SERVICE CHARGEFrom safety of the building tolandscaping of gardens, servicecharge is an all-encompassingexpense for every owner of aflat in a building, paid to acompany who manages thebuilding.

It is normal practice fordevelopers today to set up ablock management company forthe building and employ amanaging agent uponcompletion of a new-build. Theblock management companydeals with the utilities such asthe electricity in the communalarea, lifts, landscaping,cleaning, insurance, andmaintenance for the exterior ofthe building.

The managing agent collectsthe service charge and dealswith day to day issues. Theyalso assess the level of serviceneeded for the building, such as

whether to have a concierge,and do a proposed budgetreport which is used tocalculate the level of servicecharge.

Each leaseholder of anapartment is effectively ashareholder (with one vote) inthe company who can vote onhow the budget is spent, whatthe service charge should beand choose the managing agent.

So why appoint a managingagent at all? Running abuilding is as complex asrunning a business. As LouisAnastasiou, managing director

of Andrew Louis, explains, therole of a managing agent isessential to running a buildingwell and preventing ownerslosing value on their home dueto a badly maintained exterior.

“We manage in excess of 60buildings in Liverpool,Manchester and Hull,” hecommented. “As a managingagent we get discounts on bulkpurchases and certain contractslike lifts, cleaning, building andmaintenance and we pass thosediscounts on. We present aquarterly management reportand we say how much we have

spent on your block andcompare it to the budget.Accountability is veryimportant.”

As part of its transparencypolicy, each developmentmanaged by Andrew Louis hasa website. Each websiteincludes budgets, a buildinginsurance certificate,newsletters, a payment section,financial accounts andreporting repairs.

RIGHT TO MANAGEWhat happens though when abuilding has no blockmanagement company? Thebuilding still has a managingagent but they are only legallyaccountable to the freeholder,leaving the leaseholders withvery little say on maintenanceand service charge cost.

over the management of theirresidential building. There isstill a large number ofapartment blocks in Liverpoolwhere the developer is thefreeholder. They appoint themanaging agent but no blockmanagement company. Thenumber of disputes across thecountry over service charges isrising fast, but challenging aproperty management companyor freeholder through a tribunalcan be a lengthy, demanding andexhausting process.

The road to Right to Manageis legally a relativelystraightforward procedure andyou don’t have to prove theexisting managing agent is atfault. All you need is at least 50per cent of leaseholders onboard, and the building self-contained with at least 75 percent of it residential.

Ian Magenis, partner atScanlans Property Management,explains: “This legislation existsto give leaseholders theopportunity to take control ofthe running of theirdevelopment. It’s surprisinghow few apartment owners areaware of the Right to Managelegislation and how they can

take advantage of it. “At Scanlans Property

Management we are gettingmore and more calls for help insetting up Right to Manageschemes. In many cases, the cost ofsuch an action can be recoveredwithin the first year of theleaseholders taking control via thesavings they can achieve.”

There are many examples where

charges are excessive, includinginflated insurance premiums andpayments towards the flatprovided for the live-in managerappointed by the freeholder.

“In some cases, residents look

to the Right to Manage schemeto ensure there is completetransparency over servicecharge administration,” headded. “Leaseholders want theassurance that they themselvescontrol how their developmentis run, rather than this beingcontrolled by a third party.”

Scanlans PropertyManagement are managing

agents who are also offeringflat-owners without a blockmanagement company freeadvice on how to begin theprocess of Right to Manage.

SERVICE CHARGEDODGEROne service charge dodger andeveryone suffers. Non-paymentof service charge is in breachof a lease and can lead to legalaction and eventuallyrepossession. Louis Anastasiou explainedthe problems when one personthinks they can get awaywithout the charge. “If toomany people don’t pay then wedon’t have the funds to carryon providing the service for theblock and that is a major issue.Sometimes you have to cut thelevel of service. If there’s nomoney in the account thenunfortunately services willsuffer so it’s important thatpeople not only pay but pay on

time. On some blocks you canget as high as 25 per cent ofleaseholders not paying theservice charge.”On behalf of the managingcompany, a managing agentwould send out the overdueletters, with enough time forowners to pay or negotiate apayment plan. Following on from previous amnesty arrangements fordentists, medics and holders of offshore bank accounts, thetaxman is now encouraging plumbers and those in associatedtrades to come clean.

Under the PTSP (Plumbers Tax Safe Plan) plumbers (andother taxpayers) are given the opportunity to fix any leaks intheir tax affairs, by making what is called a voluntarydisclosure to HMRC. In return they will be offered lowerpenalties of 10-20% on any unpaid tax, compared with upto 100% normally. The scheme despite its name is alsoavailable as a general tax amnesty.

