SUBPART A - GENERAL

142.1 Applicability

(a) This part prescribes the requirements governing the certification andoperation of aviation training centres.

(b) (1) This part provides an alternative means to accomplish the trainingrequired by CASR Parts 61, 63, 121 or 135

(2) Certification under this part is NOT required for any training organizationalready approved under Part 121 or Part 135 for the training of its own or another operator’s personnel.

(c) The course for which application is made under paragraph (a) of this sectionmay be for crewmembers other than flight crewmembers, including flight

attendants, dispatchers, material handlers, ground servicing personnel,security personnel and others approved by the Director.

142.2 Definitions

As used in this part;

Aircraft - means an aircraft specific to type, category and class of aircraft,approved by the Director to satisfy certain flight training requirements.

Core Curriculum - means a set of courses approved by the Director, for use by a

training center and its satellite training centers. The core curriculum consists of training which is required for certification. It does not include training for tasks andcircumstances unique to a particular user.

Course means -

(1) A program: of instruction to obtain pilot certification, qualification,authorization, or currency;

(2) A program of instruction to meet a specified number of requirements of aprogram for pilot training, certification, qualification, authorization, or currency;or

(3) A curriculum, curriculum segment or component, required by part 121 or 135.

Courseware - means instructional material developed for each course or curriculum, including lesson plans, flight event descriptions, computer softwareprograms, audiovisuals programs, workbooks, and handouts or training displays.

Evaluator -means a person employed by a training center certificate holder whoperforms tests for certification, added ratings, authorizations, and proficiencychecks that are authorized by the certificate holders training specification, andwho is authorized by the Director to administer such checks and tests.

Flight simulator/or flight training device - means a flight simulator, as definedin 142.59(a) of this part, or flight training device, as defined in 142.59(b) of thispart.

Instructor - means a person employed by a training center and designated to

provide instruction in accordance with subpart C of this part.Line-Operational Simulation - means simulation conducted using operationaloriented flight scenarios that accurately replicate interaction among flight crewmembers and between flight crewmembers and dispatch facilities, other crewmembers, air traffic control, and ground operations. Line operationalsimulation simulations are conducted for training and evaluation purposes andinclude random, abnormal, and emergency occurrences. Line operationalsimulation specifically includes line-oriented flight training, special purposeoperational training, and line operational evaluation.

Specialty Curriculum - means a set of courses that is designed to satisfy arequirement of the CASR and that is approved by the Director for use by aparticular training center or satellite training center. The specialty curriculumincludes training requirements unique to one or more training center clients.

Training center - means an organization governed by the applicablerequirements of this part that provides training, testing, and checking under contract or other arrangement to airmen subject to the requirements of thischapter.

Training program - means courses, courseware, facilities, flight trainingequipment, and personnel necessary to accomplish a specific training objective.It may include a core curriculum and a specialty curriculum.

Training and checking credit - means the hours or specific operational areas of an approved course, which may be credited toward the flight hour requirements of that course.

Training device - means simulator or advanced training device that has beengiven training and checking credit by the Director.

Training specifications - means a document issued to a training center certificate holder by the Director that prescribes that center’s training, checking,

and testing authorizations and limitations, and specifies training programrequirements.

142.3 Certificate and Training Specifications Required

No person may operate a training center without, or in violation of, a trainingcenter certificate and training specifications issued under this part.

142.5 Requirements for a Training Center Certificate

(a) An applicant will be issued a training center certificate and trainingspecifications with appropriate limitations if the applicant shows that it hasadequate facilities, equipment and personnel to conduct the training proposed

by the training center;(b) Completes the application for a training center certificate on a form and in a

manner prescribed by the Director containing the information outlined insection 142.7 of this part;

(c) Each applicant for the original issue of a training center certificate who intendsto conduct training under this part must submit the following financialinformation:

(1) A balance sheet that shows assets, liabilities, and net worth, as of a datenot more than 60 days before the date of application.

