am an estate agent, and my business operates as a limitedcompany. I own the premises which the business usespersonally and I charge rent (plus VAT) to my limited company.

My accountant has told me that, unless I stop charging rent whenI sell the premises, I will not be able to claim Entrepreneurs Reliefto reduce the Capital Gains tax on the sale. What should I do?

Entrepreneur’s Relief (ER) can reduce the tax rate on qualifyinggains to 10% up to a lifetime limit of £10 million (Compared toa tax rate of 18/28% normally). Assuming that your limitedcompany meets the necessary ER conditions then if you were tosell the building/premises at more or less the same time as thebusiness then you could qualify for Entrepreneurs Relief on bothdisposals, which can save substantial amounts of tax.

However, and this is what your accountant is taking about, theamount of Entrepreneur’s Relief is restricted if.

• The building has not been in use in your business throughout its period of ownership.

• The building is only partly used in the business. • Rent has been charged.

If rent has been charged then the tax relief will be restricted byreference to the proportion of the market rent which wascharged. This catches many people in your situation out as theprevious taper relief rules did not include this restriction.

Your accountant should be able to do some calculations toshow the impact of the rental payments to date and goingforwards on your position.

OK, well I am planning to sell my business and the building in afew years and retire, so I will stop charging rent straight away! Isthere anything else to think about?

Yes, isn’t there always! Stopping charging rent can sometimeslead to a major VAT headache. If the building has ‘Opted toTax’ which means that VAT was not suffered when it waspurchased and VAT is charged on the rent, then ceasing therent means that you may not be making taxable supplies, andyou will be obliged to deregister for VAT. This willunfortunately give rise to a VAT liability of 20% of the MarketValue of the building. I have heard of several examples wherethe tax man has caught up with unwitting taxpayers in exactlyyour position, so good advice is vital.

Finally, the Chancellor gave his Autumn Statement onWednesday, and it is possible that Capital Gains Tax rules maychange...Watch this space!

And afterplenty of negative reports claiming first-timebuyers had no chance of getting onto theproperty market we embraced the market’snewfound optimism, bringing you news of thegovernment’s latest schemes to help first-timers take the plunge as well as the launch ofthe third annual First Time Buyers Show.

Iconic brand Harvey Nichols announcedplans to open a new concept store in the cityand anyone looking to be their own boss in2012 was given a helping hand thanks to theMerseyside Franchise Show 2012.

FEBRUARYPolitical fever gripped Liverpool in Februaryas the debate over whether or not the cityshould have an elected mayor gathered pace.We took to the streets to get your views; withthe majority of you deciding a new form ofleadership would be a good thing. However,while we gave you a chance to have your saythe council did not, with council members

voting 63 to three in favour of skipping areferendum and heading straight into amayoral system.

It was a great month for LSL Land and NewHomes, which scooped a gong at the EstateAgency of the Year Awards, sponsored by theSunday Times. And Paul Crowley & CoSolicitors announced it would be extending itshugely successful free legal clinics.

MARCH

The start of spring brought plenty to smileabout for would-be buyers as momentumcontinued to build for the First Time BuyersShow 2012 and the government launched abrand new initiative to help get the housingmarket moving. NewBuy was developed toencourage lenders to lend more by removingsome of the risk involved. Developers and thegovernment would underwrite the mortgage,providing a guarantee for banks.

However, it wasn’t all good news. The stampduty holiday, which saw first time buyersexempt from paying the tax on propertiesunder £250,000, came to an end on March 24.

One of Liverpool’s most iconic buildings,the magnificent Albany, was given a new leaseof life as its newly refurbished apartments wereput on the market by City Residential.

Meanwhile Andrew Louis became the firstagent in the city to use cutting edge iPad 3technology to market its properties.

Riverside opened a brand new show home atits Millbrook development and Abodecontinued its growth with the recruitment ofStephanie Walker as a new agent.

JULYThe Olympics were the big event of thesummer with the likes of Jessica Ennis andMo Farah doing us proud. Meanwhiledeveloper David Wilson Homes was busywinning gold too, receiving the Gold Awardfor customer satisfaction following anindependent national survey. More than 200customers of the developer were surveyedover a 12-month period and every customerquestioned said they would recommendDavid Wilson Homes to others.

AUGUSTAugust saw the typical British summer reachnew depths as the annual Matthew StreetFestival and the dance music extravaganzaCreamfields were both called off due to badweather.

