Anyone who violates this policy may be subject to a civil citation and subsequent fine. The board further recognizes that smoking poses a significant health risk to smokers and nonsmokers alike. Therefore, smoking and/or the use of tobacco products or electronic cigarettes in any form is prohibited in all district buildings, on district property, and in all school district vehicles.

Any employee who violates this policy will be subject to disciplinary action, which may include but not be limited to a fine, suspension, or dismissal, in accordance with the law.

5115(a) STUDENTS Welfare Bullying

Purpose

The board strives to provide a safe, positive learning climate for students in the schools. The North Penn School District recognizes that bullying of students has a negative effect on the educational environment of its schools. Students who are bullied, intimidated or fearful of other students may not be able to take full advantage of the educational opportunities offered by the school district. Bullying can also escalate into more serious violence. Therefore, the school district strives to offer all students an educational environment free from bullying. Definition

[Bullying shall mean a student being exposed, repeatedly and over time, to intentional injury or discomfort inflicted by one or more other students by means of verbal, written or physical conduct. Bullying implies an imbalance in power or strength.

Bullying (direct or indirect) manifests itself in any of the following three (3) forms: physical, verbal/written, and emotional.

Bullying includes, but is not limited to, the following examples:

1. Physical – hitting, kicking, spitting, pushing, stealing and/or damaging personal belongings, sexual acts, and invasion of one’s personal space in an aggressive manner.

2. Verbal/Written – taunting, malicious teasing, name-calling, making threats, phone and internet, and sexual remarks.

3. Emotional – spreading rumors, manipulating social relationships or environment, engaging in social exclusion, extortion, ridiculing, and intimidating.

The term bullying shall not be interpreted to infringe upon a student’s right to engage in legally protected speech or conduct.] Bullying shall mean an intentional electronic, written, verbal or physical act, or a series of acts, directed at another student or students, which occurs in a school setting and/or outside a school setting, that is severe, persistent or pervasive and has the effect, or is likely to have the effect, of (1) substantially interfering with a student’s education; (2) creating a threatening environment; or (3) substantially disrupting the orderly operation of the school.

Examples of bullying include, but are not limited to, physically, emotionally or mentally harming a student; damaging, extorting or taking a student’s personal property; placing a student in reasonable fear of physical, emotional or mental harm; placing a student in reasonable fear of damage to, or loss of, personal property; creating an intimidating or hostile environment that interferes with a student’s educational opportunities; or engaging in conduct that is intended to have the effect of, or has the

effect of, demeaning, dehumanizing, embarrassing, ridiculing, taunting, teasing, or threatening a student or group of students. Bullying, as defined in this policy, includes cyberbullying.

Cyberbullying means an intentional act, or series of acts, directed at another student or students, which occurs in a school setting and/or outside a school setting, is carried out through the utilization of computers, the Internet, interactive and digital technologies or electronic devices, is severe, persistent or pervasive and has the effect, or is likely to have the effect, of (1) substantially interfering with a student’s education; (2) creating a threatening environment; or (3) substantially disrupting the orderly operation of the school.

School setting means in the school, on school grounds, in school vehicles, at a designated bus stop, during the time students necessarily spend traveling to and from school or school-sponsored activities, and at any activity sponsored, supervised or sanctioned by the school.

Authority

[The school district will not tolerate any acts of bullying occurring on school district property, at school-sponsored activities scheduled on or off school grounds, or during the time students necessarily spend traveling to and from school or school-sponsored activities.] The school district will not tolerate any act, or acts, of bullying occurring in a school setting and/or outside a school setting that is/are severe, persistent or pervasive and has the effect, or is likely to have the effect, of (1) substantially interfering with a student’s education; (2) creating a threatening environment; or (3) substantially disrupting the orderly operation of the school.

Delegation of Responsibility

The superintendent or designee shall develop administrative procedures to increase the awareness of the problems of bullying, and train teachers to effectively intervene if bullying is witnessed in their presence or brought to their attention.

The superintendent or designee shall ensure (1) that this policy and the procedures for reporting bullying are reviewed with students at least once each school year, (2) that this policy is posted in a prominent location within each school building, (3) that this policy is posted on the district’s official website, (4) that this policy is available in every classroom (this may be achieved by ensuring that a classroom computer with access to the district’s website is available for student use), (5) that the code of student conduct, which shall contain this policy, is readily available to students and (6) that, in cooperation with other appropriate administrators, this policy is reviewed every three years and that necessary revisions are recommended to the board.

Intervention:

Teachers and other staff (including, but not limited to, secretaries, custodians, bus drivers, hall monitors, etc.) who observe acts of bullying shall take reasonable steps to intervene to stop such conduct, unless intervention would threaten a staff member’s safety. The nature of the intervention will vary depending upon the age of the student (both the victim and aggressor), the severity of the bullying and the student’s involvement in prior acts of bullying. The purpose of the intervention is to take prompt remedial steps to ensure observed acts of bullying cease and to teach students that bullying is not an acceptable behavior.