(2) An itemization of liabilities more than 60 days past due on the balancesheet date, if any, showing each creditor’s name and address, adescription of the liability, and the amount and due date of the liability.

(3) An itemization of claims in litigation, if any, against the applicant as of thedate of application showing each claimant's name and address and adescription and the amount of the claim.

(4) A detailed projection of the proposed operation covering 6 completemonths after the month in which the certificate is expected to be issuedincluding-(i) Estimated amount and source of both operating and non

operating revenue, including identification of its existing andanticipated income producing contracts and estimated revenue per mile or hour of operation by aircraft type, or training device;

(i) Estimated amount of operating and non operating expenses byexpense objective classification; and

(ii) Estimated net profit or loss for the period.

(5) An estimate of the cash that will be needed for the proposed operationsduring the first 6 months after the month in which the certificate isexpected to be issued, including a full explanation on the following;(i) Acquisition of property and equipment;(ii) Retirement of debt;(iii) Additional working capital;(iv) Operating losses other than depreciation and amortization ; and(v) Other subjects as considered significant by the Director.

(6) An estimate of the cash that will be available during the first 6 monthsafter the month in which the certificate is expected to be issued, giving fullexplanation of;(i) Sale of property or flight equipment;(ii) New debt;(iii) New equity;(iv) Working capital reduction;

(v) Operations (profits);(vi) Depreciation and amortization; and

(vii) Other.

(7) A schedule of insurance coverage in effect on the balance sheet dateshowing insurance companies; policy numbers; types, amounts, andperiod of coverage; and special conditions, exclusions, and limitations.

(8) Any other financial information that the DGAC requires to enable him or her to determine that the applicant has sufficient financial resources toconduct his or her operations with the degree of safety required in thepublic interest.

(d) Each holder of an training center certificate shall submit a financial report for the first 6 months of each fiscal year and another financial report for eachcomplete fiscal year.

(e) Each financial report containing financial information required by paragraph(d) of this section must be based on accounts prepared and maintained on anaccrual basis in accordance with generally accepted accounting principlesapplied on a consistent basis, and must contain the name and address of theapplicant's public accounting firm, if any. Information submitted must besigned by an officer, owner, or partner of the applicant or certificate holder.

142.6 Training Procedures Manual

An applicant for a training center approval shall prepare a Training ProceduresManual. Each manual shall be specifically identified and shall include at least thefollowing:

(a) a system for amendments;

(b) manual holder name and copy number;

(c) an organizational chart, showing the responsibility and reporting levels of each member of the organization;

(d) a description of the duties and responsibilities of the reporting levels listed onthe organizational chart;

(e) a simple floor plan of the facility, showing the location of the, classroomsand offices, and a general description of facilities;

(f) instructor qualifications;

(g) a description of the quality control system that ensures the policies andprocedures are effectively in place;

(h) a copy of the course curriculum;

(i) sample copies of examination questions, which shall reflect all subjectstaught;

(j) an explanation of the means by which a student’s attendance and gradescan be verified;

(k) a description of any exceptions to attendance requirements;

(l) procedures for development of examinations;

(m) a copy of the graduation certificate;

(n) a list of the names and signatures of all individuals authorized to signcertificates, forms and letters;

(o) a description of the course prerequisites for basic training;

(p) for type training courses, a detailed explanation of how changes to thecourse are controlled;

(q) a list of reference material;

(r) a description of training aids available for basic training.

142.7 Application for Issuance or Amendment

(a) An application for a training center certificate and training specifications shall -

(1) Be made on a form and in a manner prescribed by the Director;

(2) Be made at least 120 calendar days before the beginning of anyproposed training or 60 calendar days before effecting an amendment toany approved training, unless a shorter filing period is approved by theDirector.

