"Deadline Sale" protocols

A Deadline Sale is in essence a simplified

tender, with or without price guidance and

without the formality and with more flexibility.

It is favoured over tender for these reasons with tender now being

reasonably rare.A property is promoted over a

brief campaign inviting offers to be submitted by purchasers before

a specified time on a specified date - the Deadline. After the Deadline, the vendor generally has five working days to determine which offer is most attractive, and if necessary to negotiate price and/or terms with one, or more, of the offerers. During this period none of the offers can be withdrawn.

The offer is made on a pre-prepared standard Auckland District Law Society Sale and Purchase form to which any special requirements of the vendor have been added. A property LIM, copies of the titles and other material required for an interested party’s due diligence is obtained and available from the agents early in the marketing campaign. The marketing time frame usually enables the purchaser to arrange their finance well prior to the deadline.

The objective is to enable purchasers to make their offer unconditional when presented, however the method of sale allows purchasers to add clauses to suit their circumstances, such as being conditional upon the sale of their property.

As with all offers for purchase there are two components for a vendor to consider – price and conditions (terms). A lower, unconditional offer may be more acceptable to a vendor than a higher offer with conditions, as an unconditional offer gives certainty.

It is therefore beneficial for an offeror to complete all due diligence before the Deadline and make an unconditional offer.

Unlike a tender where the offers must be submitted on the due date in a sealed envelope at a determined place, the flexibility of deadline sale allows an offer to be delivered or emailed to the agent by the deadline. The integrity of

the deadline sale method is based on confidentiality. The only parties that will know the contents of an offer are the sales personal involved in the process, the vendor and the vendor’s advisors.

Unlike a tender, where the offers are all presented at that specified time and date, an offer can be presented at any time prior to the deadline.

Thus if a purchaser elects to submit an offer prior to the Deadline, the Vendor is free to accept that offer if they so wish. This situation is rare but can occur when an offer is made and the Vendor believes they will not achieve a better offer by completing the campaign.

If an early offer is made a salespersons best practice is to consult all other parties known to them who are engaged in due diligence on the property, making them aware an early offer has been received and allowing them the opportunity to also make an offer prior to the deadline.

Other parties are given a very short time frame (24 to 48 hours or as the vendor directs) in which

October is always an exciting time and, this year, those interested in flower gardening in

Masterton have an extra reason to be excited.

The combined efforts of the staff at Queen Elizabeth Park, under the guidance of Doug Bailey, and the stalwart volunteers from the Friends of the Park have brought the vision of a restored herbaceous border to fruition.

In years gone by, the main border was the floral feature of the park, with a mix of small trees, flowering shrubs (many of them uncommon), perennials, bulbs and annuals to create flowering interest all year round.

For the past few years, the bed has been a sad and sorry sight, lying fallow as decisions were made about restoring it to its glory.

The Friends of the Park stepped up and provided a lot of the finance for the new planting, as well as either growing some of the varieties out of their own gardens, or arm-twisting other gardeners (myself included) to provide pots of plants.

It is all planted now and, although it will be a year or two before it reaches its glory, there are already a few plants providing some flower interest.

I was keen to see how my plants had survived being planted out and was pleased to see some Pacific Coast irises in flower in clumps. I had broken up a large clump of a purpleflowered hybrid of my own breeding, and was pleased to see that it seems to have shifted all right and was already in flower.

As an aside, I wandered across to the iris garden around the fernery, planted with money donated by my grandparents and named in their honour.

A friend had sent me a

photograph he took on Friday of the light blue Pacific Coast iris I had planted in the bed a few years ago and it looked fabulous, covered in flowers.

Today, it presented quite a different sight and I don’t know how I feel about it — someone has taken all the flowers and there are only a few buds left.

I suppose part of me thinks it is an honour they chose my flowers to take, but on the other hand it is annoying someone would steal public property like that.

To get back to the border, one of the other plants in flower is the yellow Corydalis lutea. This is a perky little flower, with bluntly spurred golden yellow flowers, blooms intermittently from late spring to early autumn. It has pale green, slightly glaucous leaves and forms a compact, fern-like mound. This is a very useful plant as it will grow in many different situations — it is great for borders, for the rock garden or the woodland garden.

It can cope with most well-drained soils in full sun to partial shade but prefers not to dry out too much. It will be well suited to growing in the slightly shaded garden of the new main border.