But while the weather may have beenmiserable the industry certainly wasn’t.Indeed, there were celebrations all round asPaul Crowley opened a new branch in WestDerby, Go Direct Lettings welcomed a newfranchisee and renowned interior designedElaine Cunningham scooped the Best Lifestyleaccolade at the Liverpool Business Awards.

SEPTEMBERThe Merseyside Landlords Expo 2012 wasone of the highlights of September withhundreds of visitors – from experiencedlandlords to newbies – descending on theCrowne Plaza hotel to make the most of thefree event. With 30 exhibitors and a jam-packed seminar schedule the event proved tobe the best one yet.

A new initiative that aims toset new standards forLiverpool landlords isgaining momentum.

LiverpoolCityCouncil’s TenPoint Pledgeplans toreward goodlandlords andtarget those

who provide an unsatisfactoryservice is gaining momentum

The pledge sets out a balancedapproach to assisting goodlandlords, whilst at the same timemaking it clear that unsatisfactoryhousing and poor standards ofmanagement will not be tolerated.

A key part of the pledge is theCitywide Voluntary RegistrationScheme, which is now up andrunning.

Landlords can register theircontact and portfolio details(although the council will acceptjust contact details if landlords havereservations about sharing theirproperty addresses).

Registered landlords will haveaccess to Property Pool Plus foradvertising vacant properties andmore incentives will be madeavailable for good landlords.

A rogue landlord hit squad hasalso been created. It will seek outand investigate non-compliantlandlords and letting agents, takeappropriate action and publicisesuccessful prosecutions.

Now councillor Ann O’Byrne iscalling on all private landlords inLiverpool to support the pledge.

She says: “Being a registeredlandlord will allow us tocommunicate with you and keepyou in the loop with updates onthe pledge.“Let’s continue to build positiverelationships with landlords in thecity, raise the profile of the goodlandlords and leave the roguelandlord hit squad to take care ofthe minority of poor landlords.”

The Educate Awards 2012shone a spotlight on thesuccess of Merseysideschools with a glitteringawards ceremony at theCrowne Plaza Liverpool on3 December.

Harrogate-born Russell Harris made his name as a TV and radio presenter, frontingthe likes of “The Dice Man” and “I own Britain’s best home”. He also caused a stir onthe property scene when he bought and renovated an old water tower in Lymm,

Cheshire – turning it into a state of the art home. Now he has turned his hand to art,exhibiting his work for the first time at Corke Gallery on Aigburth road. We caught

up with the man of many talents ahead of the exhibition.

You’re a property developer, designer,artist and TV presenter – which camefirst? Which is your first love? I’m a TV

presenter really. I actually started out as a

club DJ, working in Southport. I’ve done

lots of radio and television, so I’m a

presenter first and foremost. The property

developing and art came later.

Have you always been creative?Yes. I make films for a living, that’s what I

do now. I produce TV. Whether it’s

musically or visually, I’ve always been

doing something creative. It’s all been

leading towards this point of getting into

painting really.

You’re well known for converting thewater tower in Lymm, which hasrecently featured in Kevin McCloud’slatest book as one of his top 75 housesin Britain. Tell us a bit about that project.We bought it 15 years ago in 1997 and spent

seven years renovating it. We’ve been living

in it ever since. It’s 90 foot high and has six

floors. It’s got 5,500 square foot of floor space

and there’s a hot tub on the roof. It’s

fantastic. We’re very lucky and we worked

very hard to achieve it, there was a lot of

blood, sweat and tears. It has won lots of

awards, including one from the Royal

Institute of British Architects (RIBA). It’s

quite an iconic building.

You’ve presented plenty of TVprogrammes, what’s been your favouriteshow? I’m most well known for a show

called ‘The Dice Man’ which was fantastic.

A friend and I went round the world with a

dice, throwing the dice to determine what

we did next. It was good fun. It’s amazing 12

years later we’re still selling DVDs of the

series and it still gets shown around the

world. The thing I enjoyed most is the fact

that people got it. It’s awful to do a

programme that no one notices but they

really embraced it. The most recent thing

I’ve done was a programme for channel five

called ‘I own Britain’s best home’. It was

great getting to see people’s houses.