(b) Each application for a training center certificate and training specification shallprovide -

(1) A statement showing that the minimum qualification requirements for each management position are met or exceeded;

(2) A statement acknowledging that the applicant shall notify the Director within 10 working days of any change made in the assignment of personsin the required management positions;

(3) The proposed training authorizations and training specificationsrequested by the applicant;

(4) The proposed evaluation authorization;(5) A description of the flight training equipment that the applicant proposes

to use;

(6) A description of the applicant’s training facilities, equipment, qualificationsof personnel to be used, and proposed evaluation plans;

(7) A training program curriculum, including syllabi, outlines, courseware,procedures, and documentation to support the items required in subpartB of this part, upon request by the Director,

(8) A description of a record keeping system that will identify and document

the details of training, qualification, and certification of students,instructors, and evaluators;

(9) A description of quality control measures proposed; and

(10) A method of demonstrating the applicant's qualification and ability toprovide training for a certificate or rating in fewer than the minimum hoursprescribed in part 61 of CASR if the applicant proposes to do so.

(c) The facilities and equipment described in paragraph (b)(6) of this section shall(1) Be available for inspection and evaluation prior to approval; and

(2) Be in place and operational at the location of the proposed training center prior to issuance of a certificate under this part.

(d) An applicant who meets the requirements of this part and is approved by theDirector is entitled to -

(1) A training center certificate containing all business names included on theapplication under which the certificate holder may conduct operations andthe address of each business office used by the certificate holder; and

(2) Training specifications, issued by the Director to the certificate holder,containing -(i) The type of training authorized, including approved courses;(ii) The category, class, and type of aircraft that may be used for

training, testing, and checking;(iii) For each flight simulator or flight training device, the make,

model, and series of airplane or the set of airplanes being simulatedand the qualification level assigned, or the make, model, and seriesof rotorcraft, or set of rotorcraft being simulated and the qualificationlevel assigned;

(iv) For each flight simulator and flight training device subject toqualification evaluation by the Director, the identification number assigned by the DGAC;

(v) The name and address of all satellite training centers, and theapproved courses offered at each satellite training center;

(vi) Authorized deviations or waivers from this part; and(vii) Any other items the Director may require or allow.

(e) At any time, the Director may amend a training center certificate -

(1) On the Director’s own initiative, or

(2) Upon timely application by the certificate holder.

(f) The certificate holder must file an application to amend a training center certificate at least 60 calendar days prior to the applicant's proposed effectiveamendment date unless a different filing period is approved by the Director.

142.9 Management and Personnel Requirements

An applicant for a training center certificate must show that -

(a) For each proposed curriculum, the training center has, and shall maintain, a

sufficient number of instructors who are qualified in accordance with subpart Cof this part to perform the duties to which they are assigned;

(b) The training center has designated, and shall maintain, a sufficient number of approved evaluators to provide required checks and tests to graduationcandidates within 7 calendar days of training completion for any curriculumleading to licences or ratings, or both;

(c) The training center has, and shall maintain, a sufficient number of management personnel who are qualified and competent to perform requiredduties; and

(d) A management representative, and all personnel who are designated by thetraining center to conduct direct student training, are able to understand, read,write, and fluently speak the English language.

142.11 Facilities

(a) An applicant for, or holder of, a training center certificate shall ensure that -

(1) Each room, training booth, or other space used for instructional purposesis climatically controlled, ventilated and lighted to conform to localbuilding, sanitation, and health codes, and

(2) The facilities used for instruction are not routinely subject to significantdistractions caused by flight operations and maintenance operations atthe airport.

(b) An applicant for, or holder of, a training center certificate shall establish andmaintain a principal business office that is physically located at the addressshown on its training center certificate.

(c) The records required to be maintained by this part must be located in facilitiesadequate for that purpose.

(e) An applicant for, or holder of, a training canter certificate must have availableexclusively, for adequate periods of time and at a location approved by theDirector, adequate flight training equipment and courseware, including at leastone flight simulator or advanced flight training device.

(f) A training center certificate may be issued to an applicant having a businessoffice or training center located outside Indonesia.

142.12 Quality Control System

(a) A quality control system shall be established to ensure that the policies andprocedures described in the Training Procedures Manual are effectively inplace.

