Concern Info Voicemail left on the MoDNR concern line in Jefferson City regarding Hillside State Apartments in Smithville, MO. She explained that part of anapartment building near her residence burned down August 2015. For approximately the past two months, a crew of people have been demolishing the building. She is concerned that there is mold, they do not have the proper netting and other safety equipment installed, there is dust and particles everywhere, their license plates on all their equipment is expired and she is unsure they have taken proper precautions for permitting or other testing that is required for demolition work.

I arrived at Mr. Hill's property on July 27, 2016, around 10:30 a.m. and noticed two burn piles that were still smoldering. Mr. Hill runs a tree trimming operation, and it appeared that the burn piles were mostly vegetative waste. Mr. Hill has had previous NOVs for disposing of commercial waste by open burning.

I then went over to Mr. Vest's property and talked with him about the situation. He told me that every day, Mr. Hill brings a load of vegetative waste to his property and stacks the waste in piles to be burned. He lit these piles when the Vests were out of town, and when they came back the piles were still smoldering and there was ash all over their property. I took pictures of two cars and a grill that had ash on them. Also, the roof has had a buildup of ash from the constant burning at Mr. Hill's residence.

I talked with Mr. Hill on the phone on the same day while I was at his property. Mr. Hill admitted to burning the piles. At one point he told me it was all generated on his property and wasn’t from his tree trimming business. At another point he blamed the department for the burning because he was stacking piles of vegetative wood waste from his tree trimming operation and we wouldn’t give him an open burning permit. The piles got too big and he said he had to burn them. He is very emphatic that he will go out of business if he has to pay to dispose of the vegetative waste and that burning is the only way he can run his business.

Concern Info Concerned party states that when he returned home from vacation, the large pile of brush on Mr. Hill's property from his business has been burned.He also explained that there was ash everywhere on his property. He also states that materials other than vegetative waste have been burned, including a mattress and box springs, trash can, plastics, and railroad ties. Mr. Hill puts the railroad ties on the bottom, then covers them with vegetation. Mr. Hill also does a lot of his burning at night.

Mr. Hill has had several concerns about burning brush from his business in the past.

Concern Info Every Sunday at 2:00 PM, for approximately 20 minutes, exhaust is emitted from an 8 inch diameter pipe. This pipe is 6 feet high off the ground andpoints out parallel with the ground. The pipe is located on the US Bank building in the alley. The exhaust causes several symptoms to those within 2 blocks of it. These symptoms include nausea, watery eyes, headache, and difficulty breathing.

Mr. Toloso states that Living Colors is “blasting” (sand or other media) metal parts in the open behind their building. Mr. Toloso is concerned because his properly is adjacent to Living Colors. I asked Mr. Toloso when the blasting activity typically occurs and he stated it is typically conducted before noon.

Comments Demolition/renovation waste consisting of vinyl flooring, dimensional lumber, fiberglass, siding, a ceiling fan, and other waste was disposed by open burning. Also, open burning wasused as a means to salvage copper wiring. A letter of warning will be issued to Ms. Kratzer and her son, Mike.

On August 16, 2016, I responded to the above concern. Upon arrival, I went to the concerned party's address to respond to his most recent call, which was on Monday, August 15, 2016. I spoke with the concerned party about the property owner next door. He said he had found out the owner's name and number and also the same of her son that was living on the property as well. He told me about the burning incident as well as a pile of brush and debris at the back of the property. He offered to take me into his field so I could look at the pile, but I thought the son would see me and not answer his door. Therefore, I declined and went to the property where the burning was taking place.

Upon arrival to the responsible party, I went to the door and knocked several times, but there was no answer. I left the open burning regulation and other fact sheets along with my card.

When I returned to the office, I received information on the property owner. I called the owner and told her about the concern and that I went out to the property to talk to her son, but didn't get an answer. I asked her if she was aware that what had happened was against Missouri state regulations. She was not aware of the regulation. I asked if I could meet her at the property to go and investigate the burning and the pile of debris. She agreed to meet me at the property.

On August 19, 2016, I returned to the property and met Ms. Kratzer and her son, Mike. I saw the pile that contained vinyl flooring, dimensional lumber, fiberglass, siding, a ceiling fan, and other demolition waste. Ms. Kratzer told me that her house had termites and that she was fixing the inside where the infestation was. I told her that the demolition waste from her house in the brush pile had to be completely removed before the pile could be burned. She told me that she would be getting a roll off dumpster and the pile would be removed. I then went to the site where burning of the copper wire took place. It was in a small water trough, and the ash was approximately 1/4 inch in the trough. Her son told me that it was a one time deal and would not be doing that again.

