Requested Action: Approve and authorize the Chairman to execute Amendment 001 to Community Care for the Elderly (CCE) Grant Agreement IC019-9400 which contains a $7,503.00 increase in overall funding as well as changes to multiple sections of the original agreement.

a. 9:00 AM PUBLIC HEARING - AN ORDINANCE OF THE BOARD OF COUNTY COMMISSIONERS OF OKEECHOBEE COUNTY, FLORIDA, REVISING THE PERMITTED HOURS OF SALE OF ALCOHOLIC BEVERAGES, AND PROVIDING FOR FINDINGS, SEVERABILITY, CONFLICTS, CODIFICATION, AND AN EFFECTIVE DATE. County Attorney Wade Vose addressed the Board and stated on January 8, 2020, by adoption of Ordinance 2020-0001, the Board of County Commissioners amended Section 6-47 of the Okeechobee County Code of Ordinances to change the permitted start time for the sale of alcohol for on-premises consumption at restaurants on Sundays from 1 p.m. to 10 a.m., while leaving the permitted start time for the sale of alcohol, both for off-premises consumption and for on-premises consumption at licensed facilities other than restaurants, at 1 p.m. At that same meeting, a majority of the Commissioners asked that another ordinance come back to consider further amending the Okeechobee County Code of Ordinances to provide for a uniform permitted start time of 10 a.m. for the sale of alcohol on Sundays, regardless of type of facility. Chairman Terry Burroughs opened the Public Hearing. Requested Action: Conduct a Public Hearing to discuss Ordinanc 2020-0001e as presented, which revised the permitted hours of sale of alcoholic beverages, specifically changed the permissible starting time for sales on Sundays from 1:00 p.m. to 10:00 a.m.

Ms. Linda Syfrett, President, Okeechobee County Fair Association, addressed the Board and presented the annual state of the Fair Report. She discussed the soundness of the fair's finances, as well as the turn out of the fair for the past few years. She discussed the weathers effect on attendance. She also detailed the various entertainment and activities they host. Finally, she requested volunteers from the public. Requested Action: Present the annual state of the Fair Report from Ms. Linda Syfrett, President, Okeechobee County Fair Association.

NOMINATIONS TO CHILDREN'S SERVICES COUNCIL OF OKEECHOBEE FOR APPOINTMENT BY GOVERNOR County Administrator Robbie Chartier addressed the Board and stated there are two (2) vacancies/unappointed positions on the Children's Services Council. The Board of County Commissioners nominate applicants for appointment and those applications are then forwarded to the Governor's Office for consideration of appointment. The Governor's Office requires three (3) nominations per vacancy. Okeechobee County does not have 3 nominations per vacancy. The Governor's Office in the past has received nominations but has not appointed applicants; therefore incumbents have remained on the Board despite their expiring term. 7. Community Services

a. OKEECHOBEE YOUTH FOOTBALL LEAGUE (OYFL) FACILITY LICENSE AGREEMENT Community Services Director Denise Whitehead addressed the Board and stated in December 2016, Okeechobee County entered into a facility use agreement for the non-exclusive, non-priority shared use of the Okeechobee County Sports Complex football field and concessions stand. There continues to be a demand for field space in the county with multiple sport organizations competing for field time. The Sports Complex has the only public, lighted football field in the County aside from the High School. Since 2016 Okeechobee Youth Football League (OYFL) and the Okeechobee Citizens Recreation Association (OCRA) have worked cooperatively to provide sports programming to a significant number of youth in the County. The two organizations have shared field time and use of the concessions stand with no issues during this time. Ms. Whitehead introduced Chaka Smith, President and co-founder of (OYFL). Mr. Smith addressed the Board and discussed the work of OYFL and their history of being accountable. He also addressed the wording of the original contract. The Board told Chaka to let them know the minute the wording of the contract becomes an issue so that they can look into changing language. Mr. Smith and Ms. Whitehead discussed the process of receiving donations for the organizations. The Board commended Mr. Smith on the time and effort he and his organization puts towards investing in kids. OYFL requested a renewal of their Facility Use Agreement so they may continue to utilize the facility and its amenities when the facility is unscheduled and available during the football season.