(b) The training center shall appoint a person who will be responsible to ensurethe integrity of the quality control program.

(c) The person appointed in accordance with paragraph (b) shall have:

(1) A minimum of five years experience as a pilot;

(2) Experience as a trainer and / or administrator at a recognized trainingcenter;

(3) Demonstrated ability to administer a quality control program.

(d) Each training center must meet the following requirements:

(1) Comply with its approved training course; and

(2) Provide training of such quality that meets the requirements of this part.

(g) The failure of a training center to maintain the quality of training specified inparagraph (d) of this section may be the basis for suspending or revoking thatorganization's certificate.

(h) When requested by the Director, a training center must allow the DGAC toadminister any knowledge test, practical test, stage check, or end-of-coursetest to its students.

(i) When a stage check or end-of-course test is administered by the DGACunder the provisions of paragraph (f) of this section, and the student hasnot completed the training course, then that test will be based on thestandards prescribed in the organization's approved training course.

(j) When a practical test or knowledge test is administered by the DGAC under the provisions of paragraph (f) of this section, to a student who has completedthe organization's training course, that test will be based upon the areas of operation approved by the Director General.

142.13 Satellite Training Centers

(a) The holder of a training center certificate may conduct training in accordancewith an approved training program at a satellite training center if -

(1) The facilities, equipment, personnel, and course content of the satellitetraining center meet the applicable requirements of this part;

(2) The Instructors and evaluators at the satellite training center are under the direct supervision of management personnel of the principal trainingcenter;

(3) The Director is notified in writing that a particular satellite is to beginoperations at least 60 days prior to proposed commencement of operations at the satellite training center; and

(4) The certificate holder's training specifications reflect the name andaddress of the satellite training center and the approved courses offeredat the satellite training center.

(b) The certificate holder's training specifications shall prescribe the operationsrequired and authorized at each satellite training center.

142.15 Display of Certificate

(a) Each holder of a training center certificate must prominently display thatcertificate in a place accessible to the public in the principal businessoffice of the training center.

(b) A training center certificate and training specifications must be made availablefor inspection upon request by -(1) An authorized representative of the Director;(2) An authorized representative of the National Transportation Safety

Committee, or (3) A law enforcement officer.

142.17 Inspections

Each certificate holder must allow the Director to inspect training center facilities,equipment, and records at any reasonable time and in any reasonable place inorder to determine compliance with or to determine initial or continuing eligibilityand the training center's certificate and training specifications.

142.19 Advertising Limitations

(a) A certificate holder may not conduct, and may not advertise to conduct, anytraining, testing, and checking that is not approved by the Director.

(b) A certificate holder whose certificate has been surrendered, suspended,

revoked, or terminated must -(1) Promptly remove all indications, including signs, wherever located, that

the training center was certified by the Director; and

(2) Promptly notify all advertising agents, or advertising media, or both,employed by the certificate holder to cease all advertising indicating thatthe training center is certified by the Director.

142.21 Training Agreements

A training center certified under CASR part 141 may provide training, testing, andchecking for a training center certified under this part if -

(a) The Director has approved a training, testing, and checking agreementbetween the certified training center and the training center;

(b) The training, testing, and checking provided by the certified trainingcenter is approved and conducted in accordance with this part;

(c)The training center certified under part 141 obtains the Directors approvalfor a training course outline that includes the portion of the training,testing, and checking to be conducted under part 141; and

(d) Upon completion of training, testing, and checking conducted under part141, a copy of each students training record is forwarded to the part 142training center and becomes part of the student's permanent trainingrecord.

142.23 Deviations or Waivers

(a) The Director may issue deviations or waivers from any of the requirements of this part.

(b) A training center applicant requesting a deviation or waiver under this sectionmust provide the Director with information acceptable to the Director thatshows -

(1) Justification for the deviation or waiver; and

(2) That the deviation or waiver will not adversely affect the quality of trainingor checking.

