Our purpose is to identify and monitor current and prospective Tasmanian

licence holders to ensure they meet licensing

eligibility requirements and where appropriate remain

in the licensing system.

We have a decision making framework that provides clarity for licence holders and where appropriate keeps people within the

licensing system.

We believe our clients deserve to be treated as

individuals and understand how and why a decision

was made.

We look for ways to improve how we assist and manage Tasmanian driver licence holders.

The person’s history specifically relating to driving history regarding road safety and behaviour. (File notes or

previous correspondence or evidence from other licensing jurisdictions e.g. NEVDIS records).

A Personal Statement which outlines the person’s needs and personal situation.

Any relevant MRS reports or search results, specifically related to driving history. - Results of the Returning

Driver Report (R100).

Nature - Are there circumstances that may have contributed to the action/behaviour of the driver eg age, type of vehicle?

Time/Place - How long ago did the action(s) occur? Is there patterns of behaviour in regard to place, time or surroundings?

Frequency - has the lose of licence occured more than once? Has there been a combination of questionable behaviours/actions?

Driver AttitudeIs the person suitable to hold a licence? Did the persons' actions indicate a lack of understanding or blatant disregard for road rules?Has the person demonstrated they have accepted responsibility for the actions that resulted in the licence being disqualified? If yes what efforts have they made to adjust the contributing factors?

In what ways may returning this licence pose a risk to road safety?Is there any evidence to indicate any road safety risk resulting from the person's driving could be mitigated by isuing a probationary licenec eg additional conditions or in the case of a novice driver additional conditions? Some examples being - speed limit restrictions, no peer passengers, night time curfews, zero BAC attendance at courses.

Should the person be required to demonstrate knowledge of the road rules or that they have the appropriate driving skills to hold a licence?

Type of licence - What is the risk of the person operating the class of vehicle they have previously held? Are there any enforcable restrictions or conditions which may be imposed to reduced the risk? Are they a novice driver?

• Are the records correct? (Gather information and establish facts)

• Is the driver a self-identified repeat offender?

• Do you need any clarification?

• Evaluate the evidence?

• Would additional evidence assist you to make a decision?

• Have you assessed all possible alternative options, having regard to the context of the case?

• Is there a way you can assist the person to drive safely and improve their attitude to driving?

• Have you identified any time restraints?

• Are your requests of the driver reasonable?

• Will the evidence when presented be viable and useful? Are you confident it will enable you to make an

evidence based decision in the future? (Noting that evidence presented in the future may change the context of the

case)

• Are you providing sufficient time and resources to the driver?

• Are you providing the driver all the information about what will be required?

• Do your feel your request is justified?

• Are you establishing an open and transparent relationship with the driver?

• Have you establish timeframes for follow up?

(pre decision making check)

• Are you willing to accept responsibility for your decision?

• Do you feel your decision is justified?

• Have you received all evidence requested or required?

• Has any behaviour or additional information been discovered?

• Do you need to request additional or different evidence?

• Do you need to request additional or different evidence?

• Are your decisions enforceable?

• Are you providing the driver sufficient time and resources?

• Have you established clear timelines and instructions?

• Do you have enough information to make a decision? • Is the information valid? (Check MRS) • Do you need any clarification? • What questions has your case assessment raised?

• Have you assessed all possible alternative options, having regard to the context of the case? • Have you considered pros and cons for each possible option? • Is there any way you can assist the person to drive safely? • Can you come up with a viable solution? If not do you need to gather more facts?

• Will your decision have a positive impact on Road Safety? • Is the decision based on evidence? • Would the decision stand up to review? • Is the outcome within your delegation?

If you are comfortable with your decision, take action. If not retrace your steps to discover a better solution.

• Are you willing to accept responsibility for your decision?

• Do you feel your decision is justified?

If you are comfortable with your decision, start to document your findings using the most appropriate

method eg Statement of Reasons. And where appropriate obtain manager’s approval.

• Are you responding within an appropriate timeframe?

• Have you explained how the decision was reached?

• What are you delivery options?

• All evidence (documentation and verbal discussions) used to reach the decision is recorded and retained and

can be easily understood and retrieved.

• Ensure information on the clients rights in regard to reviewing the decision

and being able to reapply with or without additional evidence is included,.

• Details of Evidence presented and how it was weighted should be included.
