sadar + 06 Bid Applications for Pasi mohalla)
were received against auction notice out of which only 129 applications are
found correct for getting allotment at St.No.1 Sadar Cantt and 05 applications are
found correct for getting allotment at Pasi mohalla as per auction notice. Out of
129 only 05 applications are received under Physical Handicapped Reservations
Criteria and total 03 applications are received under Ex- Serviceman reservation
criteria as per terms of the auction notice. The details of 134 applicants name &
their rates are given below in decreasing order:-

the valuable defence land of Sy.No.05, Behind the B.No.02, Hawabagh

Ref:-the DEO office letter No.Jb/13/Vol-5, Dated 13/04/2018.
To consider and approve an estimate of Rs. 1.50 Lakhs towards the providing of
chain link fencing with the help of RCC pillars to Safe Guard the valuable defence land
of Sy.No.05, behind the B.No.02, Hawabagh Jabalpur Cantt.
The above work shall be entrusted to TC for Garden/Park fencing work contractor
at the existing approved rates. The Work shall be done under maintenance head D-2(f),
for which budget provision exists.
Relevant documents alongwith report/estimate of Engineering Section is placed on
the table.

To consider the Boundary Wall plan and application u/s 235 of Cantonments Act,
2006 submitted by Revd. Pradeep P. Ahaley, Executive Secretary, Council of
Education & Christian Nature, Methodist Church in India, of Part of Sy. No. 323,
Church & Bungalow No.3, Wesley Road, for the Proposed construction of
the Sourthern and Western side Boundary Wall in the Part of Sy. No. 323, Church &
Bungalow No.3, Wesley Road Jabalpur Cantt.
The land in question is situated outside the notified civil area comprising Part of
Part of Sy. No. 323, Church & Bungalow No.3, Wesley Road Jabalpur Cantt.
The plan was referred to DEO Jabalpur Circle, Jabalpur for obtaining ‘NOC’ from
land point of view as required u/s 238 (3) of Cantonment Act, 2006, for the proposed
construction. The same has been returned by the DEO to this office vide letter
No.JM2/Temp/23, dated-13/07/2018, with the remark that the building application for
reconstruction of compound wall submitted by Executive Secretary Council of Education
& Christian Nurture, Methodist Church in India, under reference is return herewith
alongwith enclosures. This office has no objection from land point of view to the
reconstruction of compound wall on GLR Sy.No.323, with the condition that no
adjoining defence land shall be encroached upon and the height of compound wall does
not exceed two and a half meter as per building plan submitted.”
Proposed construction of Boundary wall admeasures as under:-

Jabalpur/ Cant. / R.K./III dated 24-1-2018.
To consider the joint survey report of the Defense Estate Officer, Jabalpur Circle,
Jabalpur, Local Administration Authority/ Tehsildar, Nazul Ranjhi and Local Military
Authority (LMA) of Jabalpur Cantt.
The Karondi village comes under the limit of notified Cantonment vide Defense
Department, New Delhi letter No. 10/6/G/C&L/43 dated 03rd
July,1944. In exercise of
the power conferred by Sub-section(3) of Section 4 of the Cantonment Act,1924 (II of
1924). The Central Government have declared its intention as required by sub-section (1)
of the said section has pleased to include within the limit of the Jabalpur Cantonment.
The Convening Order of LMA, Station Cell, HQ MB Area letter No. 900/27/Land/
COD/ Q1/166 dated 12-08-2017, to conven Board of Officers for survey and demark
10 acres of land at Karondi for settling the displaced civilians and their families. The
Tehsildar Nazul, Ranjhi, Jabalpur office letter No.149/jh-rg-jkWa>h@2018 dated 06-04-
2018 report of survey and demarcation of Kh.No.40/2, including with site map alongwith
panchnama report have submitted with address to the DEO Jabalpur Circle, Jabalpur.
The DEO has forwarded the same report alongwith all necessary documents vide their
office letter No. JUC/Tech/COD/Karondi/Vol.I/67 dated 23-4-2018, with further
necessary action for compliance of the direction issued by the Principal Director, DE,
Central Command, Lucknow vide reference letter quoted above. In the light of section
46 of sub section 1 of the Cantonment Act, 2006 read with rule 3 of the Cantonment Land
Administration Rules, 1937, the matter with relevant documents alongwith survey report

and map are placeing before the Board for forwarding the proposal before the Competent
Authority through the Defense Estates Officer, Jabalpur Circle, Jabalpur.