142.25 Validity, Suspension, Revocation and Surrender of a TCC

(a) Every training center certificate shall remain valid and in force unless;

(1) the holder voluntarily surrenders it to the Director;

(2) the Director decides to suspend or revoke the certificate either in wholeor in part,

(3) the training center knowingly violates a provision of its certificate or training specifications.

(b) Where a training center certificate has been suspended or revoked, it shall bereturned to the Director within seven days of receiving notice of suspension or revocation.

SUBPART B - AIRCREW CURRICULUM AND SYLLABUS REQUIREMENTS

142.35 Applicability

This subpart prescribes the curriculum and syllabus requirements for the issuanceof a training center certificate and training specifications for training, testing andchecking conducted to meet the requirements of CASR part 61 and 63.

142.37 Approval of flight aircrew training program

(a) Except as provided in paragraph (b) of this section, each applicant for, or holder of, a training center certificate must apply to the Director for training program approval.

(b) A curriculum approved under CASR part 121 or part 135 is approved under

this part provided that there are no modifications to the equipment facilities or personnel as laid down in the approved curriculum.

(c) Application for training program approval shall be made in a form and in amanner acceptable to the Director.

(d) Each application for training program approval must indicate -

(1) Which courses are part of the core curriculum and which courses are partof the specialty curriculum;

(2) Which requirements of part 61 or 63 of the CASR would be satisfied bythe curriculum or curriculums; and

(3) Which requirements of part 61 or 63 of the CASR would not be satisfiedby the curriculum or curriculums;

(4) where the program is to provide the training requirements of a 121 or 135training program paragraphs (1) to (3) of this section also apply.

(e) If, after a certificate holder begins operations under an approved trainingprogram, the Director finds that the certificate holder is not meeting theprovisions of its approved training program, the Director may require thecertificate holder to make revisions to that training program.

(f) If the Director requires a certificate holder to make revisions to an approvedtraining program and the certificate holder does not make those requiredrevisions, within 30 calendar days, the Director may suspend, revoke, or terminate the training center certificate under the provisions of 142.2.

142.39 Training Program Curriculum Requirements

Each training program curriculum submitted to the Director for approval mustmeet the applicable requirements of this part and must contain -

(a) A syllabus for each proposed curriculum;

(b) Minimum aircraft and flight training equipment requirements for eachproposed curriculum;

(c) Minimum instructor and evaluator qualifications for each proposed curriculum;

(d) A curriculum for initial training and continuing training of each instructor or evaluator employed to instruct in a proposed curriculum; and

(e) For each curriculum that provides for the issuance of a licence or rating infewer than the minimum hours prescribed by part 61 -

(1) A means of demonstrating the ability to accomplish such training in thereduced number of hours; and

(2) A means of tracking student performance.

SUBPART C - TRAINING COURSE OUTLINE AND CURRICULUM

142.45 Applicability

This subpart prescribes the personnel and flight training equipment requirementsfor a certificate holder that is training to meet the requirements of part 61 or 63 of the CASR.

142.47 Training Center Instructor Eligibility Requirements

(a) A certificate holder may not employ a person as an instructor in a flighttraining course that is subject to approval by the Director unless that person -

(1) Is at least 18 years of age;

(2) Is able to read, write, and speak and understand in the English language;

(3) If instructing in an aircraft in flight, is qualified in accordance with subpartG of CASR part 61; or

(4) Is approved by the Director; and

(5) Satisfies the requirements of paragraph (c) of this section.

(b) A training center must designate each instructor in writing to instruct in eachapproved course, prior to that person functioning as an instructor in thatcourse.

(c) Prior to initial designation, each instructor shall:

(1) Complete at least 8 hours of ground training on the following subjectmatter:(i) Instruction methods and techniques.(ii) Training policies and procedures.(iii) The fundamental principles of the learning process.(iv) Instructor duties, privileges, responsibilities, and limitations.(v) Proper operation of simulation controls and systems.(vi) Proper operation of environmental control and warning or caution

panels.(vii) Limitations of simulation.(viii) Minimum equipment requirements for each curriculum.(ix) Revisions to the training courses.(x) Cockpit resource management and crew coordination.