Guidelines

Student, Parent/Guardian and Employee Reporting:

The school district encourages all students and parents/guardians who become aware of any act of bullying to immediately report that conduct. Students may report acts of bullying to their teachers, building principal or other school employees supervising school-sponsored activities. Parents/guardians may contact the building principal to report acts of bullying.

If teachers and/or other staff cannot reasonably remediate acts of bullying through their own intervention, they should report the bullying to the building principal. Other school employees who observe acts of bullying shall report that conduct to the building principal.

Investigation Procedures:

Each building principal or designee is authorized to complete an impartial, thorough investigation of the bullying brought to their attention by students, parents/guardians or school employees. Any investigation of a report may include meetings with students, parents/guardians or employees; a review of student records; and other reasonable efforts to better understand the facts surrounding a reported incident.

Consequences/Discipline:

Consequences for students who are found to have bullied others may include counseling, a parent conference, detention, suspension, expulsion, a loss of school privileges and/or exclusion from school-sponsored activities. Depending upon the severity of a particular situation, the building principal may also take appropriate steps for student safety. Intervention will be in line with approved student code of conduct.

5131.2 STUDENTS Reference: Administrative Regulation #5144 Elementary and Secondary Use of [Beepers, Pagers, and Unauthorized] Personal Electronic Devices

The use of electronic devices by school district employees where supportive of the general welfare and the instructional program of the school is endorsed. This policy shall serve notice to all concerned that the use of beepers and pagers by students on school premises is prohibited unless said student is a member of a volunteer fire or ambulance company or the beeper is necessary due to the medical condition of an immediate family member and permission has been given by the school administration. [Further, the use of cellular phones, radios, personal stereos, CD/tape players, scanners, two-way radios, electronic games, laser devices, and video cameras by students on school premises during the instructional day is prohibited unless a request is received from the student’s parent or guardian and approved by the superintendent or his/her designee.] Further, the use of cellular phones, personal music players, laser devices, video or cell phone cameras, and other portable personal electronic devices on school premises during the school day is prohibited except as specified in Administrative Regulation 5131.2. If an extenuating circumstance exists, students may utilize such devices if the student's parent or guardian submits a written request to the superintendent and the request is approved. The board of education authorizes the superintendent to develop and enforce regulations to prohibit the use of wireless and electronic devices by students. Such regulations shall include:

1. Confiscation of devices whose use has not been approved by the principal.

2. Investigation of the incident by the principal who may return the device to the parent, suspend the student, refer the matter to the police department, or all of the above.

The superintendent may delegate responsibility for the enforcement and reporting the progress of this policy to appropriate school district officials. Each principal shall inform the students of this policy by general announcement and by inclusion in the school’s handbook.

Therefore, smoking, possession of tobacco products or electronic cigarettes, and/or the use of tobacco or electronic cigarettes in any form is prohibited by students in all district buildings, on district property, and in all school district vehicles. Any student who violates this policy will be subject to disciplinary action, as defined in the school district discipline code. Any student who violates this policy may also be subject to a civil fine.

BACKGROUND:

The following net change order was found necessary and is recommended for approval in the

NPHS Hot Water Heater Replacement Project.

Cook’s Service Company Inc. Change Order # P-1 $6,417.41

Change order #P-1 is a net change order due to the lack of shut off valves at this heater the contractor

needed to freeze the pipe to stop the flow of water for the installation of new shut off valves without having

to drain the entire domestic water system in the school, $4,479.36; There was a need to add a three-way

valve to the boiler heat exchanger for the new water storage tank to control the hot water supply to the

system, $ 1,938.05; for a total increase of $6,417.41.

The Administration has reviewed and recommended approval of this change order.

Approval to authorize Bonnett Associates, Inc. to continue the process of Subscribing to the

Green Building Initiative for certification of a Green Globes rating, as listed.

BACKGROUND:

In the USA, the Green Building Initiative (GBI ) owns the license to promote and further

develop Green Globes in the United States. GBI is an accredited standards developer under the American

National Standards Institute (ANSI). In Pennsylvania legislation recognizes Green Globes. More specifically,

the PA Department of Education recognizes a Green Globes rating as a mechanism for addition

reimbursement to School Districts in its PlanCon process for School Construction projects. A two, three or

four Green Globes Certification from the GBI’s Green Globes Building Performances Rating System could

get the North Penn School District additional reimbursement for the Inglewood Elementary School Additions

and renovations project.

The Board has already authorized Bonnett Associates, Inc. to determine qualification for a Green

Globes rating at a cost of $500.00. That determination revealed that we would qualify for at least two green

globes and possibly three. The cost of the process and certification is $14,000, with $500 already spent on the

determination of qualification. Being certified with two, three or four Green Globes would increase our

PlanCon reimbursement potential by $50,000.
