Ms. Norma Haynes invited the Board to the Public Safety Luncheon on May 4, 2012 at 11:00 a.m. and thanked the Board for their help and support.

The Board voted to execute a proclamation honoring all public safety personnel and designating April 29 through May 4, 2012 as "Public Safety Appreciation Week" in Coweta County.

2. 1352 Bike Ride Event - Tour de Cure

Ms. Aarica Smith, representative from the annual bike ride event "Tour de Cure" for the American Diabetes Association, briefly addressed the Board regarding the organization's request. She stated that the event is planned for May 20, 2012, there will be five (5) routes for participants to choose from and approximately 1100 riders are expected to participate in the event. She invited the Commissioners to come join the event.

3. 1373 Request Execution of Proclamation Designating May 3, 2012 as “National Day of Prayer” in Coweta County

Commissioner Smith read a proclamation designating Thursday, May 3, 2012 as a "Day of Prayer" in Coweta County.

4. 1364 Request from Stalwart Films Regarding Filming in Coweta County

Event Services Manager Tray Baggarly introduced Mr. Mike Riley and Mr. Seth Zimmerman with Stalwart Films.

Mr. Riley presented three locations where Stalwart would be filming the Season 3 first episode of "The Walking Dead". He said that filming would begin on May 7th. When the final schedule is released, the company will return to the May 3rd Board meeting to finalize contracts for use of County property, roads, and rights-of-way.

5. 1327 Presentation and Acceptance of the 2011 Audited Financial Statements by Bates, Carter and Company

Finance Director Hans Wilson introduced Ms. Beth Grimes with Bates, Carter and Company to present the 2011 audited financial statements.

Ms. Grimes stated that the most important part of the report is the two-page Independent Auditor's Report (opinion) advising that the audit was issued fairly and in accordance with generally accepted accounting principals. She said the firm issued an unqualified opinion meaning a clean opinion. Ms. Grimes advised that the Fund Balance ended with $1.1 million and expenditures were below the final amended budget of $1.9 million. She advised that several copies of the printed audit are available in the Finance Department.

PUBLIC HEARING

Motion To: Public Hearing Regarding Petition # 001-12 Filed by Coweta Festivals, Inc.

Zoning Administrator Angela White presented Petition # 001-12 filed by Coweta Festivals, Inc. to rezone 60.35± acres located on the southern side of SR 34W and Thomas Powers Road (aka Powers Crossroads) from RC (Rural Conservation) and C (Commercial) to RC- SUP (Special Use Permit) and C-SUP (Special Use Permit). She explained that the applicant proposes a variety of special events involving music, art and food. She further explained that the Development of Regional Impact (DRI) process was followed to determine if this was a DRI and it has been determined that this is not. Ms. White reviewed the factors used when considering a variance request. In closing, she stated that staff met with representatives from Coweta Festivals to discuss various conditions that will be required (i.e. parking and security) should the Board choose to approve the Special Use Permit. Ms. White covered the recommended conditions.

Chairman Brooks called for comments in support of or opposition to the rezoning.

Mr. Craig Harley, 1500 J. D. Walton Road, Newnan, Georgia stated that Ms. White had previously answered his questions.

Mrs. JoAnne Lee, 667 Charlie B. Johnston Road, Newnan, Georgia spoke in opposition to the rezoning citing concerns regarding traffic, parking, blocking the road, noise, and hours of operation. She asked the Board to consider these issues before rendering a decision.

Ms. Caroline Turner, 76 West Wedgewood Circle, Newnan, representing the Brown's Mill Association spoke in favor of the rezoning. She stated that the group is looking forward to a reenactment of the Brown's Mill Battle and Powers Crossroads would be a great place to hold the event.

Ms. Beverly Garner, President of Coweta Festivals, Inc. and representing the Newnan Pilot Club, stated that five (5) organizations make up the Coweta Festivals Inc. She said that the Power's property funds their projects (i.e. scholarships, help for elderly) and that all dollars made go back into the community. She stated that it would help the economy and requested that the Board grant the rezoning.

Commissioner Lassetter asked Ms. White if she had additional comments regarding Ms. Lee's concerns. She said in reviewing staff's recommendations she would like to address some of Ms. Lee's comments. She stated the road would not be closed for any event held in the area.

Ms. White assured Ms. Lee that the road would not be blocked. She said that each event will have specific rules/stipulations/responsibilities that must be followed and, if not, the Special Use Permit could be revoked.

Commissioner Lassetter stated that staff and the applicant have worked to ensure residents in the area are inconvenienced as little as possible and asked Coweta Festivals and staff to make sure each group is a good neighbor to the citizens.

Chairman Brooks asked if staff had addressed the concerns of Heard County Chairman June Jackson regarding the property. He further stated that he would like to see a specific number of deputies assigned by the number of participants at an event when alcohol sales are involved.