HMRC are following up this incentive with a threat to trackdown errant plumbers using information they haveobtained from Gas Safe (formerly CORGI).

The areas which the taxman will be focusing on arelikely to be:

‘Cash’ JobsPlumbers have been singled out because they do a lot ofcash work, and the taxman believes that tradesmen inreceipt of cash may not have declared all of their income.They will also be on the look out for businesses andindividuals which have breached the VAT registration limits,but not registered for VAT.

Over claimed ExpensesMany plumbers are self-employed and so have the potentialto incorrectly claim expenses for working from home, forhome to work travel and for subsistence.

Training costsTraining to become a plumber is costly, and some plumbersmay have been tempted to incorrectly claim the cost of thetraining and course fees to obtain their registration.

If anyone has not yet told HMRC that they have startedworking for themselves then the PTSP offers an opportunityto make a fresh start.

Anyone thinking of entering the PTSP scheme will haveuntil 31 May to notify HMRC of their intentions so theymust act quickly.

� Liverpool is set to get anew Enterprise Zone, aimedat boosting business indeprived areas. Thegovernment announced‘Mersey Waters’ had beenchosen as the EnterpriseZone. The area straddles theRiver Mersey, and coversboth sites of the 30-yearregeneration projects - WirralWaters and Liverpool Waters.

Companies will benefit fromsignificant tax breaks if theyrelocate or set up new operationshere with benefits including taxbreaks, up to 100 per centdiscounts on rates, fast-trackplanning procedures and super-fast broadband.

� One of Merseyside’sfavourite attractions,Knowsley Safari Park, is tocommemorate its 40thanniversary later this year -and asking people to join inthe celebrations.

The safari park is planning anexhibition, which will look back atits four decades of caring for exoticanimals from all over the globe.Knowsley bosses want contributionsfrom visitors to be a key part of thesummer show. Situated on thefamous estate of Lord Derby, the vastreserve, which opened in July 1971,is home to many different animalsincluding elephants, giraffes, lions,bongos, tigers and baboons.

General Manager, David Ross,explained: “As well as covering themajor milestones in our history, wewant the exhibition to reflect theimpact the park has had on somepeople’s lives. This could be becausesomeone has visited us hundreds oftimes over the years, or because abride was proposed to in front of thebaboons in our monkey jungle.

“We want visitors to get in touch

with their stories, photographs andexamples of old park memorabilia toprovide a human angle to theexhibition.”

Knowsley was the first safaripark in the country to be createdclose to a large city - just eightmiles from Liverpool City Centre.It aimed to replicate theexperience of visiting the drive-through game reserves of EastAfrica, with humans caged in theirvehicles and animals running wild.

Today, its 550 acres of parklandare home to more than 700 animalsliving in near-natural conditions,including many endangered specieslike the white rhino and PereDavid’s Deer.

What do you remember about growingup in Liverpool? I grew up in a tenementin Parliament Street, with my nan andgranddad, mum, dad and four brothers. Wewere poor, but if everyone else is the same,you don’t know you’re poor, do you? Atschool the teachers said I was thick. When Iwent in that was. A lot of times I stayed athome looking after my mum, who was badwith her nerves, but lovely with it, and mylittle brothers. There were things thathappened that weren’t nice, but there werelots of good times too. When you’re playingout as a kid, everything else goes out of yourhead. Walking up Parliament Street was areal experience in those days – all thedifferent smells. It felt alive.

How did the book come about? Nobodyknew I’d written one. I learned to read andwrite at adult education classes when I was25 or 26, and we wrote about our lives toimprove our writing. I would write thenshove it in the draw. I filled two drawersthen four. I wrote to make sense of my life.There was no beginning, middle or end. I

wrote lots and lots of poems too. There wasa time I washed a pound note in myhusband’s trousers, and ironed it to make itstraight again. That’s the last time I’ll launder money, I wrote.

How did you become a stand up comic?I have a lot of nervous energy. I would saysomething and people would say, you shouldbe on stage. I’d say, ‘me? I’m about as funnyas piles.’ I entered a few competitions andwon them but although I’d been in somefilms and TV, I never did anything like thatother than for charity nights.

About seven years ago I had just had someoperations for cancer and afterwards I justdecided to start life again. So I went toSpain and started being a comedian.