Your work will soon be exhibited at theCorke Gallery, how did you get into art?I’ve always wanted to paint. I’ve been

inspired by people like Damien Hirst and I

thought ‘Why not? What’s stopping me?’ I

rented a studio in the Northern Quarter in

Manchester and build some kit that I needed

to produce the work and got on with it.

Your pieces are based on spin art, canyou explain what that’s about? It’s no

mystery, I’m not a trained fine artist. I built a

machine, I fit the canvasses to the machine

and spin them at high speed and then I put

the paint on. What I’d like people to take from

this exhibition is that everyone can do it.

Finally, what are your plans forChristmas? I’ll be sitting in the hot tub in

my roof garden, 90-feet above the Cheshire

countryside, with snow falling all around,

the family, the bells of the local church

peeling and a glass of Leffe beer...what

could be more perfect?

“I can look at the city fromthe West Tower and quitehonestly know that I’vehad a massiveinvolvement in theshaping of Liverpoolover the last fewyears,” he says.

The Liverpoolbranch of the globalcompany actually soldLiverpool’s tallest building,the West Tower to Delph inJune for an undisclosed sum.

And it’s not the first time JLLhas been involved with such aniconic building. The residentialteam looks after properties inOne Park West, Mann Island,Hope Street, Canning Street,Faulkner Square, the TowerBuilding and apartments on topof the Hilton Hotel.

Jones Lang LaSalle is aproperty juggernaut, the second

largest property firm in the worldwith 40,000 staff in 70 countriesand a turnover of £3.5 billion ayear. The company took overKing Sturge’s Liverpool office 18months ago and since then theteam based on Castle Streethaven’t looked back. Thebranch’s annual turnover thisyear is its second best since theoffice originally opened in 1998.

I meet Martyn for lunchat the Yacht Club in

the heart ofLiverpool Marina,which is underthe newownership ofAdam Franklin,the man behind

Franklin’s Delisin the city. With a vista view of

the marina’s yachts andboats, we are presented with therestaurant’s new winter menu. Itcomes with an interesting delitwist, which is no surprise giventhe new owners lineage.

I opt for a steak ciabatta whileMartyn indulges in one of hisfavourite dishes the croquemonsieur.

Over our beautifully presentedmeals hand delivered by the chef,Martyn tells me about the latest

property Jones Lang LaSalle hasbeen working on.

The beautiful building,situated at 2 Canning Street, sitsfacing the imposingly beautifulAnglican Cathedral in the muchsought after Georgian quarter.Breathtaking inside and out, thehigh-end decoration andstunning original features meanthat the development won BestShow Apartment in the YourMove Property Awards 2012.

“It’s been very popular,” saysMartyn. “In the last few yearsthere have been so few newprojects, it’s mainly old stockbeing churned out, so whensomething high quality and newcomes to the market, people canget really excited about it.”

The response from the publichas been excellent, since thelaunch two weeks ago three ofthe apartments have alreadysold with just two now left onthe market. Martyn’s croquemonsieur is also well received, aSwiss cheese and ham toastedsandwich topped off with ayolky egg.

The steak on my ciabatta isexactly the right texture andcomes with tangy mustardmayonnaise, which goes down atreat.

As we tuck in I’m intrigued toknow just what it is about JonesLang LaSalle that attracts such aroster of large clients throughtheir doors for commercial,residential and investmentproperty deals.

“What clients love about JonesLang La Salle Liverpool is thatit’s a one stop shop,” saysMartyn. “Our clients can feelcomfortable that they’re gettinggood quality advice on allproperty matters from one of themost renowned internationalcompanies in the world.”

Looking ahead to next yearMartyn tells me that there areseveral high profile projectsJones Lang LaSalle is set to beinvolved in.

The company will also re-launch West Tower for the newowners and market theremaining properties in MannIsland phase 2.

Indeed, it looks like 2013 is setto be as busier than ever for JonesLang LaSalle and, as a man whoobviously loves what he does, it’sclear Martyn wouldn’t have it anyother way.

The Ice Festival, an original take on a classicwinter wonderland, has taken over Liverpool ONE’schavasse park. It took 25 tonnes of crystal ice tocreate the bustling ice rink, ice bar, ice sculptures, theUK’s largest ice slide and of course Santa’s Grotto forthe little ones.

For something a little icier than average visit thefestival where there will be free live ice carvingdisplays throughout December and warm mulled wineand hot chocolate available to warm you up.