(2) Satisfactorily complete a written test(i) On the subjects specified in paragraph (c)(1) of this section; and(ii) That is accepted by the Director as being of equivalent difficulty,

complexity, and scope as the tests provided by the Director for theflight instructor airplane and instrument flight instructor knowledgetests.

142.49 Training Center Instructor and Evaluator Privileges and Limitations(a) A certificate holder may allow an instructor to provide:

(1) Instruction for each curriculum for which that instructor is qualified.

(2) Testing and checking for which that instructor is qualified.

(3) Instruction testing and checking intended to satisfy the requirements of any part of CASR.

(b) A training center whose instructor or evaluator is designated in accordancewith the requirements of this subpart to conduct training, testing, or checkingin qualified and approved flight training equipment, may allow its instructor or evaluator to recommend for issue, endorsements required by part 61 of CASR.

(c) A training center may not allow an instructor to -

(1) Conduct more than 8 hours of instruction in any 24-consecutive-hour period, excluding briefings and debriefings;

(2) Provide flight training equipment instruction unless that instructor meetsthe requirements of 142.53 (a)(1) through (a)(4), and 142.53(b), asapplicable; or

(3) Provide flight instruction in an aircraft unless that instructor -(i) Meets the requirements of 142.53(a)(1), (a)(2), and (a)(5);(ii) Is qualified and authorized in accordance with subpart G of

CASR part 61;(iii) Holds licences and ratings specified by part 61 appropriate to

the category, class, and type aircraft in which instructing;(iv) If instructing or evaluating in an aircraft in flight while occupying

a required crewmember seat, holds at least a valid second classmedical certificate; and

(v) Meets the recency of experience requirements of part 61 of CASR.

142.53 Training Center Instructor Training and Testing Requirements

(a) Except as provided in paragraph (c) of this section, prior to designation andevery 12 calendar months beginning the first day of the month following aninstructors initial designation, a certificate holder must ensure that each of itsinstructors meets the following requirements:

(1) Each instructor must satisfactorily demonstrate to an authorized

evaluator knowledge of, and proficiency in, instructing in a representativesegment of each curriculum for which that instructor is designated toinstruct under this part.

(2) Each instructor must satisfactorily complete an approved course of ground instruction in at least -(i) The fundamental principles of the learning process;(ii) Elements of effective teaching, instruction, methods, and

techniques;(iii) Instructor duties, privileges, responsibilities, and limitations;(iv) Training policies and procedures;(v) Cockpit resource management and crew coordination; and(vi) Evaluation.

(ii) Included line-oriented flight training of at least 1 hour of flight duringwhich the instructor was the sole manipulator of the controls in aflight simulator that replicated the same type aircraft for which thatinstructor is designated to instruct; or

(3) Each instructor must have participated in an approved in-flightobservation training course that -(i) Consisted of at least 2 hours of flight time in an airplane of the same

type as the airplane replicated by the flight simulator in which theinstructor is designated to instruct; and

(ii) Included line-oriented flight training of at least 1 hour of flight duringwhich the instructor was the sole manipulator of the controls in aflight simulator that replicated the same type aircraft for which thatinstructor is designated to instruct.

(c) An instructor who satisfactorily completes a curriculum required by paragraph(a) or (b) of this section in the calendar month before or after the month inwhich it is due is considered to have taken it in the month in which it was duefor the purpose of computing when the next training is due.

(d) The Director may give credit for the requirements of paragraph (a) or (b) of this section to an instructor who has satisfactorily completed an instructor training course for a part 121 or part 135 certificate holder if the Director findssuch a course equivalent to the requirements of paragraph (a) or (b) of thissection.