Administrator Gay advised that he had spoken with Chairman Jackson. Commissioner Lassetter stated that he also spoke with the Chairman.

The Board voted to close the public hearing regarding petition # 001-12 filed by Coweta Festivals, Inc.

6. 1297 Public Hearing - April 17, 2012 Petition 001-12 Coweta Festivals, Inc - 60.35± acres Rezoning from RC to RC-S.U.P. and C to C-S.U.P Article 6 Section 69.9 Special Events, Festivals, & Tourism Activities

By a vote of 3 to 2, the Board voted to grant a rezoning request filed in Petition # 001-12 by Coweta Festivals, Inc. to rezone 60.35± acres located on the southern side of W. Hwy. 34 and Thomas Powers Road (aka Powers Crossroads) from RC (Rural Conservation) and C-SUP (Commercial) to RC- SUP (Special Use Permit) and C-SUP (Special Use Permit), subject to the following conditions:

1. The Fire Department will have unobstructed access on all service drives marked with red arrows on the site plan.

2. During events such as and not limited to tree climbing groups, etc. where emergency standby is required it will be the responsibility of the event organizers to hire off-duty firefighters to standby for such events. The Fire Marshal's Office shall be consulted to determine if such events will require emergency standby.

3. All events having attendance of over one hundred (100) and alcohol is being sold shall submit a plan to the State Fire Marshal's Office for approval along with the types of events planned.

4. At any event in which a tent is erected and there is occupant load of over one hundred (100) with alcohol or an occupant load of over three hundred (300) without alcohol being sold/served, the State Fire Marshal's Office will need to approve and inspect the tent.

5. As stated in the applicant's narrative description, events shall be coordinated with the Sheriff's Office and Georgia State Patrol and include off-duty Sheriff's Deputies and Troopers for traffic control, patrolling parking areas, and to oversee all event activities.

6. No permanent markings shall be made on Thomas Powers Road for pedestrian crossing(s). Temporary and patrolled pedestrian crossings shall be used to ensure pedestrian safety during events (i.e. use of traffic cones to mark where pedestrians are to cross the roadway).

7. If over 5,000 sq. ft. of permanent impervious surface is added or there is more than a one (1) acre of disturbed area, then the applicant shall address the current Coweta County Stormwater Management Ordinances and apply for a land disturbance permit (LDP).

8. Should a land disturbance permit (LDP) be required, then the applicant shall meet the requirements of the Coweta County Wetlands Protection and Floodplain Ordinances.

9. The area on the Conceptual Site Plan noting the 50 ft. buffer shall adhere to Article 25 Buffer and Screening Requirements of the Coweta County Zoning and Development Ordinance. A buffer plan shall be submitted in accordance with Article 25 for approval. In addition, the established wooded areas along the southern and eastern property lines as depicted on the Conceptual Site Plan shall remain undisturbed, except where supplemental planting is required.

10. Alcohol sales shall be permitted only when provided through a licensed caterer under the regulations of the Coweta County Alcohol Ordinance.

11. Food service and restroom facilities, both temporary and permanent, shall meet the requirements of the Environmental Health Department.

12. Lighting shall be established in such a manner that adjacent properties are not adversely affected and that no direct light is cast upon adjacent properties or roadways.

13. No permitted use shall exceed a noise level of 45 dBa, as measured at the property line.

14. Adequate refuse collection containers shall be provided.

15. Per proffered explanation of major and minor events and related times and events, the Special Use Permit shall be limited to that specific scheduling.

16. The Special Use Permit shall exclude any Motor Sports Racing Events.

17. Access to SR 34 West shall meet all applicable standards as required by the Georgia Department of Transportation (GDOT).

18. The Major/Minor events and the associated conditions are included as follows:

The Board voted to grant a 40-foot setback variance and a 65-foot buffer variance on the western property line of property located off SR 34 E and Aces Circle as filed in Petition # ZA 007-12 by Amerco Real Estate Company for construction of a stormwater detention pond subject to the following conditions:

13. 1343 Deny Screening Variance as Requested in Petition # ZA 008-12 Filed by Amerco Real Estate Co. (U-Haul) for Property Located off E. Hwy. 34, Newnan

Zoning Administrator Angela White presented Petition # ZA 008-12 filed by Amerco Real Estate Company requesting a screening variance on property located off SR 34 E and Aces Circle.

Mr. Carlos Vizcarra, president of the Amerco Real Estate Company, 2727 North Central Avenue, Phoenix, AZ stated that he is requesting permission to build a U-Haul rental facility. He said the company looks for "pile-up" areas to open a U-Haul store. He explained the company doesn't advertise in the paper, radio, or television. The only advertising used are the trucks parked on the site. He said if the equipment is not on display, the Board of Directors will not allow him to open the facility in Coweta County. He said he had originally requested seven (7) trucks on display. Inside the showroom, model rooms are installed. This problem has been resolved in other areas through design build incorporating the areas regulations.