I explained that I left the burn regulation and other fact sheets on Tuesday at his door. He said that he was in the back of the house and didn't hear me knocking and that he did get the sheets I left. I told them that I needed a receipt from the dumpster and photos showing that the pile was cleaned up. They said that they would.

Concern Info The caller states that his neighbor to the north is bringing stuff in and burning it. It produces a thick black smoke and a noxious smell. He burnedaround 10am on July 15, last Friday (July 29) in the morning and this morning. He has observed his neighbor hauling stuff in trailers and trucks (possibly shingles and/or plastic caller did not know for certain) but the burning seems to occur when an old El Camino shows up. This morning it was like a fog from the smoke.

Last week they spoke with the fire department. They visited the property last Friday but the fire was out and (according to the caller) they did not go on the property where the burning occurred. They have also spoken to the sheriff.

I investigated the site on 8/18/2016. When I drove to the site, no one appeared to be on the property. There was a locked gate, so I left my card on the lock. From the road, you could see where the house had been, but there was no debris around the area. The next day, I received a call from Mrs. Downing. She said she had been out of town during the fire, but said her husband called her and told her the old farm house had burnt down. When I asked her whether he had burnt it or if it had been accidental and she was not able to answer the question. She repeated she had been out of town. I informed Ms. Downing that they were not allowed to burn anything, but vegetative and household waste. I asked her what they did with the remains of the house. They said they removed metal items and scrapped them, but said there was absolutely nothing left of the house. I informed her that the concern stated she had buried the waste and she said that they would not do that. She said they worked very heard to clean out the creek on the property when they purchased it and would not to anything to mess it up again. I asked Mrs. Downing if her husband could call me and she said he would. I have not received a call from Mr. Downing.

Concern Info CP Called and reported that Doyle Collins at 320 Front St. in Pleasant Hill is hauling in regulated waste, such as R.R. ties, couches and other trashand piling it up on an empty lot and setting it on fire at night. He burns the pile about every other week. Once the waste is burned he brings more in and repeats the process. The property sits on a flood plain and it does flood. The CP said that the fire dept. has been out there to put out the fires on the past, and the police dept. has been contacted as well, but they told the CP that nothing can be done until he's actually caught lighting the fires. CP also said that the Katy Trial runs close by the property and he rides his quad runner through there and through farmers property and tears up the trail and farm fields.

Concern Info Several years ago CP grandmother lived in a senior housing unit at Butler Rural Estates and it had a smell to it. CP figured it was nothing ofconcern. CP's family member moved in about 2 months ago and there is a bad smell in the apartment. The sewer and creek run behind the apartment. Cp's family member has been very sick lately. CP will get light headed when they visit. The apartment complex was built in 1976 and CP knows that some of the cabinets are original so wonders if that could be a possibility as well. Some apartments are uphill and some are downhill by the sewer and the housing unit said they will allow sister to move uphill. CP had recently looked at another apartment there that had mold and the maintenance worker painted over it. Housing said they will not do anything about it until the family a resident is hospitalized. Several people that live there have said they have had health problems since moving there as well. CP has gone to the city and county, but they did not investigate. CP's family member is still in the old apartment as she packs and has not decided if she will move uphill or move out. The family member has been staying with the mother because the smell is so bad.

The waste may be coming from houses being demolished by Alan T. Lynn. A dump truck is being used to haul the waste to the property. The waste was being dumped into a pond next to the road, which has since been filled with water from the rain.

There was no violation of the asbestos rules. However, it was determined that Mr. Power conducted open burning of demolition waste in violation of the open burning rule. Issue a Letter of Warning to Mr. Power for conducting burning of regulated materials. Provide recommendations on asbestos requirements for commercial buildings. Concern Info We were contacted for assistance by Chief Ross Dutton with the Macon Fire Department. A property owner was tearing down a house trailer andsalvaging the metal and lumber. He had burned some demolition waste and was told not to burn again. He put some concrete blocks up in a ring and then burned more demolition waste. Now he has piled the concrete blocks up in a ring again and it appears that he is preparing to burn again. The owner is involved with Meth and investigator should only go to the site accompanied by law enforcement.

