We would recommend that you primarily ensure that PINS and the local planning authority are satisfied with this approach as they will have responsibility for accepting the applications etc. NRW would assess information accepted by these bodies for any future consultation. Hi Angela, I am emailing with regards to the Wrexham Energy Centre development. I have a query regarding the study area we have used to assess the Scheme. Ordinarily, a 500m zone is commonly used for the initial consideration of contaminated land impacts for sites such as the WEC where contamination is generally historic and therefore likely to be of limited lateral mobility. If the presence of mobile contaminants and pathways within the study area is confirmed, then the study area may be extended in order to identify any receptors that could be impacted by contamination further afield. Based on the contaminated land assessment undertaken and reported in our ES chapter, the extension of the study area beyond 500m outside of the Order Limits was not considered to be necessary. Could you please confirm that this approach is considered acceptable? Many thanks. We are currently compiling the Environmental Statement (ES) for this Scheme and I am writing with regards to the Ground Conditions chapter; there has been a change in the planning situation and I would also like to confirm that our methodology is suitable. confirmation on the methodology being used to assess the site from a land quality / contaminated land point of view please? The methodology and change in planning situation is outlined below. Methodology

The methodology generally is based on guidance in the Contaminated Land Report (CLR) 11 published by Defra and the EA in 2004 and the National House Building Council / Environment Agency report R&D66. We have undertaken a land contamination risk assessment and a land contamination impact assessment. Currently, we have not carried out any intrusive ground investigation prior to submission of the ES, and therefore there will remain limited information on site‐specific ground conditions and potential soil / groundwater contamination. Would you be able to confirm that you are aware of our approach, and would be happy to review the ES on this basis with the view to managing the requirement for intrusive investigation through the Planning (condition) process? Change in planning situation Previously it was expected that the entire scheme would be subject to a Development Consent Order (DCO), as a Nationally Significant Infrastructure Project. Whilst the Gas Connection forms part of the generating station, for the purposes of the Planning Act 2008 in Wales it does not constitute ‘associated development’. A separate application will therefore be submitted to the local planning authority to seek planning permission for the Gas Connection, under the Town and Country Planning Act 1990. However, powers of compulsory acquisition over the land required for the Gas Connection are being sought as part of the DCO application for the Scheme. Each ES topic chapter therefore considers and assesses both the Power Station Complex and the associated Gas Connection individually and then together as the 'WEC'. Previously it was expected that the entire scheme would proceed under DCO. Whilst this is no longer the case, the assessment itself does not change, as it had already been undertaken taking the PSC and Gas Connection separately and then together. The ES will accompany both the DCO application and the local planning application. Could you please confirm that our methodology above is still OK in light of the change in planning situation? I am a consultee to the Planning Team on land contamination issues and therefore cannot provide confirmation on what approach should be used but I am able to provide a recommendation. As you are aware my previous advice was that any potential land contamination issues on the land could be dealt with by way of a condition on the planning permission granted. On the understanding that the DCO can have conditions attached, as can a routine planning permission, then I still believe this approach would be acceptable and would recommend this to the Planning Officer (who I have copied into my response to you). Whilst the Plan is of quite poor quality, if you rotate it 90 degrees clockwise so north is at the top and gain your bearings by looking at Erlas Blackwood (in the north west) which is a feature that is largely unchanged today – it is possible to see from the field layout in the east your site and that it is undeveloped. We have a larger plan 1:2500 scale which I may be able to scan the relevant section of if you wish? I have however also found a response to a past enquiry (see attached copy of an email) and it appears that I checked on whether the site was part of the former ROF then – it wasn’t.