142.55 Training Center Evaluator Requirements

(a) Except as provided by paragraph (d) of this section, a training center must ensure that each person authorized as an evaluator -

(1) Is approved by the Director;

(2) Is in compliance with 142.47, 142.49, and 142.53; and

(3) Prior to designation, and except as provided in paragraph (b) of thissection, every 12-calendar-month period following initial designation, thecertificate holder must ensure that the evaluator satisfactorily completes acurriculum that includes the following:(i) Evaluator duties, functions, and responsibilities;

(ii) Methods, procedures, and techniques for conducting required testsand checks;(iii) Evaluation of pilot performance; and(iv) Management of unsatisfactory tests and subsequent corrective

action; and

(4) If evaluating in qualified and approved flight training equipment mustsatisfactorily pass a written test and annual proficiency check in a flightsimulator or aircraft in which the evaluator will be evaluating.

(b) An evaluator who satisfactorily completes a curriculum required by paragraph(a) of this section in the calendar month before or the calendar month after themonth in which it is due is considered to have taken it in the month is which itwas due for the purpose of computing when the next training is due.

(c) The Director may give credit for the requirements of paragraph (a)(3) of thissection to an evaluator who has satisfactorily completed an evaluator trainingcourse for a part 121 or part 135 certificate holder if the Director finds such acourse equivalent to the requirements of paragraph (a)(3) of this section.

142.57 Aircraft Requirements

(a) An applicant for, or holder of, a training center certificate must ensure thateach aircraft used for flight instruction and solo flights meets the followingrequirements;

(1) Except for flight instruction and solo flights in a curriculum for agriculturalaircraft operations, external load operations, and similar aerial workoperations, the aircraft must have an airworthiness certificate or a foreignequivalent of an airworthiness certificate, acceptable to the Director.

(2) The aircraft must be maintained and inspected in accordance with -(i) The requirements of part 91, subpart E, of CASR; and(ii) An approved program for maintenance and inspection.

(3) The aircraft must be equipped as provided in the training specificationsfor the approved course for which it is used.

(b) Except as provided in paragraph (c) of this section, an applicant for, or holder of, a training center certificate must ensure that each aircraft used for flightinstruction is at least a two-place aircraft with engine power controls and flightcontrols that are easily reached and that operate in a conventional manner from both pilot stations.

(c) Airplanes with controls such as nose-wheel steering, switches, fuel selectors,and engine air flow controls that are not easily reached and operated in aconventional manner by both pilots may be used for flight instruction if thecertificate holder determines that the flight instruction can be conducted in asafe manner considering the location of controls and their non-conventionaloperation, or both.

142.59 Flight Simulators and Flight Training Devices

(a) Each flight simulator used to obtain flight training credit allowed for flightsimulators in an approved pilot training course curriculum must -(1) Be a full-size aircraft cockpit replica of a specific type of aircraft, or make,

model, and series of aircraft;

(2) Include the hardware and software necessary to represent the aircraft inground operations and flight operations;

(3) Use a force cueing system that provides cues at least equivalent to thosecues provided by a 3 degree freedom of motion system;

(4) Use a visual system that provides at least a 45-degree horizontal field of view and a 30-degree vertical field of view simultaneously for each pilot;

and(5) Have been evaluated, qualified, and approved by the Director.

(b) Each flight training device used to obtain flight training credit allowed for flighttraining devices in an approved pilot training course curriculum must -

(1) Be a full-size replica of instruments, equipment panels, and controls of anaircraft, or set of aircraft, in an open flight deck area or in an enclosedcockpit, including the hardware and software for the systems installedthat is necessary to simulate the aircraft in ground and flight operations;

(2) Need not have a force (motion) cueing or visual system; and

(3) Have been evaluated, qualified, and approved by the Director.

(c)Each training aid, including any computer based audio visual aid, mock-up, chart, or aircraft component listed in the approved training courseoutline, must be accurate and appropriate to the course for which it isused.