15. Utilization of funds provided by State Govt. for Civil works in 2018-2019
State Govt. is providing funds for civil works viz road, drain, aaganwadis etc.
under different heads. As Cantonment Board Jabalpur is having a financial constraint
due to non receipt of proper grant from Ministry of Defence. Therefore Board is
considering to utilize the State Govt. Funds for different public works / maintenance
works from respective heads. Board is requested to consider and approve the same.
All the records regarding expenditure shall be maintained accordingly.

17. Determination of expired leases under lease Schedule VI/VIII of CLAR 1925 /
1937
To consider and approve the cases for determination of expired leases including
violation of terms of lease as per policy vide Para c (a &b) of Govt. of India, Min of
Defence letter No.11013/2/2016 (Lands) dated 10-3-2016.
These are 9 cases of expired leases due to various violation of terms of lease viz
change of purpose, sub division of site without permission of sale/ purchase of lease,
under which neither seller nor purchaser have taken prior permission/ intimation to this
office as per lease condition. Further they have not requested/ applied to this office for
condonation of above breaches. All nine expired lessee have been asked several times
through letters reminders, advertisement in newspaper, public notices to apply for
condonation of breaches but no fruitful result have been achieved. Further all nine
expired leases carried out the encroachment/ unauthorized construction of adjoining land.
As such condonation of breach involving encroachment shall not be condoned by the
Committee in compliance of policy as per para c (a&b) of Govt. of India, Ministry of
Defence letter No. 11013/2/2016. Since the leases are time bound and monitored by the
PAC / higher authorities. In view of above the following expired leases recommended
for determination by the Board.

26. Development work of Overhead Tank at Cantonment Board Jabalpur.
To consider & approve an estimate of Rs. 47.96 Lakhs towards the development
work of Overhead Tank at Cantonment Board Jabalpur.
The classification of the above said work is divided into three parts i.e.
Development of Over head Water Tank, Development of Sump well and development of
electrification with capacity of 275KL and the rates are given below.
(i) Development of Over head water Tank : Rs. 45,17,000.00
(ii) Development of Sump Well : Rs. 1,49,000.00
(iii) Development of Electrification : Rs. 1,30,000.00
Accordingly, the estimate of the work and its drawing / design has been prepared
by Er. P.K.Soni Consultant Engineer.
The above work shall be done under D1(d) head for which budget provision
exists.
The relevant file , drawing and estimate are placed on the table.

Considered and approved. It was resolved that proposal shall be sent to the
competent authority for the same.
27. Development work of Khambtaal Talab at Cantonment Board, Jabalpur.
To consider & approve an estimate of Rs. 340 Lakhs towards the development
work of Khambtaal Talab at Cantonment Board Jabalpur.
The classification of the above said work is divided into seven parts i.e.
Development of Boundary wall, Development of retaining wall, development of Toe wall
pitching, development of Ghat, development of pathway 2.0m wide, development of park
and development of electrification and the rates of each are given below.
1. Development of Boundary wall : Rs. 3,47,800.00
2. Development of retaining wall : Rs. 1,77,12,000.00
3. Development of Toe wall pitching : Rs. 10,79,000.00
4. Development of Ghat : Rs. 2,60 000.00
5. Development of Pathway 2.0m wide : Rs. 8,51,40,000.00

