New Delhi The push for digital payment platforms and removal of service tax on IRCTC book- ings online in the latest Union Budget have enthused the travel industry, who be- lieve the initiatives will make travel easier and cheaper across the country. The in- dustry, which was endorsed by Finance Minister Arun Jaitley as a sector of econom- ic importance, has welcomed the proposed decisions, say- ing that the steps will make travel more "accessible and reduce friction between the user and service provider". According to online travel portal Skycanner, that recent- ly took on board a direct booking application, the trav- el industry has already seen a hike in the number of trans- actions made via smart phones over the past one year, and the trend is only going to catch up with the recommen- dations under the budget. "We recently added low cost carrier 'Scoot' to make book- ing and payments online and on app seamless and easy. Similarly, with a 30 per cent jump in searches witnessed between January 2016 and 2017 through smart phones, we know that there is an im- petus in online transactions. "Online travel companies are embracing this develop- ment with the singular aim to make travel easy and simple," says Reshmi Roy, Growth Man- ager, Skyscanner India. The budget noted that "a mission" would be set up with a "target of 2,500 crore digital transac- tions" for the upcoming fiscal year, besides strengthening the digital payment infra- structure and grievance han- dling system. Sharat Dhall of Yatra.com said that the newer policies to promote the digital economy would contribute im- mensely towards developing a "truly cashless India" with cit- izens having an easy access to a wide choice of options at their convenience. He also ap- preciated the announcement to waive off service tax on train tickets booked via IRCTC website, saying it was another indicator of the gov- ernment's agenda of promot- ing digital transactions, par- ticularly in the aftermath of demonetisation. "The move will further encourage cash- less transactions in the wake of the demonetisation exer- cise," says Dhall. Noting that technology is one of the major elements driving the tourism industry, Arvind Bhatia from Indian Routes, a travel agency, feels the move will not only make travel cheaper for the public, but also benefit agencies. "From the tourism point of view we consider it a great move as going forward we see technology playing a great part today and paving our way for the upcoming future. It will allow agents like us to make use of this platform more and also enable offer competitive rates for the overall package for group tours," says Bhatia. Aloke Bajpai, who has co- founded ixigo.com, says that the budget has laid out some "big investments" for the in- dustry, both in terms of in- frastructure and technology. "Kicking off on a good note, this year's budget brought happiness to many with the removal of service charges on bookings made through IRCTC - indicating the gov- ernment's focus to drive more digital transactions," he says. He also lauded some of the announcements in the Rail- way budget like 'Raksha coach', 'clean my coach serv- ices', 'coach mitra' facility for registering complaints and installation of bio-toilets, which he feels would "attract back travellers by improving cleanliness, safety and pas- senger comfort". Another im- portant development was the introduction of the special tourism zones anchored on SPV (Special purpose vehi- cle) that will be established in partnership with the state governments. However, Kapil Goswamy of BigBreaks.com feels disap- pointed with the industry's concerns about high tax rates being "ignored" by the gov- ernment, and feels that waiv- ing off service tax on IRCTC online bookings would "not help the industry directly". "Even if you consider the in- direct benefit, the saving that travelers will make the with- drawal of service tax on on- line train bookings is too small (minimum Rs 46 and maximum Rs 138) to encour- age travel and tourism and make a difference to the for- tunes of the travel industry. "Of course, we will be pass- ing the benefit to our cus- tomers, but it is too miniscule and inconsequential for us," says Goswamy. —PTI ‘New budget makes travel EASIER and CHEAPER’ Travel portals go ga-ga over new budget MANOJ POKHRIYAL Dehradun It will not be a cakewalk for three-time Congress MLA and Uttarakhand Sports and Forest Minister Dinesh Agarwal to win Dharampur constituency in Dehradun this poll season with BJP fielding two-time mayor Vinod Chamoli from the seat. The BJP ticket to Chamoli has not gone down well with the supporters of his own party leader Umesh Aggar- wal, who was viewed as a strong contender for Dharampur constituency, a Congress bastion. Chamoli, however, is seen campaigning hard to garner votes and if he succeeds in coaxing Umesh's support- ers, who had allegedly van- dalised the party state office after ticket distribution, it would pose a big challenge to Congress leader Dinesh Agarwal. Agarwal on his part has trashed the candidature of Chamoli, saying he does not have a "single achievement" to his credit. Chamoli is the mayor of Dehradun Munici- pal Corporation since 2008. "There is no challenge from Chamoli. I wonder on what basis he got the ticket to fight against me. I chal- lenge him to give his one achievement in Dehradun as a two-time mayor. "I want to put across to him only one question. What is his achievement? What has he given to Dehradun as a mayor and as Municipality chairman? I think he has given the tag of the dirtiest city in India to Dehradun. He has no policy, no programme and no vi- sion," he said. Hitting back at Dinesh, Chamoli said, "Let him say that it is easy for him to win the election. Let the election gets over, everything will be out. There is a huge anti-in- cumbency in the state as well as in Dharampur con- stituency. "As a mayor, I have a long list of achievements, includ- ing establishment of bus