Among the plants in flower is a pretty pink Bergenia Cordifolia. These are very hardy plants and probably not as well known as they deserve to be. In years gone by, most gardens would have had a clump of these plants, somewhat unkindly called “elephants ears”, due to their longevity and hardiness. The most common colour is a slightly shouty pink but there are some beautiful varieties with much classier flowers, including a delightful apple blossom pink one in flower in Library Square at the moment.

These are tough plants and will survive in almost any conditions, including slightly moist and slightly shady as well. Their glossy green leaves and heads should entitle them to more popularity than they currently enjoy.

There are a few clumps of Heuchera and Tiarella, two closely related species that have become enormously popular during the past few years. The Heuchera are largely foliage plants, and very valuable for that purpose, but the Tiarella also flower very attractively, with spires of white flowers. I think the variety in the new planting is Iron Butterfly. Whichever one it is, it certainly has well cut green-bronzed foliage with black fingers down the centre of each lobe — slightly Goth looking, but it also has reasonably large fragrant flowers popping up out of the foliage.

Tiarellas have usually been regarded as woodland plants but it seems they can cope with a bit more sun as they are now found in all sorts of conditions.

No woodland garden would be complete without some hostas, and there are two or three different varieties on display in this new garden — a blue foliage form is just coming out, while a golden variegated one has popped some crisp new leaves out too.

There are other coloured foliage plants in the garden, including some lovely blue grasses, a variegated grass or two, the bright little sedge, Carex Evergold, and the brightly coloured Polemonium Stairway to Heaven, with its white and green foliage and blue flowers later in the season.

One of my favourite plants from our garden is also featured — the decorative lung wort (doesn’t that sound a terrible name?)

Pulmonaria Majeste. These plants earn their common name, and their Latin name actually, because of the supposed likeness of the foliage to the lungs. Despite that they are great garden perennials. This variety has clusters of light pink buds that open to deep-blue bells. Once the flowering season is over this plants should be trimmed back in order to rejuvenate the foliage.

One plant in the garden is likely to scare some newbie gardeners — a large plant of Tradescantia, looking for all the world like that pernicious weed Wandering Willy on steroids. Don’t fret — it is a brother, but this one is well behaved, and although it is vigorous, it will never outstay its welcome. As long as no one steals it, that is.

Make sure your pool fencing is up to scratch

With the days getting warmer and summer

just around the corner, swimming pools are great selling pools

for your home, so adequate fencing

is a must for any potential buyer.

As the homeowner you are responsible for making sure everyone in your neighbourhood is safe from the risk of drowning in your pool.

Under the Fencing of Swimming Pools Act 1987, the Building Act 2004 and the council bylaws, all swimming pools and spa pools must be fenced.

The Building Act applies to the construction of new pools and alterations to existing pools. The Fencing of Swimming Pools Act was enacted to protect young children from falling into unfenced swimming pools.

If you don’t have a pool yet, but are thinking about installing one, you first must apply for and be

granted a building consent. The council will inspect the fencing before issuing a code compliance certificate.

Under the act, the council can enter your property if they suspect you have an unfenced pool.

The minimum height for a pool fence is 1.2 metres above ground level and no space under the bottom of the gate or fence can be greater than 100mm from the ground at any point.

Fences can be constructed from any type of material provided it is durable and complies with the building code.

However, living vegetation or hedges alone are not acceptable as pool fencing.

Gates and existing doors must open away from the pool and automatically close and latch when released from a distance of 150mm from the open position.

Horizontal support rails must be at least 900mm apart.

There can’t be any holes or gaps in the fence that may give a child access to the pool area, and there can’t be any objects close to the fence that could help children climb it.

Homeowners can ask the council for a fence exemption, but you will only get one if the council is satisfied there is no significant increased risk to young children from not fencing. Each council may have different rules and will treat each application individually.

Check with your council, but a locked cover over the spa pool may not necessarily be enough - it may also need to be fenced.

Fence placement

The fence can only enclose the immediate pool area but may include things used in association with the pool, such as changing sheds. You can’t fence a big block of your back yard and expect

to comply with the act, because children generally come and go in these areas freely.

A wall of the house may form part of the fencing if it complies with the act, but if the wall of the house has a door into the house, the door will need to be self-locking.

Who checks up on fences?

It is the owner’s responsibility to advise the council if they have a

pool, if it is not already aware of it.

It is also the owner’s responsibility to ensure the fence complies with both act requirements. Missing sections of the fence, or a gate that is not self-latching, must be replaced or repaired immediately.

The council could make you empty the pool and you could be liable for a fine for non-compliance.