Considered and the matter was not approved.
28. Noting of size of Gumtis at Street No.1
Ref : CBR No.27, Sr.No.41 dated 10-03-2017.
In above mentioned referred CBR it was resolved to construct 20 Nos Gumti at
St.No.1 in phase II of work admeasuring (8x10)m but at the time of site visit of Ex-PCB
Cantonment Board, Jabalpur. Shri S.U.Dashrath and Ward Members it was resolved that
the size of the Gumti shall be kept same as in Phase I of the work so that the construction
is at safe distance from boundary wall of supply depot i.e. 7’x8’. It is to be noted that due
to reduction in size the number of Gumtis that were constructed on site is 24 Nos and the
same is recorded in measurement book clarifies that no additional financial loss is
suffered by the board in constructing these gumtis. Therefore the reduced size has
resulted in construction of 4 Nos. Gumti in addition to 20, resulting in additional source
of revenue generation for the Board.
Therefore it is to be noted that the size approved vide above referred CBR i.e.
8mx10m is due to clerical error whereas the original size is of 7’x8’(feet).

Resolution No. 28
Considered in detail. Cantt Engineer, Cantt Board Jabalpur was called with
documents to explain the matter. After the detailed deliberation, Board came to the
conclusion that no financial irregularity is involved. It was also mentioned that there was
clerical mistake by the concerned staff which led to the state of confusion. Board has
accepted the number of additional gumtis made with the same amount. It was further
resolved to issue warning to the concerned staff to avoid similar errors in future.

32. Representation submitted by permanent staff/employee Shri B.S. Kewat
seeking promotion in clerical grade.
Shri B.S.Kewat has been initially appointed as Junior Clerk vide
appointment letter dated 30/01/1988 on permanent post of Junior Clerk. After
extending his probation period through office orders No. 95-A dated 09/02/1989, No.148
dated 26/08/1989, No. 226 dated 23/03/1990 (w.e.f. 01/03/1990, to 06/08/1990), duties of
Moharrir in Revenu Section was assigned to Shri B. S. Kewat vide letter No.
12/Est./1117 dated 30/12/1990 for short period, till availability of vacant post of Junior
Clerk in establishment. Thereafter Shri B.S. Kewat had been discharging duties of
Moharrir in Revenue Department till issuing office order No. 78 dated 01/01/2002 by
which Shri B.S. Kewat was transferred to M. N. Hospital for learning office work of
“Senior Clerk” before superannuation of Shri M. M. Kapoor who was working as Senior
Clerk in M.N. Hospital. After superannuation of Shri M. M. Kapoor on 28/02/2002 Shri
B. S. Kewat took charge of Senior Clerk of Hospital form Shri M. M. Kapoor.
There after Shri. B.S. Kewat has been working in various clerical post but he was
not promoted as per clerical grade under wrong presumption that Shri. B. S. Kewat is
appointed as Moharrir in establishment.
It is noteworthy that Shri B. S. Kewat has submitted a representation before Chief
Execiutive Officer on 06/03/2007 for seeking proper promotion as per clerical grade with
recommendation of the then RMO, M.N. Hospital but due to some oversight he could not
be promoted till today. Hence it is established that due to negligence and oversight, Shri.
B. S. Kewat could not get systematic promotion as per clerical grade (i.e. Junior Clerk-
Senior Clerk-HOD- O.S.) even after discharging duties of clerical grade almost in whole
service period.
At present after completing of 30 Years of services without any promotion, Shri
B.S. Kewat submitted representation with request to grant benefits of regular promotions
and financial benefits as per clerical grade.
Report of office superindent along with records is placed on the table.
Resolution No. 32
Considered in detail. It was resolved that the employee is entitled for financial
benefits as per clerical grade but he cannot accommodate at present in any promotional
grade because there is no vacant promotional post in establishement. It was further
resolved that financial benefits shall be calculated from the date of assigning duties of
Moharrir and shall be got approved by LAO and by legal opinion. CEO is authorized to
take final decision on grant of financial benefits, deemed suitable as per opinion.

33. Revision of pay scale for Staff Nurse, Compounder, A.N.M and Food
Inspector.
The State Govt., Finance department Vide Guzzet Notification No F 8-1 -2015/
Rule/four dt 07/06/2018 revised intial pay scale for post of Cook, Supdt. and Junior
Engineer as per recommendation of A.K Agrawal State Pay Commission.
Pay scale of identicle and equivalent post in Cantonment Board Jabalpur is need to be
implemented as per Govt. Orders.

