QUESTION:

Last year there was a lot of news about a new FHA program called HAWK. It was supposed to start this year and save fi rst-time buyers big money, so when will it begin?

ANSWER:

Yes, absolutely, there was a lot of news about the proposed HAWK program. The great attraction of the program was that fi rst-time buyers could save perhaps $9,800 over the life of the loan, money that comes from a reduction of FHA mortgage insurance premiums.

Why would the FHA reduce its fees? Because to qualify for the HAWK program borrowers would have to take housing counseling and have a steady record of good payments for at least two years. In other words, with better-educated borrowers who performed as promised the FHA would have fewer claims against its reserves, thus everyone wins. Borrowers would have lower costs and the FHA would pay out fewer dollars.

This sounds like a sensible idea, one that parallels auto insurance: If you take driver’s ed classes and don’t have accidents, you get insurance at a lower cost. The HAWK program was supposed to start this year, but then Congress became involved. If you take a look at the $1.1 trillion budget passed in December you can fi nd this curious provision:

“SEC. 235. None of the funds made available by

this Act nor any receipts or amounts collected under any Federal Housing Administration program may be used to implement the Homeowners Armed with Knowledge (HAWK) program.”

Why would members of Congress be against the HAWK program? It’s hard to know. Are members of Congress opposed to lower costs for fi rst-time homebuyers? Do they oppose less risk for the FHA? You might want to ask your senator or representative.

First-time buyers used to represent about 40 percent of all purchasers. That constant infl ux of new buyers made it possible for existing homeowners to readily sell their properties and created demand which helped stabilize and often increase home prices. However, according to the National Association of Realtors, in 2014 “the share of fi rst-time buyers fell to its lowest point in nearly three decades and is preventing a healthier housing market from reaching its full potential.”

The reality is that the housing market remains fragile and while values have been rising nationwide that’s hardly the case in all markets. It’s hard to imagine why more fi rst-time homebuyers and additional demand would not cause home values to strengthen – or why members of Congress would be opposed.

IS THE NEW FHA PROGRAM STILL HAPPENING?

It’s the time of year when Uncle Sam pays you back. A majority of Americans (51 percent) have already received or expect to receive a tax refund this season, according to a recent Bankrate.com report, which also found that people prefer large refunds (38 percent) over small refunds (19 percent) or no refund at all (27 percent). Tax and fi nancial advisers, however, directly advise against getting any amount of money back. When income tax is withheld from paychecks, taxpayers are essentially giving the government a small, interest-free loan. “Most people think getting money back is a good thing, a windfall, but you’re simply getting your own money back,” says Douglas Boneparth, a certifi ed fi nancial planner and vice president at Life and Wealth Planning in New York City, said in a statement. The average 2015 refund is currently about $3,000, which amounts to $250 a month that you could have used for savings or spending. Millennials are more likely than any other age group to receive a tax refund (66 percent), compared to 35 percent of people age 50 or older. This is unsurprising since the likelihood of receiving money back decreases with age. “People are still very, very nervous about the future,” Tim Gagnon, a tax attorney and accounting faculty member at Northeastern University in Boston, said of the report. “They had to take on more debt and see a refund as an opportunity to get some of it down so they won’t be so leveraged.”

Some of the most important tax write-offs available exclusively to those who own homes (including, in many cases, vacation or second homes) are:

• Mortgage and home loan interest deductibility. You can deduct the interest on a mortgage of up to $1 million used to purchase a home, as well as the interest on a home equity loan of up to $100,000.

• Mortgage interest credit, available to lower-income buyers who received a qualifi ed Mortgage Credit Certifi cate. Unlike the mortgage interest deduction, this is a credit that reduces your tax liability dollar for dollar.

• Discount points, paid at closing for a home purchase or refi nance, that enabled you to borrow at below current market rates (each point equates to 1 percent of the size of your mortgage loan). Certain rules

apply, but in general the cost may be deducted dollar for dollar in the year in which they were paid; with a refi nance, however, points are usually amortized over the loan’s life.

• Real estate taxes paid to state and local taxing bodies, which can typically be deducted in the year in which they’re paid.

• Casualty losses, which can occur, for instance, if a major storm impaired your residence. The write-off is based on the net loss after insurance has been paid and has to exceed 10 percent of your adjusted gross income.

• Home offi ces. If you work from your house, you can usually deduct expenses associated with running an eligible home offi ce, such as utility costs to heat and cool the space, fees to remodel the room, and more. Qualifying for these write-offs, however, can be diffi cult, although the IRS introduced a simplifi ed option for home offi ce deduction last year that makes this process easier.

Even if it’s too late to qualify for some of the aforementioned deductions on your 2014 tax return, you may be able to claim these and other tax breaks in the future, so count on keeping good records and planning ahead, say the experts.

“For example, while you cannot write off the cost of home improvements, you can add these costs to your basis when it comes time to sell your home, helping you qualify for an exclusion on the net sales gain,” says John Gregory, tax professional in Oxford, Pennsylvania, and founder of 1040Return.com. “So be sure to keep your receipts.”

There are many strategies available to maximize these tax deductions, but it pays to enlist the help of a professional accountant or tax planner, says Mark Luscombe, principal analyst with Wolters Kluwer Tax & Accounting U.S. in Riverwoods, Illinois.

“Homeowners should familiarize themselves with the rules and consult with tax experts, as professional expertise is helpful in identifying possible tax breaks and avoiding costly mistakes,” Kluwer says.