shelters, flyovers, widening of roads and increasing sewerage connection to 80 per cent of the area from just 20 per cent," he said. He said the election out- come would be in favour of BJP as "aam admi stands with the Modi government" and the people want "change" as Congress government in the state is "engulfed in corrup- tion". —PTI TIGHT CONTEST Tough contest in the offing in Dharampur Guwahati A suo-motu case has been registered against As- samese filmmaker Himang- shu Prasad Das on charges of waging war against the country by allegedly seek- ing help from ULFA(I), through an open letter, to run his film in theatres across the state. "We had registered a suo- motu case a few days back against Das for trying to contact sources or persons inimical to the interest of India," Guwahati Police Commissioner Hiren Chan- dra Nath told PTI here. The police had issued a no- tice asking Das to appear be- fore it, but he has not come yet, Nath said. Asked if Das will be arrest- ed, he said, "We will at first interrogate him and then de- cide." Guwahati Police regis- tered the case under various IPC sections including 121 (waging or attempting to wage war or abetting wag- ing of war against the Gov- ernment), 121(A) (conspira- cy to overawe by means of criminal force or), 153(A) (promoting enmity between different groups on grounds of religion, race, place of birth, etc) at Panbazar police station and issued a notice to Das for appearing before them. Assistant Commissioner of Police (Cyber Unit) Suleman Ali registered the case on January 28. The director had written the letter following hall own- ers' decision to withdraw his film, which was released on January 20, to accommodate Shah Rukh Khan starrer "Raees" and "Kaabil" star- ring Hrithik Roshan that hit the screens on January 25, police said. Responding to the letter, Barua allegedly called up lo- cal TV channels and asked the hall owners to run Das's film if people wanted to watch it, or else ULFA(I) would oppose it. Sweet justice for Goan teacher Appointment in minority institution open to judicial review, rules SC FROM OUR BUREAU NEW DELHI A Goan economics teacher has won a 12-year long le- gal battle for fair play against the Diocesan Socie- ty denying her the post of principal and invoking Ar- ticle 30 that gives protec- tion to the minority insti- tutions. The Bench of Justices Adarsh Kumar Goel and Uday Umesh Lalit an- swered this question early this week, allowing appeal by Ivy C. DA. Conceicao by holding that autonomy of a minority institution does not dispense with the re- quirement to act fairly and in a transparent manner. It held that a minority in- stitution is free to select and appoint a principal and not bound by the sen- iority principle alone, but whether an individual eli- gible candidate''s right has been violated by not adopt- ing fair procedure is liable to be tested in exercise of power of judicial review under Article 226 of the Constitution since right of choice of the institution has to be fair, non-discrim- inatory and rational. Since this aspect was not examined by the Goa Bench of the Bombay High Court in its judgment on August 14, 2012, the Apex Court set aside the ruling and remitted back the case to the Goa Bench for "a fresh decision in accor- dance with law," directing all parties to appear before it for further proceedings on February 15. A teacher of economics for 21 years in Rosary High- er Secondary School at Navelim run by the Dioce- san Society, Conceicao felt unfair treatment meted out to her by the society not considering her case while filling the vacancies of the principal in its various schools and despite the fact that she was the senior- most and she has no ad- verse remark in the confi- dential reports. The society took the stand that she was duly considered and in exercise of its right under Article 30, it selected someone else as the most suitable candi- date. It claimed the autono- my as a minority institu- tion in selecting a principal and asserted that seniority is not the only criteria. The Apex Court held that Article 226 allows judicial review of an educational institution, even a minori- ty institution, as to whether it is transparent and fair. Despite the auton- omy under Article 30, exer- cise of power by a minority institution in discharging public functions is open to judicial review, it added. The question as framed by the Supreme Court was: "Whether the process of appointment of a principal in minority institution is open to judicial review and on what grounds?" It was alleged the question papers were leaked out. Physical test was held in November last year. Senior SP of Patna police Manu Maharaj said Brigadier of Danapur can- tonment of BRC has in- formed him that the two hav- ildars were being ques- tioned. Patna police had ar- rested five persons and they had named the two havildars against whom Patna police obtained arrest warrant from the court. When Patna police went to Danapur cantonment, army authorities refused to hand the two havildars over to them. The five arrested people had alleged they used to pay to the Col Rs one lakh each from the aspirants through the two havildars. They have also named offi- cer’s wife as beneficiary in the scam and claimed they had paid Rs 12 lakhs to the wife of the officer. Those ar- rested in the scam are- Munna Kumar Singh of Bhojpur, Rahul Kumar and Vicky Kumar of Vaishali, Satish Kumar Sharma of Danapur and Nitish Kumar Singh of Rohtas. According to online travelportal Skycanner, that recent-ly took on board a directbooking application, the trav-el industry has already seen ahike in the number of trans-actions made via smartphones over the past one year,and the trend is only going tocatch up with the recommen-dations under the budget."We recently added low costcarrier 'Scoot' to make book-ing and payments online andon app seamless and easy.Similarly, with a 30 per centjump in searches witnessedbetween January 2016 and2017 through smart phones,