34. Regarding connecting drain at Shri Krishna School Gorabazar to MES
Quarters drain, Jabalpur
In this regard in past Cantonment Board constructed RCC drain at
Shri Krishna School Gorabazar. This said drain was supposed to be connected to an
existing drain at MES Quarters adjoining the School. Due to unknown reasons the Local
Military Authority did not permitted the joining of these two drains. The Board is
requested to resolve this matter so that to avoid any health hazard that may cause due
incomplete drain at Shri Krishna School, Jabalpur.
The said work is around 35m in length and estimated cost is of Rs 1,00,000/-.

35. Points raised by Members
(i) Shri Amit Agrawal, Ward Member, Ward No. 8 has raised the point to
provide Sewing Machines to BPL card holders and widows of each ward, as the same
were provided earlier. Also he has suggested that each ward member has its own
cabin/small room in his ward from where he can interact with the public directly. All
ward members has also advised that President Cantonment Board Jabalpur should have
his office in Cantonment Board premises also.
(ii) Shri Ajay Padam, Ward Member, Ward No. 5 has raised the point of appointment
of Doctor and Nakedars.
Resolution No. 35
(i) CEO has informed the Board that earlier the sewing machines were
purchased from the welfare funds provided by the State Govt. but now the
funds were directly transferred to the beneficiary account and the Board has
not sufficient funds for the same. Board has asked the CEO to find the
possibility of the execution of the demands raised.
(ii) It was resolved that Col Ravroop Singh be appointed by the Board to look
into the matter of recruitment process of Doctors. Similarly Col Rajeev K
be appointed by the Board to look into the matter of recruitment process of
Nakedars. It was also resolved that both appointed members should submit
their report in 07working days and matter shall be placed in the next Board
Meeting.

(vii) To further refer the matter of TC for repair of drain/nallah to the
Tender Opening Committee, as two contractors have quoted lowest rates, even
after negotiation.

The committee considered the tenders and recommended following action to be taken for
the tenders.
(i) Approved with 49% above as proposed by M/s Vinod and associates after
reconsidering the rates.
(ii) Approved with 41.89% above. CE during the discussion mentioned that the
rates are reasonable.
(iii) It’s resolved to retender the same.
(iv) It’s resolved to retender the same.
(v) Approved with 62% above as proposed by M/s Nitin Builders after
reconsidering the rates and CE also repeated that the rates are reasonable.
(vi) Approved with Rs. 3099/- sq. mtr. as proposed by M/s ACP World after after
reconsidering the rates and CE also mentioned that the rates are reasonable..
(vii) The work is of urgent requirement keeping in the view of coming monsoon
season, the work is approved to both the L1 bidders. Works of Ward No.-
1,2,3,4 will be executed by M/s Shrivastava Construction and works of Ward
No.-5,6,7,8 will be executed by M/s Vivek Construction. It’s worth mentioning
that the tenders were called online which has no scope of manipulation.

Vide CBR cited under reference renewal of Agreement for Physiotherapy services in

24.07.2015. The term of agreement will expire on 22.07.2018.
Hence to consider and approve further extension/renewal of term of agreement between

The Cantonment Board Jabalpur first time invited tender from interested persons for
Installing Toy Train, Children Helicopter, Children Car, Jumping Bounce in Tagore Garden on
04-07-2016 for the period of One year after completion the tendering process the tender had been
approved by the Board vide CBR No. 05 dated 05.-12-2016 in favor of Shabnam Bano.
The Contractor Successfully run the contract for the One year and also deposited
complete contract amount without any dispute and complications. Thereafter on expiry of One
Year this office again published fresh Tender for further period of One year but no Bid received

It is submitted that equally lowest rate (38.23% above narrick rate) is quoted by tenderer
M/s Glow N Guard and M/s Maa Narmada Cleaning Solution for Zone A in this circumstances
total strength of ‘safaiwalas’ could be divided into two part (50-50) % and each of tenderer
might be awarded 50% of supply of safaiwala for zone A. Lowest rate quoted by tenders for
Zone B is 40% above narrick rate and for Zone C is 41.41% above narrick which are more than
lowest rate quoted by tenderer for Zone A hence lowest tenderer for Zone B & C should be asked
for supply of safaiwala at rate of 38.23% above narrick rate in compliance of equal pay for equal
work formula.