How did Benidorm come about? I wasworking every night at hotel El Presidenteand Captain Morgan’s Tavern in Benidorm.One night two men and a woman came inand said they were writing a TV series andwere looking for someone to play the personwho runs the hotel. One of the men wasDarren Litten, the series’ writer. Morgan’sTavern is actually Neptune’s Bar in theshow and for the first few episodes I wouldfilm at Morgan’s during the day and be backthere at 6.30pm to do my own show.

What do you think of your character,Janey York? I love her. With Janey, what

you see is what you get. I can imagine herwhen she was young, going round thinkinglife was going to change, but she’s still stuckthere. I’m nothing like her. I’m happier!

Are sun, sand and free cocktails youridea of relaxing? No, I don’t drink! I loveNew York and Prague because I lovebuildings and history. I don’t like sun orsand, probably because I had it for sevenyears. I couldn’t wait to get indoorseveryday after filming. I was like MissHaversham, skin as white as a sheet.

Everyone slates Benidorm, but it’sbrilliant. It’s like Blackpool in the sun oreven Vegas. It’s like being back in the olddays when there were social clubs.

Where do you go out when you cometo Liverpool? I hardly go out. But I go toMecca Bingo on East Prescot Road oneSunday every month with my friendMargie. The bingo caller, Steve, is an oldfriend of mine and we do a lot of charitywork together, like raising money forcancer. I see people there I grew up with.I’m not Crissy Rock to them. They say,‘have you had any luck,’ and I say ‘no’.

Aftera decade of working at thetheatre he went solo, setting uphis own business, Bill ElmsAssociates.

Over a freshly-made lunch, hecommented: “I don’t think Icould have set my company up

before 2008, and be takenseriously but because culturewas very much in people’sminds after 08 it seemed theperfect time - I would say Istarted my company as a resultof the Capital of Culture.”

The business has grown fromstrength to strength over thepast few years, establishing itselffirmly as an arts marketing andPR service. With the success ofhis most recent projectTutankhamun: His Tomb andHis Treasures exhibition at theMuseum of Museums inManchester (over 150,000 peoplevisited), Bill has successfullyexpanded into the regionalmarket. “The company ischanging slightly with the type

of clients we’re getting,because we’ve made a

really nice transitioninto festivals andexhibitions whichworks really well.”

frittata and tomato salad, wenote the constant good food ofthe Bistro and lament itsdeparture. “I’m here all thetime,” Bill comments, digginginto the frittata with gusto. “Ilove the food, there’s nowherelike it in Liverpool. When I

started coming here, it wasincredibly arty. This was theplace to be seen, i-D magazineused to come down andphotograph people it was soexciting coming here. The food is always fantastic and it’sa great crowd that come inhere.”

Although there willnot be an EverymanBistro as we knowit after July, thenext year for Billpromises to be avery busy one.Physical Fest,Liverpool Pride,Brazilica, the relaunch ofJudy and Liza, Polar, St HelensTheatre Royal and so muchmore.

“Liverpool has always been onthe map in the UK as a festivalcity. The international physicaltheatre festival, Physical Fest, isgoing to be a great addition tothe Liverpool festival scene.Liverpool Pride is going to bebigger and better than last year’sand we’re going to attract a lotmore people and make sure it’son the gay calendar.

“I’m really excited about thebrand new festival Brazilica inJuly, which is an internationalsamba carnival. It was theLiverpool samba parade, whichdidn’t end up anywhere, anincredible amount of work wentinto these costumes and floats

and it was phenomenal so afestival seemed appropriate.”

Bill Elms Associates has alsotaken on the marketing and PRcontract for St Helens TheatreRoyal. With the expansion intoregional PR and marketing,what is the future for Bill and

his company? “I don’twant to move out of the

arts, I think thereason we’resuccessful is becausewe specialise. Whena big event is coming

to the city I want tobe the first person they

choose to work on aproject. At the moment the

majority of larger tours, forexample Les Miserables, themarketing all tends to be doneby London companies which arenot always the best for theregions. I would like to see mybusiness in the next few yearstaking on the big tours as well asdoing the big regional events.”

he Liverpool Half Marathon was declared ahuge success with thousands of people takingto the streets in a friendly run. The winner

was Ben Fish, from Blackburn, who completed the13-mile course with a time of one hour and sevenminutes. The Half Marathon took runners fromWapping Dock, along the historic sites of theAnglican Cathedral, Princes Road Synagogue,through the warm breeze of Sefton Park and alongOtterspool Parade. The Half Marathon is one of aseries of events for local runners this year, with thehighly anticipated return of the LiverpoolMarathon in October.