we know that there is an im-petus in online transactions.

Thebudget noted that "a mission"would be set up with a "targetof 2,500 crore digital transac-tions" for the upcoming fiscalyear, besides strengtheningthe digital payment infra-structure and grievance han-dling system. However, Kapil Goswamy ofBigBreaks.com feels disap-pointed with the industry'sconcerns about high tax ratesbeing "ignored" by the gov-ernment, and feels that waiv-ing off service tax on IRCTConline bookings would "nothelp the industry directly"."Even if you consider the in-direct benefit, the saving thattravelers will make the with-drawal of service tax on on-line train bookings is toosmall (minimum Rs 46 andmaximum Rs 138) to encour-age travel and tourism andmake a difference to the for-tunes of the travel industry."Of course, we will be pass-ing the benefit to our cus-tomers, but it is too minisculeand inconsequential for us,"says Goswamy. —PTI

Agarwal on his part hastrashed the candidature ofChamoli, saying he does nothave a "single achievement"to his credit. Chamoli is themayor of Dehradun Munici-pal Corporation since 2008.

"There is no challengefrom Chamoli. I wonder onwhat basis he got the ticketto fight against me. I chal-

lenge him to give his oneachievement in Dehradunas a two-time mayor.

"We had registered a suo-motu case a few days backagainst Das for trying tocontact sources or personsinimical to the interest ofIndia," Guwahati PoliceCommissioner Hiren Chan-dra Nath told PTI here.

The police had issued a no-tice asking Das to appear be-fore it, but he has not comeyet, Nath said.

Asked if Das will be arrest-ed, he said, "We will at firstinterrogate him and then de-cide."

Guwahati Police regis-tered the case under variousIPC sections including 121(waging or attempting to

wage war or abetting wag-ing of war against the Gov-ernment), 121(A) (conspira-cy to overawe by means ofcriminal force or), 153(A)(promoting enmity betweendifferent groups on groundsof religion, race, place ofbirth, etc) at Panbazar policestation and issued a notice toDas for appearing beforethem.

The Bench of JusticesAdarsh Kumar Goel andUday Umesh Lalit an-swered this question earlythis week, allowing appealby Ivy C. DA. Conceicao byholding that autonomy of aminority institution doesnot dispense with the re-quirement to act fairly andin a transparent manner.

It held that a minority in-stitution is free to selectand appoint a principaland not bound by the sen-iority principle alone, butwhether an individual eli-gible candidate''s right hasbeen violated by not adopt-ing fair procedure is liableto be tested in exercise ofpower of judicial reviewunder Article 226 of theConstitution since right ofchoice of the institutionhas to be fair, non-discrim-inatory and rational.

Since this aspect was notexamined by the GoaBench of the Bombay HighCourt in its judgment onAugust 14, 2012, the ApexCourt set aside the rulingand remitted back the caseto the Goa Bench for "afresh decision in accor-dance with law," directingall parties to appear beforeit for further proceedingson February 15.