1. Note On Dental Services being provided in Cantt Motilal Nehru Hospital On
PPP Mode
It is submitted that for the last few years dental services are being provided in our
hospital on PPP mode as decided by the Board ie.75% of total revenue to the
concerned doctor and 25% to Board. Apart from this Board has to expense on
dental procedure of CBE patients and monthly remuneration to the doctor.
On the basis of above point, we are analizing the data (net present analysis) for the
last six months i.e. from Nov 2017 to April, 2018.

Observation
- Data reveals that in the last six months 877 pt’s got dental services ( 2 hours
per day), from which total revenue was Rs.2,09,632/-.
- Rs.1,57,257/- of total revenue (75%) paid to the concerned doctor . (Loss of
Board )
- Only Rs.52,375/- on total revenue (25%) Board was getting.
- In the analysis we found Board expended total Rs.2,98,188/- on different
heads.
Recommendations:
a) Board has to install a dental set up of its own. If it is considered the total
revenue derived will go into the account of Board excluding salary to the
Consultant.
b) Board can save the money being spent on CBE patients.
c) Morning and evening OPD for dental services can be started to facilitate
public @Rs.750/- per 2 hours per shift plus 25% share of the procedural
charges to the Dental Surgeon for general public. No extra charges shall be
payable in respect of Board employees and their dependents as the dental
unit shall belong to the Board. The approximate amount of dental unit
including dental chair with X-ray unit shall be Rs.2.00 to 2.50 lakhs.

Resolution No.1
Considered the notes/observations stated in the agenda side. It was
recommended that the Board may consider installation of a dental set up of its
own. Further recommended that morning and evening OPD for dental services be
started @750/- per 2 hours per shift plus 25% share of the procedural charges to

respect of employees of Board and their dependants and retired employees.
Further recommended that advertisement be got published in local news
papers inviting application for engagement of Dental Surgeon.
2. Extension of engagement of Hon. Consultants

To consider further engagement on contractual basis for a period of 11 months of
OPD Consultants, Counselors, Radiologist with effect from 07.08.2018 to
06.07.2019. RMO may be authorized to utilize the services of qualified specialist
doctors from outside for OT services.

Considered and recommended that period of engagement of Consultants
from S.No.1 to 13 be extended for 11 months with effect from 07.08.2018 to
06.07.2019 at the already approved rate of Rs.1250/- per visit for two hours..
Regarding S.No.14 it was recommended that substitute of Dr. Nishint
Gupta be found, as members have informed the Committee that behavior of the
said doctor is not good. It was also recommended that one more Orthopedic
Surgeon be engaged for two hours per day thrice a week at the already approved
rate of Rs.1250/-per visit for 2 hours.
For S.No.15, the present Dentist Dr.(Mrs)Vidushi R.Singh be allowed to
continue her services at the already approved rate of Rs.1250/- per visit for two
hours. Till such time the Board installs its Dental set up and selects Dentists after
advertising in news papers.
3. Revision of pay scale for Staff Nurse, Compounder, A.N.M and Food
Inspector.
The State Govt., Finance department Vide Guzzet Notification No F 8-1 -2015/
Rule/four dt 07/06/2018 revised intial pay scale for post of STAFF NURSE,
COMPOUNDER, A.N.M AND FOOD INSPECTOR as per recommendation of A.K
Agrawal State Pay Commission.
Pay scale of identical and equivalent post in Cantonment Board Jabalpur needs to be
implemented as per Govt. Orders.