b. RESURFACING SPORTS COMPLEX PARKING LOTS UTILIZING COOPERATIVE PURCHASING WITH C.W. ROBERTS CONTRACTING INC. Community Services Director Denise Whitehead addressed the Board and stated the Parks and Recreation Department has been working cooperatively with the Roads and Bridges Division and the Capital Projects Department to prepare for the resurfacing of the parking lots at the Sports Complex. An Independent Contractor's Agreement exists between Okeechobee County and C.W. Roberts Contracting Incorporated that encompasses the proposed scope of work. As recommended by the Capital Projects Department, the Parks and Recreation Department is requesting to utilize the current paving contract unit prices under the Road Department's contract to perform the Sports Complex Parking area resurfacing. Therefore, for your review, we have attached a copy of a letter from C.W. Roberts Contracting, Incorporated allowing the cooperative purchasing use of the contract to perform the work, along with a copy of their proposal and the cooperative purchasing form. This is a budgeted project to asphalt resurface the east and west parking lot located at the Sport Complex. As part of the preliminary preparation of the existing asphalt for resurfacing, it is recommended certain areas be milled prior to the asphalt overlay. It is not intended to mill the entire parking lot, but rather areas where the existing asphalt has deteriorated and new asphalt won't adhere properly, or the area adjoins a curb or it is a handicap parking space and proper elevation needs to be maintained. Requested Action: Approve the resurfacing of the Sports Complex parking lots in the amount of $143,056.50 utilizing the Independent Contractor's Agreement between Okeechobee County and C.W. Roberts Contracting Incorporated as a cooperative purchase for asphalt paving services.

Facilities Maintenance & Development Director Donnie Oden addressed the Board and stated on January 24, 2020, the Board approved the Contract with Securitecture, LLC for Phase I of the Jail Expansion and Renovation Project. On January 29, 2020, the Request for Qualifications for the Construction Manager At-Risk with Design Assist Services for the Jail Renovation and Expansion Project was advertised and put on the County Website and responses are due on February 26, 2020. The Architect, Joe Mrak, Securitecture, LLC will attend the BOCC Meeting on a monthly basis to keep the Board informed of the progress of the Project. Mr. Mrak addressed the The Board and gave them an update on the project. Requested Action: Receive a Progress Report on the Jail Expansion and Renovation Project from the Architect of Record, Joe Mrak with Securitecture, LLC.

APPROVE PURCHASE OF TRAFFIC PREEMPTION EQUIPMENT FROM TRANSPORTATION CONTROL SYSTEMS FOR FIRE RESCUE Public Safety Director/Fire Chief Ralph Franklin addressed the Board and stated this is a request is for approval from the Board to purchase from Transportation Control Systems (TCS) Traffic Preemption Equipment and Services in the amount of $74,489.99, for County Fire Rescue using the FDOT Contract DOT-ITB-20-9034-GH. The funding for this purchase was approved during the Fiscal Year 19/20 budget process. Traffic preemption is a system that involves equipment mounted at the intersection and on the Fire Rescue vehicles that allows Fire Rescue to control the light. As a unit equipped with this system approaches the intersection, it will turn the light green in the direction of travel in order to clear the traffic out for emergency vehicles to travel unimpeded. Although the system is on all the time, it is only activated when the vehicles have their emergency lights activated. Fire Administration will have the capability to view in the system each time the preemption is activated and by what unit. This purchase and program will be for the following: 1. Equipment to be installed at the US 441 and Highway 70 intersection, (main intersection) 2. Equipment to be installed at the US 441 and SW 21st Street intersection (Wal-mart). 3. Equipment that will be installed in the primary and back up Engines, Ambulances, and Staff vehicles. 4. Training for the Fleet Management personnel to install the equipment in the vehicles.