(d) An applicant for, or holder of, a training center certificate must show that each

flight simulator and flight training device used for training, testing, andchecking must be approved by the Director for -

(1) Each maneuver and procedure for the make, model, and series of aircraft, set of aircraft, or aircraft type simulated, as applicable; and

(2) Each curriculum or training course in which the flight simulator or flighttraining device is used, if that curriculum or course is used to satisfy anyrequirement of CASR part 61,121, 135 or 141.

(e) The approval required by paragraph (a)(2) of this section must include -

(1) The set of aircraft, or type aircraft;

(2) If applicable, the particular variation within type, for which the training,testing, or checking is being conducted; and

(3) The particular maneuver, procedure, or crewmember function to beperformed.

(f) Each qualified and approved flight simulator or flight training device used by atraining center must -(1) Be maintained to ensure the reliability of the performances, functions, and

all other characteristics that were required for qualification;(2) Be modified to conform with any modification to the aircraft being

simulated if the modification results in changes to performance, function,or other characteristics required for qualification;(3) Be given a functional preflight check each day before being used; and(4) Have a discrepancy log in which the instructor or evaluator, at the end of

each training session, enters each discrepancy.

(g) Unless otherwise authorized by the Director, each component on a qualifiedand approved flight simulator or flight training device used by a training center must be operative if the component is essential to, or involved in, the training,testing, or checking of flight crew.

(h) Training centers shall not be restricted to specific -

(1) Route segments during line-oriented flight training scenarios; and

(2) Visual data bases replicating a specific customers bases of operation.

(i) Training centers may request evaluation, qualification, and continuingevaluation for qualification of flight simulators and flight training deviceswithout -

(1) Holding an air carrier certificate; or (2) Having a specific relationship to an air carrier certificate holder.

SUBPART D - OPERATING RULES

142.61 Applicability

This subpart prescribes the operating rules applicable to a training center certificated under this part and operating a course or training program curriculumapproved in accordance with subpart B of this part.

142.63 Privileges

A certificate holder may allow flight simulator instructors and evaluators to meetrecency of experience requirements through the use of a qualified and approvedflight simulator or qualified and approved flight training devices if that flightsimulator or flight training device is -

(a) Used in a course approved in accordance with subpart B of this part; or

(b) Approved for meeting recency of experience requirements.

142.65 Limitations

(a) A certificate holder shall -

(1) Ensure that a repositioning feature is used during line operationalsimulation for evaluation and line-oriented flight training only to advancealong a flight route to the point where the descent and approach phase of

the flight begins.

(b) When flight testing, flight checking, or line operational simulation is beingconducted, the certificate holder must ensure that one of the followingoccupies each crewmember position:

(1) A crewmember qualified in the aircraft category, class, and type, if a typerating is required, provided that no flight instructor who is givinginstruction may occupy a crewmember position.

(2) A student, provided that no student may be used in a crewmember position with any other student not in the same specific course.

(c) The holder of a training center certificate may not recommend a trainee for alicence or rating, unless the trainee -

(1) Has satisfactorily completed the appropriate training specified in thecourse approved under this part; and

(2) Has passed the appropriate final tests required by this part.

(d) The holder of a training center certificate may not graduate a student from acourse unless the student has satisfactorily completed the curriculumrequirements of that course.

(e) The certificate holder shall provide to a trainee, upon request and at areasonable time, a copy of his or her training records.

SUBPART F – OTHER APPROVED COURSES

142.81 Conduct of Other Approved Courses

(a) An applicant for, or holder of, a training center certificate may apply for approval to conduct a course for which a curriculum is not prescribed by thispart.

(b) The course for which application is made under paragraph (a) of this sectionmay be for crewmembers other than flight crewmembers, including flightattendants, dispatchers, material handlers, ground servicing personnel,security personnel and others approved by the Director.

(c) An applicant for course approval under this subpart must comply with theapplicable requirements of subpart A through subpart F of this part.

(d) The Director approves the course for which the application is made if thetraining center or training center applicant shows that the course contain acurriculum that will achieve a level of competency equal to, or greater than,that required by the CASR part or parts under which such applicant isoperating.