4. Repairs/Reconstruction of Existing Cantt Boundary Pillars (CBP) Phase-II
Jabalpur Cantt
Ref:-the Station Cell, HQ MB Area convening order no.900/27/Lands/Svy/Q1/134 dated
05/04/2016 & letter No.9000/27/Joint/Svy/Q1/56 dated 17/11/2017.
To consider and approve an estimate of Rs. 6.33 Lakhs towards the repair and
reconstruction of existing cantt boundary pillars of the Jabalpur Cantt. As per reference letter
including convening BOO order to ascertain the condition of Cantt Boundary pillars inside and
outside of the Cantonment Jabalpur. The Board Proceedings have been received and
recommended that the Cantt Board Jabalpur to take action as under:-
a) Cantt Boundary pillars mentioned at para 3 in BPs required immediate
repair/replastering.
b) All missing and uprooted pillars to be construct with new pillars immediately in the
places mentioned at paras 4&5 of BPs.
c) All Cant Boundary pillars require white snowcem prior to respective plastering to
withstand for longer duration and to be freshly renumbered with black paint or
notified colour.
The existing Cantt Boundary Pillars have been completely damaged, broken condition as
per BPs. There has been no repairs done ever for, past two decade. The above work shall be
entrusted to TC for Garden/Park fencing work contractor M/s CS Rajshekhar Mudliar at the
existing approved rates CBR No.06, (Srl.No.03) Dated 06/08/2016.
Work shall be done under maintenance head D-2(f), for which budget provision exists.

13. Implementation of benefits to MP Pay Revision of pensioners who have
retired before 01.01.2016
The State Government of MP vide letter no. F/9/2/2018/Niyam/ Char dated 11th
June 208 have revised the pension of pensioners who have retired before 01.01.2016.
Therefore the Board may also consider revision of pension of pensioners of Cantt Board,
Jabalpur since according to Clause 18 of Memorandum of Settlement, the employees of
Cantt Board are entitled for benefit incorporated in the MP Pay Revision of pensioners.
Simultaneously, the Board may also consider to recommend to obtain sanction as per
clause 14 of the Memorandum of Settlement. The additional financial implications would
be reflected in the Budget Estimates.

14. Release of payment to BSNL for lease line upgradation
DGDE vide letter No.83/62/MPLS-VPN/DGDE/Coord-Vol IV dated 13 June
2018 has conveyed the upgradation project of lease line from 02 mbps to 08 mbps OFC
line and send a demand note of BSNL HQ and instructed the field office (Cantonment
Board, Jabalpur) to pay Rs. 297532.00( TWO LAKH NINETY SEVEN THOUSAND

1. Points of Cantonment Model Higher Secondary School
(i) Requirement of Books for Hindi Medium School from classes 1st to 8
th and
English Medium School from Nursery to 8th

Considered and recommended to approve the following:-
(i) It was recommended that a proposal for creation of regular post of
Principal be forwarded to the competent authority, after getting it
approved from the Board.
(ii) 01 peon and 01 clerk, as per required be provided to the school.
(iii), (iv) & (v) It was recommended that for providing pavor block in the
school premises, repairing and white wash of school boundary, installation
of lights in school and installation of submersible pump in the borewell,
Cantt Engineer shall prepare estimates for the same works after inspection,
get it approved by the CEO and put up in the next Board Meeting for
approval.
3. Points of CANTT RIDGE BAZAR PRIMARY SCHOOL SEETA PAHAD
CMM JABLPUR
(i) Requirement of new Swings and kindergarten toys (soft toys) for mental and
physical development of small children.
(ii) Requirement of extra rooms to accommodate the classes, one Principal Room
and 01 Office Room.
(iii) Requirement of 04 teachers, 01 regular peon and 01 gardener
(iv) Repairing of entrance gate.
(v) Requirement of wall paintings (cartoons, rhymes and colourful things for
visual teaching).
(vi) Requirement of western toilet and ramp for registration / affiliation of school.
(vii) Creation of post of regular Principal in the school.