Commissioner Lassetter stated that at a previous meeting Mr. Crimes was asked why a sign could not accomplish the advertising for the business.

Mr. Vizcarra stated that through experience they have found that the less equipment and displays seen, the less business the location receives. He said it is just what people recognize for the locations.

As requested by Commissioner Smith, Ms. White reviewed the conditions should the Board approve the variance. She fielded questions from the Board regarding fencing and distance from SR 34.

Commissioner Smith made a motion to approve the zoning with conditions.

Commissioner Poole asked Chairman Brooks for his thoughts on the variance since the property was in his District.

Chairman Brooks stated that due to the economy, he would be in favor of approving the variance with the conditions stipulated by the Planning Department. He then asked the applicant if he would be willing to participate (25%) with the cost of traffic signalization at the intersection.

Mr. Vizcarra advised he would participate in the signalization at 25% of the cost.

Commissioner Smith amended his motion to include the signalization.

Commissioner Brooks stated that based on economy and participation of signalization, he would second the motion for approval.

The motion to approve a screening variance requested in Petition # ZA 008-12 filed by Amerco Real Estate Company (U-Haul) failed by a vote of 2 to 3; thereby denying the variance.

The Zoning Appeals Board and Planning staff recommend approval of the Conditional Use Permit.

The Board voted to grant a Conditional Use Permit as requested in Petition # ZA 010-12 filed by Brian Szczech dba Gold-Plated GunDogs, subject to the following conditions:

1. The facility shall be limited to a maximum of twenty (20) dogs.

2. The applicant shall obtain all applicable building permits from the Coweta County Building Department.

3. The facility shall meet all applicable ADA requirements.

If over 5,000 square feet of impervious surface is added, then the applicant shall address the current Coweta County Stormwater Management Ordinances and apply for a land disturbance permit (LDP).

19. 1367 Presentation of Proposal for Planned Expansion of the University of West Georgia

Administrator Theron Gay stated that representatives from the University of West Georgia are present to request that Coweta County partner with them in a planned expansion of the University's presence in Coweta County. He stated that the University would like to expand their operation to the Newnan Hospital on Jackson Street. He introduced Mr. Jon Anderson.

Mr. Anderson gave a brief history of the University's presence in Coweta County since the early 80's and the current offerings. He stated that the school needs more space and they are trying to pull resources together to make the expansion a viable project. In response to a question from Chairman Brooks, Mr. Anderson stated that the current building would be kept in operation and active.

In response to a statement from Chairman Brooks, County Attorney Nathan Lee stated that the financing would have to go through one of the development authorities.

The Board instructed staff to work with the City of Newnan and the University to determine what the County's portion of participation would be for the expansion project.

Commissioner Poole asked staff to also look at numbers to support West Georgia Technical College.

20. 1359 Request Approval to Run Coweta County Transit 2012 DBE Public Notice

On November 16, 2010, the Board of Commissioners approved the Coweta County Transit Disadvantaged Business Enterprise (DBE) Program as required by the Federal Transit Administration (FTA) and the Georgia Department of Transportation (GDOT). An annual requirement of the transit DBE program is to run a public notice in the county’s legal organ to announce review and comment on transit DBE goals and activities for the current fiscal year.

The Board voted to instruct staff to submit an advertisement to the Newnan Times-Herald as notification to the public to allow for comments and feedback on Coweta County's Disadvantaged Business Enterprise (DBE) policies, goals and activities for FY 2012.

Administrator Gay stated that a public hearing is required to exempt County owned/leased vehicles from the State law requiring a clearly visible decal or seal on the front door of each side of the vehicle. He requested that a public hearing be held on May 15, 2012 at 6:00 p.m. to exempt vehicles utilized by the Administration Office and the Coroner’s Office.

Administrator Gay explained that at a Public Hearing/Regular Meeting held on January 18, 2011 the Board approved a greenspace conversion and property exchange of 18.2841± acres with the Coweta County Water and Sewerage Authority associated with the Brown's Mill Battlefield Project, contingent upon approval by the Georgia Department of Natural Resources. He said that staff has received that approval and is requesting execution of the deeds.

Comprehensive Planner Sandra Parker stated that the deeds regarding the property exchange have been completed and are being presented to the Board for execution.

The Board voted to execute a deed conveying property located at the Brown's Mill Battlefield to the Coweta County Water and Sewerage Authority as part of a land exchange agreement related to the Battlefield project.

He stated that some residents do not want the north exit on Walt Sanders closed and some don't want the southern exit closed. He presented several options, but the residents want the road left as it is.