Concern Info Caller sent email to Scott Adams, P.E., Environmental Engineering Unit" While I was at the WP ro/co, I had messages left on my phone. Ronald Putnam, village chair for Harris, MO.660-654-0823 cell , 660-794-2965 home , [email protected] called him back. He said that there was a neighbor that had stockpiled various kitchen trash, including aerosol cans, then lit them on fire a weekago. He said that the pile was about the size of a car, with loud popping explosions from the aerosol cans. He said the debris and smoke wereblowing into his yard and around the village. The occupant of the home was Josh Smith, on the north side of Main St., northeast of its intersectionwith 3rd St. It is the lot with several junk cars with the guy living in the old grocery store.Mr. Putnam also said there was a woman on the north side of Harris (Darlene Rigger?, on the north side of College St. between 3rd and 139) whowas stockpiling lots of household trash. He said she was not burning it. Further, Mr. Putnam said that they have several abandoned properties thatwere not being maintained."

PMM - I spoke with Mr. Putnam by phone 8/12/2016 - In addition to the above comments Mr. Putnam said Mr. Smith is disabled and that Mr. Smith's burning is a nuisance. Please note that Mr. Putnam reports stockpiling and trash in his comment above.

There was also a large amount of dust in the air around the site.

Comments On July 22, 2016, Jan Chronister and I visited the construction site at Three River Community College. At the time of our investigation there was no heavy equipment or personnel onsite. There were no visible emissions. While at the site we spoke with a Poplar Bluff Police Department Officer who routinely patrols the college campus. He stated that he has not observed any dust issues during the construction work.I contacted Mr. Jeff Alford of R. L. Persons Construction who informed me that all the heavy equipment has been gone for at least 2 weeks, but they did move some dirt out of the basement area last week. Mr. Alford stated that he was not aware of any dust issues and assured me that they have been using a water truck at the site. Truck watering is an acceptable method of dust control.

Concern Info (SP #9214)Caller is concerned about the dust being generated from the construction site and leaving the property. The caller wants to know if reasonable and appropriate action is being taken to control or keep down the dust. The caller reports that he is having to change his air conditioning filter more often than usual and that it is dirtier than usual. The caller states that his air conditioning unit outside is dirtier than usual and is going to have to be cleaned and serviced as well. The caller is concerned that his family's health is being affected. Mr. Lemons is leaving his telephone number, so that he can be called back with the investigation results ASAP. He also requests a copy of the report. Mr. Lemons stated that he is prepared to call Channel 12 if necessary.

Comments I investigated this concern on 8/17/16 and met with Mr. Tim Smith, the owner of Washington County Recycling. He informed me that they had been burning recently to clean up a pileof skids and cardboard boxes. He stated that everyone burns around the area and he had decided to burn a pile of misc. to dispose of some waste. I told Mr. Smith that cardboard can be recycled and that the open burning of trade waste is illegal in Missouri for business owners. I emailed Mr. Smith PUB02047, "Facts on Open Burning under Missouri Regulations."

No further investigation required on this concern at this time.

Comments No violations. I contacted Rapid Roberts and got ahold of Mr. Rob Wilson. He stated that demolition had not yet started on the building, and that the company has contracted withEnvironmental Works to conduct the asbestos testing. I conducted a site visit of the area with permission form Mr. Wilson. The buildings had evidence of being emptied out in preparation of demolition, such as the removal of furniture, and door being taken off hinges. The structures had yet to be demolished, and remained standing. Mr. Wilson stated that tests were scheduled for August 24th, and the company would proceed from there.

Comments No violations found. There was odor present in Noel and around the city limits. There was a large area of land application northeast of Noel, on Elk Springs Road on the north side ofTrestle Park Bridge. This was being conducted by Nebo Solutions, and they were spreading waste from Simmons Foods in Southwest City, Missouri. The odor was very strong, but they were meeting all their setback distance from the property line, and well over the minimum 300 feet from the river.

The odor around Tyson's was not strong enough for a detection at 7:1 with the Nasal Ranger, yet was very strong to my nose without the device. Because the air was heavy and still, it was hard to determine if the odor around the plant was coming from Tyson's or the Noel waste water plant or a combination of the two, since they sit next to each other.

Concern Info Caller lives about a mile from the Tyson plant and says that it smells very strongly of ammonia. Trucks are constantly going in and out of the plant.Caller said her daughter lives 10 miles out of town and they can smell it at their house.

Caller said that the same thing happened last Friday, but it's considerably worse today. She can barely breathe and was coughing on the phone. She said she can even taste it in her mouth because the odor is so bad. She said it's not a chicken plant litter smell, but more of a chemical smell.

She said she tried calling Tyson earlier and they hung up on her.