(iii) 02 english medium teachers (contractual), 01 peon and 01 gardender, as per
required be provided to the school.
(iv), (v) & (vi) It was recommended that for repairing of entrance gate, wall paintings
of cartoons, rhymes and colourful things for visual teaching, construction of western
toilet and ramp, Cantt Engineer shall prepare estimates for the same works after
inspection, get it approved by the CEO and put up in the next Board Meeting for
approval.

4. Points of Cantt Board Poorv Madhyamik Shalla, Gora Bazar
(i) Creation/requirement of Posts of 01 Principal, 06 subject teachers (qualified) for
recognition of school.
(ii) Requirement of CCTV cameras
(iii) Requirement of One Incharge, One Chowkidar, One Peon and One Safaiwala for
running the school in two shifts.
(iv) Requirement of 01 English Teacher, 01 Science Teacher and 03 English Medium
teachers.
(v) Construction of stage and sports ground.
(vi) Repairing of school walls.

Considered and recommended to approve the following:-
(i) It was recommended that a proposal for creation of regular post of Principal
and 06 UDTs be forwarded to the competent authority, after getting it
approved from the Board.
(ii) For requirement of more CCTV cameras in schools, it was recommended that
Asstt Programmer shall submit its report and approx estimates for installation
of CCTV cameras, get it approved by the CEO and put up in the next Board
Meeting for approval.
(iii) One Incharge, One Chowkidar, One Peon and One Safaiwala be provided to
the school for running it in two shifts.

(iv) 01 English Teacher, 01 Science Teacher and 03 English Medium Teachers be
provided to the school.
(v) The matter of construction of stage and sports ground be pend.
(vi) For repairing of school walls, Cantt Engineer shall prepare estimate for the
same after inspection, get it approved by the CEO and put up in the next Board
Meeting for approval.
5. Points of Naveen Cantt Kanya Madhyamik Shalla
(i) Creation/requirement of Posts of 01 Principal, 06 subject teachers (qualified) for
recognition of school.
(ii) Requirement of one Hall, 02 Labs (Physics and Chemistry), one Computer Lab,
one Library and new class rooms.
(iii) Repairing / renovation of school building and furniture.
(iv) Requirement of more CCTV cameras and LED screen.
(v) Fencing at first floor for safeguarding of students.

Considered and recommended to approve the following:-
(i) It was recommended that a proposal for creation of regular post of Principal
and 06 UDTs be forwarded to the competent authority, after getting it
approved from the Board.
(ii) It was recommended that possibilities for construction of new rooms be
checked and matter shall be placed in next Board meeting.
(iii) For repairing of school building and furniture, Cantt Engineer shall prepare
estimate for the same after inspection, get it approved by the CEO and put up
in the next Board Meeting for approval.
(iv) For requirement of more CCTV cameras in schools, it was recommended that

6. Proceedings of School Management Committees of Cantonment Board
Schools

To consider and note minutes of School Management Committees of
various schools run by Cantonment Board Jabalpur, in which various issues have
been discussed and recommended for proper and better functioning and services of
the Cantonment Board Schools.
(i) Cantonment Model Higher Secondary School, Katanga held on 14-03-
2018, 25-04-2018
(ii) Dr Sarvapalli Radhakrishnan Cantt High School, Gora Bazar held on 06-
03-2018, 13-04-2018, 21-05-2018 and 09-06-2018.
(iii) Naveen Cantt Kanya Madhyamik Shalla, Sadar, held on 16-03-2018 and
02-04-2018
(iv) Tagore Cantonment Public School, Karondi held on March and April 2018.

Considered. It was noticed by the Committee that the proceedings of School
Management Committees of above four schools have contained all the points
which were mentioned in the above agenda points of respective schools.
Committee noted the proceedings of School Management Committees.
In case of Cantonment Model Higher Secondary School, Katange the Committee
recommended that the Headmistress of the School is authorized to take up the
matter of change of name of the school.
It was further recommended that the legal opinion be obtained regarding case of
Smt. Anjali Shivhare for availing two annual increments who has done B.ed
before 1996, as per rule.
