California Swimming Pool Safety Act

2019 California Building Code Section 3109

Swimming Pool defined: any structure intended for swimming or recreational bathing that contains water over 18 inches deep. Includes in-ground and aboveground structures includes but not limited to hot tubs, spas, portable saps, and nonportable wading pools.

Drowning PreventionSafety Features Required. State of California requires any new

pools to be equipped with two of these seven safety features:1) An enclosure with minimum height of 60 inches;

2) Removable mesh fencing;

3) An approved safety cover;

4) Exit alarms on the private residence doors accessing the pool;

5) A self-closing, self-latching device on the doors of the residence

accessing the pool;

6) A pool alarm, that will sound upon detection of accidental or

unauthorized entrance into the water;

7) Other means of protection equivalent to the above and as approved

by an approved testing laboratory.3

PLACER HISTORY• Placer County has mandatorily required an enclosure around

each swimming pool for more than 40 years.

• Staff recommends continuation of this practice as a reasonable

means of protection, meeting or exceeding the State’s

requirements through three enclosure options, plus one

additional feature—see next slide scenarios.