As the main intersection and Wal-mart intersection are within the City limits, an interlocal agreement with the City will need to be approved for the City's approval of the installation and maintenance of the equipment on those signalized intersections within the City's jurisdiction. Staff will work with the City Administrator on the details and bring back for Board approval. The City will be able to utilize the preemption system as well, however, the cost of equipment installation will be borne by the City. AWARD BID 2020-02 CONCRETE DRIVEWAY APRON AND COLLAR RESTORATION Road Maintenance Director Brian Moore addressed the Board and stated the Road and Bridge Department replaces failing driveway culverts on an as needed basis, some of these will require the replacement of a concrete drive apron and all will require the installation of concrete end collars. Bids for ITB Bid # 2020-02 for the Concrete Driveway Apron and Collar Restoration were opened on January 31, 2020. Two (2) bids were received and attached with this agenda item you will find the bid tabulation and cost case scenarios to substantiate low bid. The bids were very close but the cost scenarios will show Accurate Concrete Inc. as low bidder. Most driveway aprons replaced are 350/sf or less. The requested cost amount was approved by the Board of County Commissioners in the FY 19/20 Budget. Requested Action: Approve and award ITB 2020-02 for Concrete Driveway Apron and Collar Restoration to Accurate Contracting Inc.; this agreement has a Term of two (2) years and may be renewed for up to two (2) additional one (1) year Terms; and authorize the Chairman to execute the contract as prepared by the County Attorney, and authorize spending in the amount of $40,000.00 per year as needed.

of roadway in various parts of the County. The FY19/20 budget has $1,000,000 appropriated between the Transportation Trust Fund and the Road Improvement Fund. Staff has been able to increase the number of miles of paving with the internal inspections of asphalt paving and the expertise of the Road Maintenance Division Director. The Road and Bridge Division selected roadways based on the following criteria, the Pavement Condition Evaluation (PCI) and Recommendations that were performed by Culpepper and Terpening Inc., actual field evaluations by staff, traffic volume and amount of maintenance performed on roadway. The PCI is a pavement condition survey for each roadway on a segment by segment basis for the entire 380 miles of County roadways in Okeechobee. It analyzes the existing pavement condition based on distress type, level of distress, quantity of distress and then rates each road with a numerical value which correlates from excellent to failed roadways. The roads listed for resurfacing in 2020 have been inspected and show various types of pavement failure such as: oxidation, cracking, loss of aggregate, pot-holes, and edge of pavement failure. Requested Action: Approve the list of roadways submitted for resurfacing in 2020 consisting of 8.4 miles to be accomplished within the budgeted funds; and approve the alternate road should there be sufficient funding remaining after completing the primary list. If insufficient funding for alternate road, bring back to Board.

On January 29, 2020 there were (10) proposals received for RFQ 2019-19.

The committee considered such factors as project scheduling, consultant location, current and past experience and projected workloads of the firms. Based upon the presentations and experience with the services, the Committee ranked the firms as follows:

Requested Action: Approve the Public Service Evaluation Committee (PSEC) rankings of Request for Qualifications (RFQ) 2019-19, and authorize the County Administrator and/or her designee to begin negotiations for Professional Engineering and Related Services agreements covering all aspects of local government with the top ranked firm with the intent to engage multiple firms. The Board did establish a date and time for the interviewing of the firms to provide County Engineer services as March 12, 2020 starting at 1:30pm with 30 minutes for presentations.

PROCUREMENT POLICY AMENDMENT County Administrator Robbie Chartier addressed the Board and stated that attached to this agenda item is the recommended revised Procurement Policy for Okeechobee County, for consideration by the Board. After staff review of the current policy, there are some areas that need revising for further clarification in addition to the addition of Contract Repair Services. The proposed changes in the policy are shown as underline and strikethrough. Most of the changes are to provide a clearer policy for procurements and have been recommended due to various situations that have arisen since its last amendment in 2017, using the current policy by staff and Finance. This amendment to the Procurement Policy is due to changing conditions from questions that have arisen over time which the current policy does not address or is in need of clarification (such as emergency procurements). There have been periodic changes in the past few years, for local vendor preference, and the ability to "piggyback" off of other governmental agencies competitively bid procurements.
